2:11Once again, thank you all for joining us
2:13today. Um, we have quite a few items on
2:16the agenda, but we'll start out with the
2:18uh
2:21I'll take it back. We do have um
2:25we'll start with the uh canvas. We'll go
2:27ahead and and do the administration then
2:29come back to the office. All right. They
2:32are in that order. I just didn't read
2:34them. At this time we'll have the uh
2:36canvas of the election and administer of
2:39office with follow
2:44[Music]
2:58the whole set.
3:01Okay. It goes down and comes back. If
3:05you do them one by one and then send
3:07them back. Yeah,
3:11expedited.
4:01This was the last
5:58looking
6:02for. Yeah, I think everybody's been
6:05struggling with internet.
6:10having a really hard time covering all
6:13of my conversations.
6:48Yeah.
6:53[Applause]
6:56Okay. At this time, can we get a motion
6:59to accept the canvas of the election?
7:02A motion to accept the canvas. Second.
7:07Okay, it's been moved and second. All in
7:08favor?
7:10Motion carries. Okay, it brings us to
7:12item number two. Administr administer
7:15office oath of office to the mayor.
7:21Take the glasses off.
7:46All right, mayor. I'm going to state the
7:48first line and then after that I'll ask
7:50you to repeat after me. Please raise
7:52your right hand. In the name of
7:54authority of the state of Texas, repeat
7:55after me. I Dr. I am the officer I Dr. I

8:12will to the best of my ability and will
8:14to the best of my ability to preserve
8:16protect and defend preserve protect and
8:18defend the constitution and law the
8:20constitution and law and laws of the
8:23United States and laws of the United
8:25States and of this state and of this
8:27state so
8:31You can sound right here.
8:35Is there
8:56Here
9:11you go.
9:19[Applause]
9:21Thank you so much for trusting me a long
9:23time.
9:41This is where you said my how the time
9:43flies. It's hard to believe the time has
9:46passed that quickly. But thank you so
9:48much, city of Crockett and all of you
9:50that uh cared enough to uh engage in
9:53voting. Thank you so much. And at this
9:56time it brings us to our recognition of
9:59visitors.
10:01And like I said once again, thank you so
10:04much for all attending. I thank my
10:05husband for coming in to cheer his wife
10:07on.
10:13He's glad to be here after 45 years with
10:16He's just glad to be here.
10:19If he's not here, you have to pretend
10:21it.
10:24Thank you so much for everything for all
10:26of you being here. So, at this time we
10:27uh we do recognize our visitors. We know
10:29that it takes a effort to come out each
10:31council meeting and we know that it's
10:34because of you that we get business done
10:36and we get it done effectively because
10:38we hear what you have to say. And so
10:40with that being said, we're uh
10:42recognizing of our visitors. We're now
10:44to the comments from the audience. And
10:46we do have one uh listed from Diane
10:49Rome. And as in past, for those of you
10:51that are not familiar, we do a
10:53threeminut limit and no one on the
10:56council will respond either way because
10:59it's not an agenda item. Thank you.
11:01Thank you, madam.
11:03On November 4th, Citizens of Crockett
11:06voted to terminate
11:09economic development, which is
11:11approximately 2 million dollar in debt.
11:15It passed over and after the debt is
11:17paid off in about three years, the
11:20halfent sales tax will continue to be
11:22collected and will go toward property
11:24tax relief. This was voted on passed by
11:28the citizens of profit on November 4th,
11:302024.
11:32This opposition will help the 50% of
11:35profit citizens who actually pay their
11:37property taxes.
11:39That being said, I don't know how many
11:41of y'all realize, but really truly only
11:4350% of taxpayers pay their taxes and all
11:48of us here.
11:51So, I'm here tonight to request the city
11:54to give a monthly report on how the
11:56funds of economic development is being
11:59used.
12:00How much of the monthly sales tax is
12:02going to pay off the $2 million debt?
12:06When economic development was in
12:07operation, questions were asked many
12:09times about why there could not be a
12:11monthly report. That never occurred. I
12:15realize it might be something different
12:17and to give this report, but hopefully
12:19you will see the need to keep the
12:21citizens informed. It is the taxpayers
12:23money.
12:25Now, I see a problem making this
12:27request, and this is because, as the
12:30mayor said, we're only allowed three
12:31minutes to make a comment. And as she
12:34reminds us, they can respond. You all
12:36cannot respond to us in any way council
12:38meeting about our concerns.
12:41So I guess the only way that we will
12:43know this can be done is if you do it.
12:47If for some reason you cannot make it
12:50and we need to know that as well. I
12:52thank you for allowing me the time to
12:54say this and I look forward to your
12:57decision regarding this matter. I think
12:59it's extremely important that
13:03be
13:05thank you. Thank you. Um that is at this
13:09time and that was the only uh
13:12request from the audience. So with that
13:15being said it brings us to to the next
13:18item approve of the minutes item number
13:20three regular session May 19th 2025.
13:24All of you had an opportunity to view
13:27them. I make a motion we approve the
13:30minutes. I second. It's been moved and
13:32second. All in favor?
13:34Motion carries. That brings us to the
13:37reports. Item number four, police
13:39department manpower and criminal
13:41incident report for May 2025.
13:45Good evening, Mayor City Administrator.
13:48Police department manpower and criminal
13:50activity report for May of 2025. Total
13:53of 16 officers, worked 2,800
13:58hours, manh hour hours, responded to 461
14:01calls for service, investigated nine
14:04traffic accidents, made 54 arrests,
14:08issued 490 traffic citations, completed
14:1183 reports, responded to 32 alarm calls,
14:1529 of those were false alarm. I
14:18entertain any questions you may have
14:19about a report.
14:25Does anyone have any questions?
14:30If not, thank thank you so much. Thank
14:32you. Thank you, Chief. Appreciate it.
14:34Okay. Uh bring us to item number five,
14:37fire department monthly activity and
14:39status report May 2025.
14:46Good evening, Mayor, council members.
14:49For the month of May, uh we had a total
14:51of 46 calls. 33 of those being in the
14:54city and 13 in our county response area.
14:58There's a further break down
15:00question.
15:04One thing we had a little rain to help
15:06you out a little bit.
15:08But over the 33 calls, half of them was
15:11storm related last night. So probably
15:14ran probably 15 calls so far during this
15:17last weather event. So we've been busy
15:22weather trees falling
15:24fire lines. Oh, I forgot about that part
15:27of it.
15:30Did y'all help with any of the the
15:32flooding? Any of the u community?
15:37We had a couple
15:40high.
16:04Thank you. That's good.
16:07Okay. All right. Any other questions?
16:10No. Thank you for your service. Okay.
16:12That bring us to item number six.
16:14Receive as information the Houston
16:17County Appraisal District fiscal year
16:192024 financial audit and fiscal year
16:222026 operating and collection uh
16:26budgets.
16:28Mayor and council. Those um I put those
16:31in your packet and it's under tabbed
16:33under uh the number six there. Yeah, to
16:36relate to agenda item number six. Um
16:39those are your a copy of the budget from
16:42the appraisal district um that they
16:46adopted for this upcoming year. As you
16:48know, we all contract ourselves and
16:51other government entities, taxing
16:53entities in the county contract with
16:55them for appraisals and uh for
16:58collections as well. So we all share in
17:00the cost after the budgets are adopted.
17:04And then I also have um one hard copy of
17:07the audit. It's available for council's
17:10review at any time here at city hall.
17:15How many people work out there?
17:22Does it show on here? Yes, sir. Um
17:24employment. Okay. Yes, sir. You got one,
17:27two, three, four, five.
17:32Uh, six
17:38looks like eight employees. Eight
17:40people. Okay.
17:44Has so we got salaries going to
17:46514,4757?
17:50Yes, sir. Um, on eight employees, they
17:53had a uh 4 and a.5% uh cola that they
17:58provided this year and that's what
17:59caused that increase.
18:03That looks pretty good.
18:07Hopefully we can afford one like that. I
18:09know. I agree. 100%.
18:14So, we just got a caller last year, did
18:182%.
18:23So, we go from 485 to 514.
18:37When does this need to be? It's already
18:41It's approved. Um that's their adopted
18:43budget. It's for information. Okay.
18:47Their board already
18:49um has adopted. So we pay for this out
18:52of our tax revenue. Yes.
18:58If you go further down, it'll there's a
19:00breakdown. I think it's on the maybe the
19:02last page or the second to the last page
19:04of the share split between all the
19:06taxing entities
19:11since there's two budgets. One's for
19:12operations, one's for operating and
19:14one's for collections.
19:47This is strictly for information. Yes,
19:49ma'am. For information. There's no
19:50action. There's no action required on
19:53Pretty good. pretty good. Since
19:55it'sformational, you have a time to go
19:58over in details with that.
20:05And I'm sure if you have any questions,
20:07you can contact them directly.
20:12Thank you. Would that do any good? Huh?
20:16Would that do any good? Well, they've
20:18approved it. I wouldn't say that they
20:20reapproved it, but I have no I'm sure if
20:23they the board has approved it, but it
20:25might help in the next time that they go
20:28to it. Number seven. No, ma'am. Okay.
20:31It's just for discussion with if nothing
20:33else on that one, that moves us to the
20:36next item,
20:38our business. Item number seven,
20:42consider and approve a recommendation
20:44from the planning and zoning commission
20:46to hold a public hearing regarding a
20:48proposed zoning district's change from M
20:52manufacturing warehouse and wholesale
20:56selling district to R2
20:58family residential district with a strip
21:01of properties bordered by Martin Luther
21:03King Bullet King Jr. Boulevard on the
21:07east Sycamore Street or Sycamore Street
21:10right of way on the west and west
21:13goladed Avenue on the north and Berles
21:16Avenue on the south.
21:19Mayor and council, um I have Miss [name]
21:23[name] here, um who is our
21:25administrative assistant, has been
21:26diligently working on this project. um
21:29she provided a a report in y'all's
21:31packet as well that that y'all have had
21:34time to look over. But we also have
21:36additional information to try to help
21:39council understand why we're deciding to
21:42do this in in a bigger block instead of
21:45peacemailing it with spot zoning. has
21:48we've gotten a few requests for some
21:50spot zones for residential use and we
21:53found out that our zoning map for this
21:55district is uh manufacturing which
21:59precludes that. So, we'd have to
22:01individually address each request for
22:03new homes. And we have an issue with all
22:07of the existing homes that are in that
22:09district who may run the risk of having
22:11a commercial business move in right
22:13beside them and with no with no way to
22:16stop it because it's it's all currently
22:17zoned as manufacturing uh district. And
22:21so, Miss [name], if you don't mind talking
22:24a little bit or and [name], I do have a few
22:28of the things that you sent me that I
22:29can share or show. But, hi, I'm a
22:33assistant for the city of Crockett and I
22:36act as the planning and zoning
22:38commission. Secretary [name], you know him
22:40as our code enforcement officer. We work
22:43together to develop this report. Um, I
22:46hope there's a lot of information in
22:48here. A lot of it self-explanatory, but
22:51if you have any questions, I'm just
22:53going to be here to help answer those
22:54questions.
22:57We do see this as an improvement to the
22:59area. As the court said, this was made
23:03manufacturing probably in the 1980s
23:05before the profit industrial park
23:07existed. So, at the time, it seemed like
23:09manufacturing would have been a good
23:11idea along the railroad, but um there
23:14were already houses especially to the
23:16north around West We have the first
23:19couple blocks are older homes. Uh
23:22there's a lot of vacant properties. Most
23:24of the property is vacant. So obviously
23:26it's not being used for manufacturing.
23:28There's not much interest. And new
23:30companies coming in are going to go to
23:32the industrial function. They're not
23:34going to come here. Uh the residents
23:38uh this would give them an opportunity.
23:40Right now they're non-conforming use. Um
23:43so sometimes if they want to sell the
23:45property or make improvements it is a
23:47hindrance and this would bring them into
23:49performance use. Uh also the
23:52infrastructure there is streets for
23:54residential or sewer for residential.
23:57It's not made for industrial use. Some
23:59of the u uh parcels might remain
24:03manufacturing. Uh I want to emphasize
24:06all we're requesting all the is
24:08requesting is that this be considered in
24:10the public hearing. So before they can
24:12have a public hearing and it's their
24:14idea to change a zoning district, city
24:18council has to approve. They have to
24:20submit a report to you and city council
24:22has to approve allowing them hearing to
24:26have the property owners come voice
24:28their opinions and including the
24:30property owners within 300 ft of this
24:33strip will also have the chance to voice
24:36their opinions changes. They will be
24:38provided. We're planning on providing
24:40each the owner the packet of information
24:43be as transparent as possible along with
24:46actually the little map of their
24:48property showing exactly what we're
24:50proposing plus uh not only mailing the
24:53packet public will go knocking on the
24:55doors talk to them make sure they
24:57receive the packet and have the
24:59opportunity to come speak at a public
25:01hearing and then public uh planning
25:04zoning will make their recommendation to
25:06the city council and y'all will have a
25:09public hearing also receive
25:11addition input if property owners want
25:13to come at that public hearing. They'll
25:15be advised of those public hearings. So,
25:17it's a lot of time to uh and we're not
25:19planning on having the PNZ public
25:22hearing until
25:23uh July 15th and then hopefully the city
25:28council public hearing unless it's
25:29tabled by PNZ instead of making
25:31recommendation will be uh July 21st.
25:34That's a lot of time to further look at
25:36the report and be familiar with
25:41is being recommended
25:43because I think there have been a lot of
25:46requests for residential and not
25:49manufacturing and that's the way that
25:51we've heard and since it is residential
25:53in front if people were wanted to do it
25:56the street would have on both sides and
25:59I think in terms of building communities
26:03it would be more beneficial than having
26:06a manufacturing in front of someone's
26:08house and So I I you know just from
26:12looking at it and knowing that area how
26:14long it's been vacant and how
26:17well if you have a nice house over here
26:19it's not very beneficial to you if you
26:21have something in front of you that's
26:22not very nice and so I think as a
26:25community now because I believe that Dr.
26:28[name] you're only strong as the weakest
26:31part of your community and so to look
26:33like a community you want people to have
26:36similar communities. So if you're trying
26:39to do it to improve your community, it's
26:42very hard if you have a diff a business
26:45right in front of you as opposed to your
26:48home area. And it kind of hinders what
26:51we like to think of as neighborhood
26:54community. And so in order to prove that
26:57has been an area because of the location
27:00that it's been hard to to grasp the
27:02community aspect because of how it has
27:05been developed in the past. So I'm
27:08thinking that anything you know that can
27:10bring it in more align with being a
27:13community instead of manufacturing
27:16community and that it would really add
27:19to enhance our community as a city so
27:23that we would know that this is a
27:24community and then they would be able to
27:26dialogue and develop what they want it
27:28to look like because it's very hard you
27:31know when you have too many diff
27:33different stations taking place and I do
27:36think we need to work on and since it's
27:38in a minority area, it just need to be
27:41kind of addressed in that sense that it
27:44can be more synchronized.
27:47That's [name]'s take on it.
27:50Is um his choice still available to the
27:54resident or the property owner as far as
27:56whether they wish to have a
27:58manufacturing zone or resident
28:00residential zone or would that just go
28:05as far as the the zoning?
28:09What the preliminary report is
28:11recommending is that the first two
28:14blocks from Goad uh down to Howard that
28:18all
28:19R2 residential duplexes. Yes, ma'am.
28:23Correct me if I'm wrong. Down to um
28:28down to
28:31you.
28:34Yes. Mhm. First half a block north
28:39um manufacturing and then the first
28:42block south stay manufacturing. South of
28:44that R three, north of that R two.
28:47Gotcha. Thank you. And the the process
28:51like uh like you had asked if one this
28:54hall current our goal is to align it to
28:57what the current uses are. So if
28:59somebody's living with a home there,
29:01they're likely going to want it to stay
29:03to become residential so they don't
29:05become a non-conforming use and have
29:07somebody move in beside them. So, but if
29:10there is another desire, say for a few
29:12parcels or or whatever, the public
29:15hearing process, if there's more people
29:18that come to it that are against it than
29:20that are for it, that's how that pro the
29:22public hearing process is divided out
29:24and we put it back in a report and bring
29:26it back to council and say, "Here's all
29:29the here's what the people wanted, okay,
29:31that are going to be directly impacted
29:34and within 300 ft on both sides." So
29:36moving all the way over another block at
29:38least in both sides direction everybody
29:41will have input is this what they want
29:43is this good okay or are there other
29:45considerations to take okay and then the
29:48planning and zoning makes a
29:49recommendation back to council and says
29:51hey this is this is what we need what we
29:53come up with and then y'all so there's
29:56multiple layers of of input from the
29:58community and then council okay so you
30:00will have a couple of areas that in uh
30:03in that location that will stay
30:05manufacturing along Bell where there is
30:08some current manufacturing or commercial
30:10type uses. Okay. Automotive. Yes ma'am.
30:14That is manufacturing.
30:16Again with reaching out to property
30:18owners
30:20he has expressed interest in buying the
30:23properties adjacent to his. And uh then
30:26the property next south of that that's
30:29where the old there's a huge commercial
30:32building there. Tabers. Tabers
30:36[name] Deere. Yeah, Tabers. We'll be ask
30:43you. He might want to tear down a
30:45commercial building and change it
30:47to keep it commercial. So that's the one
30:49block that we said on report M2
30:53because what's a shop next to it? So
30:55even that that barn area over there
30:57across from Tabers. Are you y'all
30:59looking at that as well? The water bar.
31:02Yeah. So that that's the railroad that's
31:04off of it. That's um that's what 300
31:09Martin King is their address. That's
31:12owned by the railroad. We're trying to
31:14get the railroad themselves to tear that
31:15down. Okay.
31:18The uh the one below it is the one she's
31:21referring to 1170.
31:24So partial 117 um right there. Yeah.
31:30[name] here. Yeah. Yeah. Okay. Butters
31:34that's actually quarters. Yeah. Carters.
31:38So, um Okay. So, even like I said, the
31:42location where actually where Tabers is
31:44across the street where Mr. Odds live
31:48462 right there on this
31:53board.
31:55Yeah. Like it's like a barn or whatever.
31:57Okay. So, what are what are we making
31:59it? Uh technically right now fall into
32:01the R2 one until he decides what he's
32:03going to do with it because right now I
32:04just use it for storage of agriculture
32:06equipment. It's currently zoned as R2.
32:09So it would match up with what we would
32:11like to move the rest of it. Well, it's
32:13currently manufacturing. It would fall
32:15into what we're recommending for R2
32:17because it is just a barn and the only
32:19thing that's in there is egg equipment.
32:20Okay.
32:22He's not right here manufacturing with
32:24it. This right here is is white not is
32:28white not R2. Yeah. It doesn't even show
32:30the road right there on that. Right.
32:31Okay. So, I think it could be based on
32:35that. We could zoom in and see it, but
32:37understand it's hard to say. It could be
32:40half the building on it. Yeah. Okay.
32:42That building covers close to that wall.
32:43Right. Right.
32:46Yeah. Okay. So, what we're doing right
32:49now is just deciding if we want to go
32:52forth with it and open it up so that the
32:54community would have their actual say on
32:56it. Okay. Are y'all just trying to
32:59just approving.
33:01Yes, ma'am. Any not trying to make it
33:03all residential? Most of it. Most of is
33:07currently being used as residential
33:10except for that's that would stay the
33:14same. That would stay commercial. That
33:16would stay commercial. Okay. That's the
33:18recommendation. Okay. And so even with
33:21the recommendation of be the hearing
33:23would start and everybody would get a
33:24the people themselves would have an
33:27opportunity to come in because what
33:29we're looking at is what the overall
33:31recommendation is but it will be done in
33:33hearings to initiate the process is what
33:36we're asking. Yeah. So the very bottom
33:38of it all the way at the bottom of the
33:40list of the bars we're looking at on all
33:43of those were added since this was
33:44change manufacturing but we don't know
33:47like I I haven't found where their
33:51permits came in residential homes in
33:53that area for in manufacturing. So so
33:58that was oh that was part of
33:59manufacturing as well.
34:02manufactur.
34:13I guess one of them was, but I don't
34:15know all at least one of them was
34:16through specific use permit, but it
34:18still puts it residential. So, people
34:20are still, even with it being
34:22manufacturing, people are just finding a
34:24way to make it res anyway. It makes more
34:27sense to make
34:30what the city wants. Yeah, I think that
34:32like you said, we're at a good point.
34:34Everybody's seeing what direction we
34:36would like to take and with that in
34:38mind, we're going to leave it up to the
34:40people what direction they desire, they
34:43plan to take. We're projecting and
34:45they're going to vote on what they
34:46really want. So, I think that this give
34:48but like I said, I think it's a good way
34:50of synchronizing a community because the
34:53more neighborhoods you have, the better
34:54off that you are and they're all on the
34:57same agenda.
34:59Uh, does anyone else have any direct
35:01question that won't be answered by? You
35:03said it's a lot of vacant property over
35:06there. Yeah. Yes. Yes. I think y'all
35:09going to try to y'all plan on doing
35:10something with it or just see right here
35:12all of these. It would be the community
35:15that would decide or how they're being
35:16used. Yeah. Somebody own the owners.
35:20Yeah. These are all the owners and this
35:22is what currently being vacant. And
35:24those will be the people that will come
35:26forth and decide what they want, how
35:28they would like their their property to
35:30go. Yeah. So, it's not Yeah. It's not up
35:34to just the city to decide. It's own the
35:37property is owned. So, that's why the
35:39people are going to have to come in and
35:40vote on what they want to do with it and
35:43continue with it. And like I said, the
35:47the closer we get to it and the
35:49recommendation, we'll keep having the
35:51hearings until we come to consensus.
35:54Signs posted at every intersection a
35:57being considered with our phone number
35:59so that people can call in and say,
36:01"Hey, what's up?" On my property, I want
36:04mine to be this, of course. Yeah. Okay.
36:06Uh any other uh general comments?
36:10If not, we need
36:14I uh mayor a motion to I make a motion
36:19to consider an approved recommendation
36:21from the planning and zoning board uh
36:24commission to hold a public hearing uh
36:26regarding the the proposed zoning
36:30district change from M manufacturing
36:34warehousing and wholesaling district to
36:37R2 to family residential.
36:40etc.
36:42I second. Okay, it's been moved and
36:45second. All in favor? Motion carries.
36:48Okay, so we all go
36:52asking.
36:58Okay. Okay.
37:02Okay. At this time, since we do have our
37:04attorneys and they're on the clock, we
37:07don't know if they're on the clock
37:08officially yet, but they are here. Uh,
37:11can we get a recommendation just to go
37:12into our exeive executive session at
37:16this time
37:18just and then we'll come back and finish
37:20the remainder of the agenda. Mayor, I
37:22recommend that we go into executive
37:23session. Okay. Do we have to vote on it?
37:26We just recommend You don't have to
37:28though, but Okay.
37:30All right. Okay. If it's at that time,
37:33we're going to ask uh you can sit down
37:35and y'all even get to sit in here. We're
37:37going to leave
37:40and we need to bring Okay, we will go
37:43into executive session because they're
37:45attorney
37:47and then we'll come back.
37:50But if you would like to go get a a
37:53drink or a bathroom break, it'll be a
37:55minute.
37:58Come on.
38:04[Music]

1:04:40first
1:04:42You know,

1:25:42members.
1:26:13You got two years.
1:26:19Maybe
1:26:21she will
1:26:23now.
1:26:37We had
1:26:39the day before
1:26:44we also
1:26:55thought
1:26:57One last
1:27:25technology. Sure.
1:27:39Captain
1:28:19Well, they should tell you
1:28:22not in

1:30:53sat in the car.
1:30:57It is cold in here. Oh, well, last time
1:31:00was too hot and then too cold.
1:31:03I guess when all the body heat went out,
1:31:04it got cold. I got to go.
1:31:08Trying to keep us from passing out.
1:31:13[Music]
1:31:21My pen go. Somebody took my ink pin.
1:31:26Huh?
1:31:31Oh,
1:31:33you know, but you know what? They trying
1:31:36to get the word from around the world.
1:31:38Tower here, they sucking water from
1:31:40anybody. You know, we think Trinity.
1:31:44They're just they preparing for all that
1:31:46suck. You know that that big suck that
1:31:49building I mean, you know why can't go?
1:31:53They have a war. They came water. So you
1:31:58they thought they could use their own.
1:32:01All right. So we come back to it's
1:32:02covered under all of this. There's no
1:32:04more free water.
1:32:06They drain that lake to go all the way
1:32:09up to other. So we got to have some kind
1:32:13of protection. It's bad in California
1:32:15though. Oh yeah. It's bad. Like I said,
1:32:18when they suck all the ground water,
1:32:20we're going to all be in trouble. Okay.
1:32:22Is everybody everybody
1:32:25get
1:32:29[Music]
1:32:30back? What item was that?
1:32:33Yeah. What? Oh, that was our executive
1:32:35session.
1:32:44Okay.
1:32:46Who's missing?
1:32:48Well, Lord, you know, one would have
1:32:50thought we'd be fighting over water, but
1:32:52you know, Wild West fought over the
1:32:53whale and put up fence. Watch us stir
1:32:56the day. I said, "Oh, you know, we've
1:32:58been fighting over water for a long
1:32:59time."
1:33:10Okay. One, two. Who's missing? Oh, Gary.
1:33:14Here come Mr. Gary.
1:33:18I don't know why I call him Gary.
1:33:19[name]. I don't know where Gary. It is a
1:33:22Gary.
1:33:24Okay.
1:33:27Yes. Some caffeine is good.
1:33:31It's cold. So, we just on 17.
1:33:35We come in. We vote on 17. Is that where
1:33:38we were?
1:33:42What did he say? We just come back to
1:33:44just go through the rest. Oh, okay. Then
1:33:47we come to Okay. I think when we got we
1:33:49were we were on number eight for council
1:33:51just to move the table the
1:33:55time. Yeah, that's what I'm saying.
1:33:57Okay.
1:33:59Um
1:34:01Okay, we're officially back in session.
1:34:03We're up to item number eight. Consider
1:34:06and approve a resolution supporting city
1:34:08of Crockus application to the Texas
1:34:10Department of Transportation 2025
1:34:12transportation alternatives set aside TA
1:34:16call for projects. Mayor Council, I have
1:34:20um under your tab there number eight. Um
1:34:26I I'll give you just a quick update and
1:34:28on your in your packet as well um under
1:34:32item number eight. Um, I left mine in
1:34:36here.
1:34:38That's the We'll pull it up here. So,
1:34:41it's over there. Every year the uh
1:34:45every year the uh actually it's every
1:34:47two years. Tex comes out with a new
1:34:49budget and a and a application period.
1:34:52They set aside text funds that you can
1:34:56request um grant grant funds from for
1:35:00something called traffic alternatives.
1:35:01Usually that's um to pay for uh
1:35:04sidewalks or bicycle lanes. Um usually
1:35:07cities apply for bicycle lanes or
1:35:08sidewalks. Uh and we usually put in for
1:35:11it. Some years they call us back or they
1:35:14give us notice and say, "Hey, you're in
1:35:16the running. Go ahead and send in an
1:35:18application." Um the last time we got
1:35:20the funding for it was in 2019 when I
1:35:23got uh the grant for the sidewalks down
1:35:26East Golad. Um, and so that was funded
1:35:30from this traffic alternatives uh
1:35:32project. Uh, we've put in since then and
1:35:35haven't got the notice to call or the
1:35:37call for applications. Um, they gave it
1:35:39to us this time.
1:35:41However, this time our
1:35:45which I'm I've asked them to to look
1:35:47into it for next year, but this year
1:35:50we've already been categorized
1:35:53in a we did not get all the credit
1:35:55points due to our unemployment rate.
1:35:58Everything else met full granting 100%
1:36:01grant except for our unemployment rate
1:36:03and we didn't we didn't get those
1:36:05credits and due to that we have a 20%
1:36:08match
1:36:10since we did not get full credits. So
1:36:13any grant funds that we I can continue
1:36:15and I can go ahead and ask for um we
1:36:18have two projects that are already uh
1:36:20Texot has provided some pre preliminary
1:36:22engineering on both roughly um close to
1:36:26a million dollars and that's with
1:36:28easement acquisition engineering and
1:36:31everything for sidewalks for buoy from
1:36:34the square all the way to the loop and
1:36:37then um for Austin from South Fourth
1:36:41street
1:36:43um down out to the school. The red flag
1:36:46on that one is they will not approve any
1:36:50TA funds for crossings of railroads
1:36:52unless it includes engineering and the
1:36:55money for an overhead or an under
1:36:59that that you know they're not going to
1:37:00lead people up to the railroad tracks
1:37:01and cost and and and so we're going to
1:37:03have to include that into the budget.
1:37:05So, it'll be much more than a million
1:37:08dollars due to that um an overhead
1:37:11sidewalk crossing over the train tracks.
1:37:15So, that being said, now that we have to
1:37:16come up with 20%.
1:37:19I don't know that, you know, we're in a
1:37:21position right now that I think if we're
1:37:22spending 200 plus,000, we have other
1:37:26things that we need to spend it to in
1:37:28infrastructure outside of sidewalk. That
1:37:30being said, if it was state funding, I
1:37:33would highly recommend let's move
1:37:34forward with the sidewalks. So, the
1:37:37other project that I have, the other
1:37:40project that I have is a downtown master
1:37:43plan that was funded um also for another
1:37:46city in their last round. The city of
1:37:48Huntington got funding for a downtown
1:37:50master plan. All of my discussions with
1:37:53Texot
1:37:54end up with where's your downtown master
1:37:56plan? when I'm looking at leveraging and
1:37:59bringing in uh texttop funds to help us
1:38:02on sidewalks, crossings, parking,
1:38:05um lightings, stop signs, any changes to
1:38:09our downtown to make it safer. We need
1:38:12to have a downtown master plan that is
1:38:14developed by architect and engineers
1:38:18where they sit down and they look at the
1:38:21widths, the roadway widths, the speeds.
1:38:23How can they make it safer and come up
1:38:26with lots of different options to
1:38:28improve on parking, on traffic flow, on
1:38:32pedestrian safety, on sidewalks and
1:38:34crossings and things of that nature.
1:38:37um
1:38:39using u the city of Huntington's and
1:38:41their develop their project and the cost
1:38:44um if if you look in your packet that
1:38:47tab number eight is what our cost
1:38:50estimates that we're that we believe we
1:38:53should apply for what we did was that
1:38:55was two from two years ago so we added
1:38:57another 10% on top of that this is the
1:38:59budget that I'd like to apply for and
1:39:02then we would go through the process if
1:39:03if getting the grant if we do get the
1:39:06grant then we'll have to go out and, you
1:39:09know, call for engineers and find
1:39:11someone to do the project for us and
1:39:12I'll bring that back to council as well
1:39:14with an estimated cost.
1:39:16Um, but we would have a responsibility
1:39:19of 20% of that. I feel like with Tex
1:39:23having given us already quite a bit of
1:39:26they've already told us that they have
1:39:28construction budget monies in their 2026
1:39:32year and 27 28 fiscal years. They they
1:39:36do a a two-year fiscal for construction
1:39:39for all of our downtown streets. If we
1:39:42can get this downtown plan done in time,
1:39:45they'll commit more money to our
1:39:47downtown. Right now, all stay on those
1:39:50streets. Yes, ma'am. Right now, all
1:39:52they've committed to is restriping
1:39:54and putting pedestrian LED LED
1:39:57pedestrian flashing signs at the
1:39:58existing crosswalks. They have said that
1:40:01they'll do that and they'll also put
1:40:02some they'll paint some turn lane arrows
1:40:07in front of you to where you know you
1:40:10can't go straight. You're supposed to
1:40:11turn right to go around the square.
1:40:13Right. So, they're going to do some
1:40:14safety things like that, but they're not
1:40:15going to invest into any infrastructure
1:40:17until we uh get us a downtown master
1:40:20plan. And that master plan will include
1:40:23in developing that. That'll include
1:40:25community stakeholder hearings, uh, you
1:40:27know, public participation, council
1:40:30meetings. They'll come to council
1:40:31meetings and talk to council. Hey,
1:40:33here's some of our thoughts. What do
1:40:34y'all like? Do some joint sessions
1:40:36between us and the county and so forth.
1:40:39Um, and so I would recommend that we go
1:40:42ahead and apply for through the TA
1:40:46um, for that project to try to get at
1:40:48least 80% of a downtown master plan
1:40:51covered.
1:40:52What's the what's the difference between
1:40:55uh the master plan and a strategic plan
1:40:58for the city? A strategic plan breaks
1:41:02down a master plan. You know, if we get
1:41:05you're supposed to have master plans and
1:41:07then you can break it down into in this
1:41:09year, you know, year one we're doing
1:41:11this, year two we're doing this. It
1:41:14breaks down a a larger plan into sizable
1:41:18pieces. A downtown master plan is pretty
1:41:21specific to the downtown traffic. It's
1:41:23not a like a citywide master plan. Uh
1:41:27what we've developed is a comprehensive
1:41:30uh 3 years ago we did a comprehensive a
1:41:33city comprehensive plan which addressed
1:41:35a lot of the big needs such as housing
1:41:38um planning and zoning, parks and wrecks
1:41:41infrastructure. And that's just
1:41:46um very
1:41:49far side, you know, it's long range long
1:41:52range. These are the things we need to
1:41:54be concerned about. This is the money
1:41:56that we should start looking at setting
1:41:57aside for these projects, but it's not a
1:42:00strategic plan brought brought down that
1:42:02I can say, hey, we've adopted this
1:42:04strategic plan and this year we've
1:42:06committed to setting this much money
1:42:08aside for this, this much money aside
1:42:10for this.
1:42:11So would it be beneficial for us to to
1:42:13to um look at is send a strategic plan
1:42:17where we would focus on the city as a
1:42:19whole instead of one part of the city
1:42:22you know. Yeah. I think if if we develop
1:42:24this down this master plan then we could
1:42:27talk about a strategic plan. Yes ma'am.
1:42:29Most of it's just implementation. I just
1:42:31said one of the things that we had been
1:42:32work working on was looking at the
1:42:35downtown because of the number of
1:42:38streets that run through that don't
1:42:40belong to the city of Rocky even though
1:42:42we do it any funding we can get first to
1:42:45work with them that that's sort of
1:42:47cross-section and then when we broaden
1:42:48out like you said around the city we
1:42:51won't have that extra support and
1:42:53funding because all you know all the
1:42:55roads lead through Crockett you know
1:42:57sounding cute but those are textile
1:42:59roads there they don't belong on to
1:43:01Crockett. So any this is additional
1:43:03funding that we're we're going to be
1:43:05allowed to go after that's not directly
1:43:08from ours funding, but but the what we
1:43:11found out if we don't do our part with
1:43:14what we are capable of doing, we don't
1:43:16get their part and that's where we kind
1:43:19of bumped heads on. Even when they
1:43:21wouldn't fix the roads, they said until
1:43:22we fix our sew and our lines on it, they
1:43:25wouldn't even run the roads. That's why
1:43:27they kept getting a little more
1:43:28deteriorated until we were able to do.
1:43:31So, what we're proposing is, you know,
1:43:34what can we do that they're do their
1:43:37part and then we can go back. But we do
1:43:39have a plan, a strategic plan. We've we
1:43:41we've had them come in and look at it
1:43:43and it has been a longterm. It probably
1:43:45needs to be updated, but we've been
1:43:47hitting and missing at it simply because
1:43:49of the emergency of the roads and things
1:43:51that we've had busted lines have to
1:43:54address and those kind of things. So,
1:43:56where we are right now is addressing
1:43:59with this money even with the match 20%
1:44:03is better than the other 80% up to 100.
1:44:06If we can get the 80% from them, we can
1:44:09work back from that instead of just
1:44:11borrowing. We have to work where we can
1:44:13get the most money at this time. money
1:44:14is tight. We do know that. Uh so it
1:44:17would be beneficial for the city even
1:44:20though we we're going to do a long range
1:44:22plan but we have to work with where we
1:44:23are and if this grant is accessible and
1:44:26they've allowed us to apply for it again
1:44:29because they don't offer for you the
1:44:30invitation every year and I think it's
1:44:33to our advantage as a city to move
1:44:34forward what they're offering us and
1:44:36work around and then expand out to to
1:44:39core I mean to synchronize what we're
1:44:42actually getting from them. Yeah. Yeah.
1:44:45So, this is what the grant is about with
1:44:48the free money with 20% match if we're
1:44:50accepted. Downtown,
1:44:53it's when we're saying downtown is the
1:44:55surrounding area like the square which
1:44:58is considered
1:45:00what would y'all do downtown? No, not
1:45:02the not the building. We're talking the
1:45:04streets and the and the parking and the
1:45:08not development of the building so much.
1:45:10It's development of the transport the
1:45:12the routing more so than anything. I
1:45:15swear getting around it the best way it
1:45:18is. It's not doing individ individual
1:45:21businesses is doing how you get through
1:45:23Crockett with the least amount of
1:45:27danger. The square is dangerous
1:45:29sometime. But we do know that we've had
1:45:32um two different incidents just this
1:45:33past year of people getting hit. One
1:45:35woman had a lot of surgeries and
1:45:39recuperate, you know, rehab to go
1:45:40through. Um we've had deaths on the
1:45:43square where people have gotten hit.
1:45:44Yeah. Crossing um in our past and so um
1:45:48and lots of lots of close calls. Yes.
1:45:51Safety is an issue on the square. Well,
1:45:53you know, if you cross it if any this
1:45:54could be used to enforce the no trucks
1:45:57through, of course. Right.
1:46:00Okay. So, what we're looking for right
1:46:02now
1:46:04uh to a resolution supporting the
1:46:07application. Yes, we may or may not get
1:46:08it, but we at least can put an
1:46:10application for the money.
1:46:16I'll make a motion we approve the
1:46:17resolution.
1:46:19A second. Okay, it's been moved and
1:46:22second. All in favor?
1:46:24Okay, motion carries. That moves us down
1:46:27to number nine.
1:46:29consider and approve appointment of
1:46:31representative to serve on the board of
1:46:32directors for DP's Texas Council of
1:46:35Government.
1:46:37Uh mayor and council, this is um this is
1:46:40sent to us every year where we appoint a
1:46:44uh representative from the city of
1:46:46Crockett. The mayor, I believe since
1:46:48she's been here, has served in that
1:46:50position as representative. So, uh, this
1:46:53request for a nomination and
1:46:55appointment, um,
1:46:58back to that board.
1:47:02I nominate
1:47:04uh, Mayor [name] to continue to serve
1:47:06on the uh, decl.
1:47:09Okay, it's been moved and second. All in
1:47:11favor? Okay, motion carries. It brings
1:47:14us to item number 10. Consider an
1:47:16approved bid for phase two and three
1:47:19building renovation of the ProLis Center
1:47:21at uh 1505 South Street.
1:47:26Mayor Council, I have um bids
1:47:30um in your packet under items number 10
1:47:34as well as I have a couple additional
1:47:37umformational packets that I've put and
1:47:40it's under tab number 10. So,
1:47:45a couple months ago, we finalized all
1:47:46the engineering required for phase two
1:47:49and phase uh three construction of the
1:47:52uh Proalis building.
1:47:55If you look on that front page right
1:47:57there, and I was trying to pull it up,
1:47:58but it's timed out on my my screen.
1:48:04It's going to show you a bigger picture.
1:48:06So, if you see the darker area, that's
1:48:09phase three.
1:48:10If you see the hash marks over to the
1:48:13left with that front picture there,
1:48:16you see this
1:48:19right there. Um, if the hash areas,
1:48:22that's phase two. So, the goal is to do
1:48:25this because we currently have right now
1:48:27we have, as we speak, we have 42
1:48:29employees in there plus staff, local
1:48:31staff, but 42 locally hired people. Um,
1:48:35and they're trying to increase that by
1:48:37July. Their goal was to hire up to 60.
1:48:40Um, so they're continuing to hire people
1:48:42out there. They're currently situated in
1:48:45that white area in that white area. And
1:48:48over there, there's another building or
1:48:50there's another room that they're
1:48:51currently situated in for current
1:48:54operations. So, our goal is to go in and
1:48:56build out phase two, which is the hash
1:48:59marked area to the left. Okay. Build
1:49:02that out. Once that's complete, we move
1:49:04all current employees into phase two.
1:49:07while we do phase three. That's so we
1:49:10didn't have to wait for a year for all
1:49:12this construction and then go hire
1:49:15people. They were willing to hire people
1:49:16right away. And so it's kind of a phased
1:49:19approach to where we can work with
1:49:20people in the building while we're doing
1:49:22construction. So we hired Don Hill
1:49:25Architecture and Engineering Firm to go
1:49:27and put these specifications together,
1:49:29the bid specs. We went out for bid. We
1:49:33were talking to four different firms.
1:49:35Two of them ended up not putting a bid
1:49:37in due to the timeline. Provalis is is
1:49:40has really um requested.
1:49:44They have uh lots of of
1:49:49uh contracts
1:49:51that they can fulfill and hire more
1:49:53people.
1:49:55And
1:49:57I forgot where I was going with that. Is
1:49:59it that they did they not put a bid in
1:50:02because of Okay, that's where I was.
1:50:04That's where I was going. They needed
1:50:06for those two, right? So, those two
1:50:09contractors said they couldn't meet the
1:50:10the timeline. That's where I was That's
1:50:12what I was trying to tell you. They did
1:50:13say timeline or because of uh we hired a
1:50:18architect.
1:50:19We're required by law to hire an
1:50:21architect.
1:50:22We're required by law if we spend if we
1:50:24spend over $100,000 in public funds for
1:50:27a public building, we have to hire
1:50:28architect and um engineering.
1:50:32Um so that means the price doubles.
1:50:36Not in this case. Um using square
1:50:39footage, using the footage. Um, I do I
1:50:42do agree that if there's something that
1:50:43doesn't require architectural
1:50:45design and specifications that
1:50:49uh we can look at from a common sense
1:50:50level and go in and just paint a
1:50:52building or reheat rock it or doing
1:50:54things of that nature. But this we're
1:50:56changing the structure of a lot of this
1:50:58building, removing lots of walls to open
1:51:00it up. Their initial buildout of this
1:51:04building was right at 125 employees. By
1:51:07removing these walls, their goal is to
1:51:10increase it to 180.
1:51:13Um, by removing a bunch of the walls,
1:51:16and you're not trying to limit yourself
1:51:17to small rooms. Is there any walls out
1:51:19there that's that's uh loadbearing?
1:51:24None of them are loadbearing. None of
1:51:25them are loadbearing. However, they're a
1:51:28lot of them are fire rated and required
1:51:30by Well, we're ultimately we're taking
1:51:33the fire rating out.
1:51:36No, cuz you still have to engineer for
1:51:38fire and and escape routes. I'm not
1:51:42buying it. I understand. Um, however, if
1:51:46we go back to what's the legal
1:51:49requirement is over 100,000, we have to
1:51:51have architecture and engineering.
1:51:55Um,
1:51:58so that being said,
1:52:01we got two quotes. We got two bids that
1:52:05were submitted to our bid request. Uh we
1:52:08had the bid we had a hear the public bid
1:52:10opening uh last week and
1:52:14um there were two
1:52:18let me get it right here.
1:52:25Um
1:52:27on page 28 we received two bids. One of
1:52:31them was incomplete.
1:52:35They only bid on phase two. They didn't
1:52:37bid on phase three.
1:52:40And then there was other incomplete
1:52:42material items that were not included in
1:52:44the package such as bid um bonding. Uh
1:52:47their performance and bid bonding was
1:52:49not included. Um so it was an incomplete
1:52:53uh bid. However, if we look at just for
1:52:56phase two and we compare it to
1:52:59the other uh bidder, their phase two
1:53:03bid,
1:53:05Langston is still cheaper. Langster
1:53:07Langston Industrial Group out of Lufkin
1:53:11was the only fully qualified and
1:53:13complete bid. Um
1:53:17and it came in well our budget on the
1:53:19this buildout as you recall in our
1:53:22resolution and clo and closure of the
1:53:24EDC when we um designated funds uh for
1:53:28this construction uh we set aside
1:53:30$550,000
1:53:31to to dedicate towards this project and
1:53:34the bid with those alternates
1:53:41is um 300
1:53:45I'm sorry. Here it is right here. It's
1:53:47in that packet right under item number
1:53:4910. Um,
1:53:52uh, 391,400
1:53:55for all construction. That's redoing
1:53:58everything from the floors, grinding the
1:54:01floors down and all the old old flooring
1:54:03off, repainting everything, new walls,
1:54:05new HVAC,
1:54:07um, everything that is included in that.
1:54:09Have we allocated 550? Yes, sir.
1:54:16and he came in at 3 550 was my
1:54:21my best educated personal guess at it
1:54:25just using by the square footage and so
1:54:27I was very uh pleased to see that it
1:54:30came in under that um because we didn't
1:54:32have time to hire an engineer to give us
1:54:34a preliminary cost estimate. Yes. And
1:54:37so,
1:54:40um, and I do have these here.
1:54:45These packets here show many of their
1:54:47other projects.
1:54:50Oh, you see, you don't you don't get to
1:54:52see it. Anybody that you just pass it
1:54:54on. You don't these are some of their
1:54:55other projects here and back that
1:54:57they've currently been involved in in
1:54:58Lin area.
1:55:01And they've done construction in
1:55:02Crockett area too as well.
1:55:11Okay.
1:55:16So, in that agenda item,
1:55:18um if it they did they were able to get
1:55:21um
1:55:24contract in in time.
1:55:27I would I would request that we when we
1:55:29award the bid that we approve the moving
1:55:32forward with that price amount. The the
1:55:3539 391. Yes, sir.
1:55:40Award the bid to Langston Construction
1:55:44and approve the contract notice.
1:55:48Yeah.
1:55:53Any more questions, concerns?
1:56:19Is there any more question concern?
1:56:23Are we ready for motion?
1:56:28And they said that they could start.
1:56:30They would mobilize right away. I
1:56:32believe they were planning on starting
1:56:35officially by the end of the month, 1 of
1:56:37July, and being done by the last of
1:56:40September. 100 days, a 100 day
1:56:42construction period. Do we do we have a
1:56:45guarantee for that? And by their
1:56:47contract? Yes, sir.
1:56:50They don't they pay us?
1:56:53Okay. Any sounds
1:56:55other concern, questions?
1:56:58Can we get a motion? I'll make a motion
1:57:00that we consider and approve the
1:57:01construction of the administration of
1:57:03services. Uh that's Oh, we're on number
1:57:0610. I'm sorry. That too. Okay. Number
1:57:1010. Okay. Number 10. I'm sorry. Uh
1:57:12consider and approve the bid for phase
1:57:14two and three building renovations of
1:57:17the Provalis Center at 1505 Southport
1:57:20Street. I second. Okay. It's been moved
1:57:23and second. All in favor?
1:57:26And I would at not that you can get in
1:57:28the building, but you might after
1:57:30looking at the picture know some of the
1:57:32people that are working out there.
1:57:33They're really excited about it and they
1:57:36like their job.
1:57:39So I was really excited for them to have
1:57:41that many jobs close to home. Okay, that
1:57:45bring us item number 11. Consider and
1:57:47approve construction administration
1:57:48services of Dunb Hill Architect, Inc.
1:57:52for PLAL space phase 2 and three
1:57:54construction project maning
1:57:58this back with the the scope of this
1:58:00project
1:58:02um I would like the person that designed
1:58:06these specifications and bid them out
1:58:07and the same person that built this
1:58:10building in 2009 and 2010
1:58:14uh work with us to ensure that um draws
1:58:18when bid when drawdowns are submitted um
1:58:21that those are signed signed off on that
1:58:22the amount of work is being completed
1:58:24according to the percentage of the draw
1:58:26down and to ensure that the work is
1:58:28getting completed as
1:58:30as it was designed and engineered and
1:58:32that there's not any things that slip
1:58:34through the crack. We have a pretty good
1:58:36eye for it, but it you need an arch, you
1:58:39need a an engineer and an architect to
1:58:41sign off on those things to reduce our
1:58:43liabilities. And I would really like to
1:58:46have him there for those processes to
1:58:48take care of all the inspections so the
1:58:50city doesn't have to and take that
1:58:52liability upon ourselves because we're
1:58:54signing off on something that is
1:58:55complete and if we miss something, we
1:58:59bear the liability.
1:59:01A firm to do that and I have that in
1:59:04your packet as well. He's willing to do
1:59:06um all bid all inspections and bid
1:59:10administration or uh contract
1:59:11administration services uh for the
1:59:1414,500 for over the period of the next
1:59:17100 days.
1:59:20It's a small price to pay for guarantee.
1:59:23Yeah.
1:59:25Okay. Any questions?
1:59:33dollar.
1:59:36Okay. Um, like I said, it's you
1:59:38guarantee we see what we see. They know
1:59:41what's really there. So, yes, ma'am.
1:59:43We're covered.
1:59:44Okay.
1:59:46Can we get a motion? I move uh mayor to
1:59:49consider and approve the construction uh
1:59:53administration services of Mr. Don behel
1:59:56the architect uh in company uh for the
1:59:59puralis phase two and three construction
2:00:01project.
2:00:04And we get a second. A second. Okay,
2:00:07it's been moved and second. All in
2:00:08favor? Motion carries. Item number 12,
2:00:12award bid, Texas Division of Emergency
2:00:14Management Hazards Mitigation Grant
2:00:17Program, DR44850313,
2:00:22storm warning siren.
2:00:25Mayor, if you mayor and council, if
2:00:27y'all will go to y'all's packet again.
2:00:29Um, starting on page third
2:00:3332
2:00:3632,
2:00:38right? Let's see here. I believe it's
2:00:4032.
2:00:42Um, we have the bid
2:00:45the bids for the storm warning sirens.
2:00:48Um,
2:00:52and then on page
2:00:55uh 34. It shows the map
2:00:59and I wish I could pull it up on here,
2:01:00but it timed out again on us. Um so
2:01:06we got two bids
2:01:11and when going through the process, we
2:01:12were pretty excited about one
2:01:15uh looking at the cost. Um this is all
2:01:18um paid for under hazard mitigation
2:01:21grant program that we applied to using
2:01:23FEMA rollover funds.
2:01:26Um
2:01:28and when we started looking at the
2:01:29specifications, they were half the size
2:01:32of what the specified
2:01:35um or the required specifications were
2:01:38when we bid them out. They weren't the
2:01:40right sizing. Um we asked
2:01:44um
2:01:45different ways to go about it.
2:01:46Essentially TDM, Texas Department of
2:01:48Emergency Management confirmed um that
2:01:52we would have to go with the lowest
2:01:55qualified bidder or you know that met
2:01:57specifications. Mhm. The next contractor
2:02:01that met the specifications
2:02:04was um
2:02:06Crockett Construction and he'll be using
2:02:08Hullbrook
2:02:10for all the electrical and pulsating and
2:02:13uh Brandon Enus and his firm for company
2:02:16for all the electrical and software and
2:02:20programming and installation of the
2:02:22sirens themselves.
2:02:24um they use Crop Construction as the
2:02:26general contractor, but they won't be,
2:02:28you know, doing the work. They're
2:02:30overseeing the project and covering the
2:02:32bid bonds and performance bonding as
2:02:35required by law. Um and that would be a
2:02:38local a local contractor.
2:02:41alternate bid one. If you see if on page
2:02:45uh on page 35,
2:02:49you have alter alternate bid one and
2:02:51two. Alternate bid item number one we're
2:02:55not asking for. That is we were actually
2:02:57after talking with the contractors and
2:03:00our engineers.
2:03:02Alternate bid number one is a standalone
2:03:05solar system that provides the
2:03:08electricity for these sirens. They're
2:03:11not wired directly to electricity.
2:03:14Solar systems and batteries don't last.
2:03:18It's new technology and just batteries
2:03:20in in of itself just don't last. And
2:03:24we're looking at a cons consistent
2:03:27maintenance cost to this. If we went
2:03:30with the silver option, it's a it's a
2:03:32good idea if it's out in the middle of a
2:03:34field where there's never going to be
2:03:35any access to electricity or whatever.
2:03:38However, this these these are all on
2:03:40sites that have access to electricity
2:03:42and already have generator backups. We
2:03:44already they're on generators. So, even
2:03:46if electricity goes down, our storm
2:03:48sirens will still have access to
2:03:49generators. And so, we would we would
2:03:53recommend not going with alternate bid
2:03:54number one. However, alternate bid
2:03:56number two for an additional $2,000
2:04:00allows logging and report back systems
2:04:04that allow us to not have to go out
2:04:06there every 3 months or 6 months and run
2:04:09tests on the sirens and and set them
2:04:12off.
2:04:13It does an internal feedback and reports
2:04:16back since they're electronic. Mhm. Um
2:04:21it reduces someone liability as well and
2:04:24is not a interruption every few months
2:04:27for audio testing and people calling
2:04:31city hall and wondering what what
2:04:32happened and then they get used to it
2:04:34maybe and they stop calling city hall
2:04:36because they think it's another test.
2:04:40So our recommendation would be for that
2:04:42total package, the total base of 423
2:04:45plus alternate bid number two for a
2:04:47total of 425 to Crockett Construction.
2:04:51And our engineers did provide a letter
2:04:52in there as well. Um and they uh they
2:04:57agree that this meets this does meet
2:04:59specifications. This is a 100% grant.
2:05:03This is a uh 10% grant and we've already
2:05:07paid most of that in the upfront
2:05:08engineering costs already.
2:05:11Okay. So, we we we're responsible for
2:05:1410%. 10%. Yes. And we've already done
2:05:16most of that. Okay. The upfront cost of
2:05:19engineering and bidding and everything
2:05:21usually eats up that initial match.
2:05:24I'll make a motion we'll go with
2:05:26alternate bid number two. Uh base bid
2:05:29and alternate bid number two. base bid
2:05:32and alternate bid number two with proc
2:05:35construction. Croc construction. Yes,
2:05:37sir. Thank you. I see. It's been moved.
2:05:40Second. All in favor?
2:05:42Motion carries.
2:05:44Okay, that brings us to
2:05:4813
2:05:50to item
2:05:5313.
2:05:54Oh, you said I thought you said what
2:05:56else did you say? I thought you said
2:05:58open it back up. My bad. Uh consider and
2:06:01approve a resolution of the city of
2:06:02Crockett, Texas acknowledging the
2:06:04satisfaction of conditions of one and
2:06:07two in the few simple
2:06:09determinable condition of contained in
2:06:13the deed to ANA Texas Capital and the
2:06:16tax abatement and incentive agreement
2:06:19affirming the city's intent not to dis
2:06:21dispute the fulfillment of said
2:06:24condition and directing that condition
2:06:27three and paragraph three recapture for
2:06:31default be stricken from said documents.
2:06:35Mayor and council, um if y'all have
2:06:38questions, please stop me and ask me.
2:06:40Just uh just to re
2:06:43re uh restate this resolution. Um we
2:06:48placed for the first time in any of our
2:06:50negotiations with a a a
2:06:54business proposal that was saying, "Hey,
2:06:56we're going to do all of these things.
2:06:57They're making these promises to us when
2:07:00we negotiated with them on the land that
2:07:02they built the buildings out there on uh
2:07:06in the industrial park, the the big
2:07:07buildings. Um we put some clawback
2:07:11clauses that if they did not perform
2:07:14these three conditions that the title
2:07:17would the t the deed to the property
2:07:19would revert back to the city with no
2:07:21action necessary. That's something that
2:07:23we hadn't done in the past. And usually
2:07:26then it requires us going back and
2:07:27negotiating with them after they've
2:07:29decided to move on to another city or
2:07:31not come to Crockett. Then we're trying
2:07:33to buy the property back or you know get
2:07:35so
2:07:37in doing that it was a it was security
2:07:40for the city and remove the liability or
2:07:42the risk of them choosing to move away
2:07:45and then selling the property off or
2:07:47doing something else with it that we had
2:07:48no control over. Um, however, ANA Texas
2:07:52Capital moved in rapidly and achieved
2:07:56those conditions.
2:07:58Um, they're not in they're not in any
2:08:00default of those conditions currently.
2:08:03However, just as a short recap, and I do
2:08:06have their Mr. Gary White, their CFO
2:08:08here to also expound on anything that
2:08:10you guys have. Um, condition one says
2:08:15that within 12 months they they will
2:08:17begin construction. they did that.
2:08:20Condition two says within 3 years,
2:08:22within 36 months, they will have
2:08:24invested a capital investment of at
2:08:26least $3,630,000.
2:08:29Um, they've already done that to date.
2:08:33To date, and obviously the three years
2:08:34are not up, but to date, they've
2:08:36invested over $7 million. And Mr. Gary
2:08:39can talk about that.
2:08:42Condition number three,
2:08:45as I've said, they were expecting to
2:08:47invest somewhere between three to five
2:08:49million dollars initially when they came
2:08:51and proposed this project to us.
2:08:54As market conditions have changed,
2:08:57tariffs, whatever it may be, and they've
2:08:58decided, we're going to expand the
2:09:00project in Crockett to a greater extent,
2:09:03we're going to make that building even
2:09:04bigger. they've they're wanting to bring
2:09:07in local lending a bank to also help
2:09:11them to um to expand their project even
2:09:14more than they have currently done. a
2:09:18bank and looking at that deed with that
2:09:20pretty significant recapture clause. The
2:09:24recapture clause number condition number
2:09:26three says that if they if such
2:09:30default is the result of failure of
2:09:32developer owner to use the real property
2:09:34exclusively
2:09:36for a functioning facility to
2:09:37manufacture materials that enhance the
2:09:39durability of wood products.
2:09:42that clause
2:09:44is what they've asked and that what I
2:09:47personally agree is probably overly
2:09:50restrictive. If the market continues
2:09:52changing and they want to expand their
2:09:54product to something outside of wood
2:09:58preservation, they want to do some steel
2:10:00manufacturing or anything else, any
2:10:02other
2:10:05lines that they want to add and invest
2:10:07even more money and hire more people, we
2:10:09say they can't. So, if they've invested
2:10:12their money and the bank has invested
2:10:13another few million dollars and we say,
2:10:16"Hope, that's our property because you
2:10:17decided to expand even more, which is a
2:10:20good thing in all reality at this point
2:10:23with that major the amount of investment
2:10:25that they currently have out there. We
2:10:26don't want that property back because
2:10:27they're going to be paying taxes. Even
2:10:28if they don't hire jobs
2:10:31and they don't follow through, we don't
2:10:33want that property back. We don't want
2:10:34that much investment, capital investment
2:10:37or assets to worry about and become non
2:10:40and become tax exempt at that point. Now
2:10:43that they are fully invested in the city
2:10:45of Crockett and their funds and they
2:10:47want to further invest with bank
2:10:49lending,
2:10:51they're going to have to requitable.
2:10:56Well, how do you hold them to how do you
2:10:58hold them accountable to perform? I
2:11:00understand that you they're going to
2:11:02have to perform, but what is in the
2:11:05agreement to hold them accountable. Is
2:11:07there any way that we could go back in
2:11:09there and give other options for the
2:11:12clause? Because all the performance
2:11:14clauses remain in there. Okay. There's
2:11:16still performance clauses in there that
2:11:17says that they have to hire and be
2:11:21functioning for the next 10 years or
2:11:23they have to pay back um all tax
2:11:25abatements as well or any other
2:11:27incentives incentives that we provided
2:11:29them. So the recapture clauses are still
2:11:32in there. It's just this condition that
2:11:33says we're going to take the property
2:11:35back, right? We don't want the property,
2:11:37right? Okay. So basically, so just like
2:11:40I'm going to give you an example. So
2:11:42just like we have like Lincoln Lumber
2:11:44like right now Lincoln Lumber is no uh
2:11:46longer in business. Um and my
2:11:49understanding is they are so and and we
2:11:52went into agreement a partnership with
2:11:54the county. Right. So at this point in
2:11:57time when I looked at the recapture
2:12:00clause we're recapturing that property
2:12:02and the equipment. No ma'am.
2:12:05What what what are we doing? Cuz we did
2:12:07not provide them their property or their
2:12:09equipment or their building. So we can't
2:12:11recapture. So with it it this this um
2:12:16relates to the issue. So I'm I don't
2:12:18want to get too far off topic because
2:12:20this is talking about another contract,
2:12:21but Lincoln Lumber.
2:12:24So the Lincoln Lumber, they decided to
2:12:27close their business down. Now they have
2:12:31to repay us all tax abatements that
2:12:33they've that they've been provided,
2:12:36right? because they did not fulfill
2:12:38their full 5-year um
2:12:42agreement. So, they have to pay us.
2:12:44We're recapturing all incentives and
2:12:45abatements that we provided them.
2:12:47Incentives. Incentives because they did
2:12:49not perform for the full 5 years like
2:12:51the contract said. That's the clawback.
2:12:54Okay. However, even with that building
2:12:57empty, now they're going fully on the
2:12:59tax roles.
2:13:00And so it's it's their it's even though
2:13:03they decided to shutter their current
2:13:05business, it's in their best interest to
2:13:07find another company to move in and take
2:13:10that load off of them because they're
2:13:12paying taxes and they're pay they're
2:13:13keeping a few people out there just to
2:13:15keep the place mode and presentable to
2:13:17show to other
2:13:20potential businesses. So what exactly we
2:13:24have with that? Yeah. But with that well
2:13:27with with that being said though I mean
2:13:28I I mean kind of did a little research.
2:13:30I was just looking and uh I was looking
2:13:33at a TML uh the 2017 um the uh
2:13:39uh 380 agreement basically. 380
2:13:41agreement. Yeah. I'm looking at that and
2:13:43it was basically um giving us um
2:13:49approval or or let's see for protection
2:13:53uh approval for protection. Let me see.
2:13:55Let me read this to you here. Um, it
2:13:58says the agreement should be provide
2:14:00remedies for the city if if the program
2:14:03fails to serve the for public purpose.
2:14:06Right. So, what I'm what it's saying is
2:14:08giving us an opportunity to recoup or
2:14:10recover that that property. Now, from my
2:14:13understanding as we talk, we didn't even
2:14:15get that property appraised and
2:14:19uh sold it for a little nothing. So that
2:14:22property could be possibly we possibly
2:14:25have uh approximately 2 million probably
2:14:29invested who in that in that property
2:14:32giving them that property. Yes. Matters.
2:14:34No matter being that we didn't have that
2:14:37property appraised, we don't even know
2:14:38what we have in it, right? Yeah. At 10
2:14:42acres. So,
2:14:44yeah, but it was it's 19 acres out there
2:14:46either way either way on the loop that's
2:14:48currently I think appraised at
2:14:50approximately $2 million, right? So, so
2:14:53right now and that's the values the
2:14:55values that we assessed at it was it was
2:14:58an empty piece of property and we had a
2:15:00business owner that was wanting to make
2:15:01investments in it. So, and and hire jobs
2:15:05all of which they've they've they've
2:15:08kept their end of the bargain. When
2:15:10you're talking about you said remedies,
2:15:13it says this this tax abatement has all
2:15:16the remedies still in there. All the
2:15:18recapture clauses that you're talking
2:15:19about are still in there on on page
2:15:22number 43 of the tax abatement. It still
2:15:25has all the recapture clauses left in
2:15:27there. All we're saying is we don't want
2:15:29to take that property back if they
2:15:31decide to expand it even greater and do
2:15:33something in steel production or
2:15:36plastics or something else. We're not
2:15:39going to play a legal game and and take
2:15:42that property back when they're when
2:15:44they owe money to the bank and they've
2:15:45already made investments of over 7
2:15:47million because at the end of the day,
2:15:48so the recaptures are still there. Isn't
2:15:50that is that the issue we started with
2:15:53here is is that we're limiting them to
2:15:56what they can manufacture. Well, is
2:15:58there and we we've gotten off track
2:15:59here.
2:16:00So with that being said, when if we're
2:16:03limiting them with what they can
2:16:05manufacture, why can't we go in with a
2:16:08recapture clause and amend that
2:16:10recapture? No, no, the recapture is
2:16:12here. But a it's amend the recapture
2:16:16cost. Mayor, I I I move we that's a
2:16:18different we move on the previous
2:16:20question. I'm still in the discussion. I
2:16:23move we move on the previous question. I
2:16:25think we discuss but you can call it.
2:16:27Okay. You can go. No, I'm Yeah, but we
2:16:30in discussion though. Discussion is
2:16:32first. So, I mean I do have some I do
2:16:34have some questions. No, he said he can
2:16:37move to it if he Okay. Well, I'm I'm
2:16:38talking uh Mr. Mo. I'm I I'm doing the
2:16:43thing of it is Excuse me. Did they're
2:16:45calling for end of the discussion at
2:16:47this point. So, with that being said, I
2:16:48understand M Did you understand? I
2:16:50understand that. Okay. But right now,
2:16:52but you have the discussion. He can call
2:16:55to end the discussion to move to the
2:16:58question. Anybody can call to move to if
2:17:00you can get a a you can call and if he
2:17:03can get a second. The discussion is in
2:17:05and it can go to the vote. I second.
2:17:07Okay. It's been moved and second. It's
2:17:09time to go to the vote.
2:17:14All in favor? If we're in favor of
2:17:16moving to the vote. Okay. And they're in
2:17:20favor to move it to the vote. Okay. Now
2:17:22we're up to the vote.
2:17:25Okay.
2:17:29[Music]
2:17:31Do do we move on this or or on 14? This
2:17:34is the uh agenda item number um 13. Is
2:17:38it 13? Is it 13? Initially it's 13. This
2:17:41is the resolution that sets the premise
2:17:44on what the intent is. We're going to
2:17:47consider that item condition number one
2:17:49is satisfied that they started
2:17:51construction. Item number two that they
2:17:53invested over 38.6 million within 36
2:17:57months. We realize that that's um
2:18:00satisfied. Okay. Well, I'll make a
2:18:01motion we approve the resolution. I'll
2:18:03make a motion we approve the resolution.
2:18:06I second. Okay. Has been moved and
2:18:08second. All in favor?
2:18:10Motion carries. That opposes
2:18:21us to item number 14. 14. Uh consider
2:18:26and approve amending deed conditions and
2:18:28tax abatement and incentive agreement of
2:18:31ANA Texas Capital LP. This is just a
2:18:34little bit more uh detailed on that same
2:18:36item. council approved to do such, but
2:18:40I'm presenting you the red line on the
2:18:42deed itself and the red line on the tax
2:18:45abatement itself. Let me pull it up real
2:18:47quick. So, if you go to your I wish I
2:18:51was working on the laptop and it
2:18:53wouldn't have turned off. So if you go
2:18:56to page number 38, this tax abatement
2:18:59agreement
2:19:01on p on the second page of that
2:19:02agreement on page 39, well I have one
2:19:05red line that's going to be stricken
2:19:10which says and three. So item number one
2:19:14and number two stay in there, right?
2:19:16They stay in there. Item number three
2:19:17says use the real property exclusively
2:19:20for a facility to manufacture materials
2:19:22which enhance the durability of wood
2:19:24products for a period of at least 10
2:19:26consecutive years. We're striking that
2:19:28to not restrict them only to wood
2:19:30product preservation materials. Okay. On
2:19:34page, if you go to page
2:19:37um seven of nine, which is in your
2:19:40packet pa, which is page 44,
2:19:43page seven of the actual tax abatement
2:19:45agreement, this recapture for default
2:19:48clause
2:19:50of the tax abatement stricken, which
2:19:53says if such default is the result,
2:19:57our recapture our our requirement for
2:19:58recapture. If such default is the result
2:20:01of failure of the owner to use the real
2:20:03property exclusively for a functioning
2:20:05facility to manufacture
2:20:07materials that enhance the durability of
2:20:08the wood products that clause be
2:20:11restrict be be stricken which is the
2:20:13recapture clause. The other clauses that
2:20:15you had mentioned all remain all the
2:20:17performance agreements saying that they
2:20:19have to hire um x number of people they
2:20:22have to keep this many people on on
2:20:24payroll. They have to um invest a
2:20:27certain number. So all of those they
2:20:29have to keep in there and we're keeping
2:20:30it. We're not touching those. Okay. So
2:20:32basically so basically what I'm asking
2:20:33is so if if if
2:20:36you know which I understand we have to
2:20:38have a courting phase but if they uh
2:20:41decide to just pick up and leave and
2:20:44that means that all those people that
2:20:46they did hire will no longer have jobs.
2:20:48We don't have anything to hold that
2:20:50company actually accountable to stay
2:20:52here to the only thing that we can hold
2:20:54them accountable for is anything that
2:20:57we've invested into their business. All
2:20:59incentives that we provided them which
2:21:01be tax abatements. So within 10 years if
2:21:04by year 8 they say you know what we're
2:21:07moving back to Canada and we're shutting
2:21:08this down and we're going to sell it off
2:21:09to somebody else. Everything that
2:21:11they've been abated all the tax
2:21:12abatements that's been provided to them
2:21:14they have to pay those back. all
2:21:15incentives that we provided to them in
2:21:17um utilities, they have to pay those
2:21:20back. Um go ahead. I just had a question
2:21:23for Mr. Perry. Yes. Yes. Um would would
2:21:28you mind taking a stand, please? Just a
2:21:31quick question.
2:21:33So um and
2:21:36so in regards to
2:21:39um what I'm reading here under recap
2:21:41recapture for uh default it says um to
2:21:45be strucken if such default is the
2:21:48result of failure of developer owner to
2:21:52use real property exclusively for uh
2:21:55functioning facility to manufacture
2:21:57materials that enhance the durability of
2:22:00wood products etc. and and it reads
2:22:02further on um can you kind of give us an
2:22:05example of some products that you
2:22:08are processing or making?
2:22:12Okay. Well, the one of the primary
2:22:15products Yes, sir.
2:22:17Yes. a wrap that goes around.
2:22:22Yes, sir.
2:22:25Yes, sir.
2:22:28Right now we have a supplier
2:22:31that is providing us that mesh. Yes. And
2:22:34we would like to be able to bring in
2:22:36water and do that mesh ourselves. So
2:22:39that's that's steel. Yes sir. Steel. So
2:22:43with this clause that would denote you
2:22:47doing more than wood products would it
2:22:49not? Yes sir. I I understand. Thank you
2:22:53sir. And also with us amending that
2:22:58clause and adding extra products or
2:23:00extra whatever you're requesting to
2:23:03manufacture in that would also allow you
2:23:07to make other products. Am I correct?
2:23:09More capital. If if we if we could know
2:23:12how to forecast and and guess in 10
2:23:15years what what things they may want to
2:23:17manufacture. Yeah. We would be putting a
2:23:19catalog of information in there or just
2:23:22strike that re that restriction. Yeah.
2:23:25On them, you know, because
2:23:28Yeah, it could be done. It could be done
2:23:30either, you know, either way. For sure.
2:23:32Yeah. My main my main concern is is the
2:23:34um 380 agreement. uh where is where the
2:23:38TML recommends us to put place a rec
2:23:41capture clause in the agreement so if
2:23:44they decide to pick up those people are
2:23:46out of jobs that they no longer have any
2:23:49jobs and then the property they could
2:23:51end up selling it to someone we really
2:23:53don't care for them to be here in the
2:23:56city of they're under um that property
2:23:58is under deed restrictions so not just
2:24:01any property can come in there there's a
2:24:03lot of manufacturing properties that are
2:24:05not allowed in there under the deed
2:24:07restrictions. Um, secondly, like you
2:24:10said, the recapture clauses, all of
2:24:12those stay in there. It's just the
2:24:13recapture for them choosing to do
2:24:16something in addition to wood product,
2:24:18uh, you know, preservation. Um, so this
2:24:21one is more specific in that this this
2:24:24motion, what I'm requesting is, and I I
2:24:27wrote it down just talking to our
2:24:29attorneys, the things that the attorneys
2:24:30need in order to amend the deed and
2:24:32amend the tax abatement agreement is
2:24:36is to approve to amend the deed
2:24:39conditions
2:24:40the deed conditions as redlinined in our
2:24:43agenda packet and direct city staff to
2:24:45prepare a material correction deed to be
2:24:47recorded. So otherwise we're going to
2:24:50have to go through the process of a new
2:24:52closing. We're going to have to reclose
2:24:54on that property if if unless we do a
2:24:57material correction be where it's just
2:24:59striking
2:25:01wording within the deed and we keep that
2:25:03same deed on file. So, I wanted to
2:25:05clarify that as well. We're not wanting
2:25:08to just amend the deed. We're wanting to
2:25:10file a material correction to that deed
2:25:13that says we do not intend to recapture
2:25:16the property if they choose to do
2:25:17something outside of what we read the
2:25:20current wood products wood wood product
2:25:22preservation. Yeah. My whole thing is
2:25:24just holding the company accountable for
2:25:28uh providing the services in u for the
2:25:31community that they stated that they
2:25:33would would provide.
2:25:34All of those stay in the All of those
2:25:36stay in the abatement agreement. Well, I
2:25:38would like to make a motion to uh number
2:25:4114, consider and approve uh amending the
2:25:44deed conditions and tax abatements and
2:25:46incentive agreements of ANA Texas
2:25:49Capital LP. I second. Okay, it's been
2:25:51moved and second. So, it's been a um
2:25:53moved and seconded. Can we amend that
2:25:56motion to Can you look at this and read
2:25:59it and and verify that you like the
2:26:01wording
2:26:03to make sure that I properly record it?
2:26:09Is that is that proper? Yes, that was
2:26:14under my attorney's adisement that we be
2:26:16sure to properly word it. It's only if
2:26:18he approves it.
2:26:22Understood. recommend a motion that we
2:26:26um move to u I move that we approve to
2:26:31amend the de um conditions as read as
2:26:34red line in our agenda packet and direct
2:26:37city staff to prepare a material
2:26:40correction deed to the to be recorded
2:26:43and I further direct city staff to
2:26:46prepare a first amendment to the a first
2:26:48amendment to the ANA Texas capital tax
2:26:51abatement and incentives agree ment as
2:26:54redlinined in our agenda packet to be
2:26:57executed by the mayor.
2:27:02So this this amends the lawyer it amends
2:27:06both our tax abatement and it amends our
2:27:08deed under a materials correction deed
2:27:10to strike clause number three. Okay.
2:27:14It's on the motions on the floor.
2:27:18Then I second it. A second. Oh it's been
2:27:20second. It's been moved and second. All
2:27:22in favor? All oppose.
2:27:26Okay. Motion carries. That brings us to
2:27:28item number 15. Consider and approve a
2:27:31resolution of the city of Crockett
2:27:33Council concerning groundwater
2:27:35withdrawal application by Redtown Ranch
2:27:38Holdings LLC and Pine Bliss LLC.
2:27:46Mayor and Council. Um,
2:27:50this is a resolution
2:27:52recapturing the events of this past week
2:27:55and what we've learned to be our highest
2:27:57concern um and probably one of the
2:28:00greatest concerns that we should be
2:28:02focused on over the next um and
2:28:05potentially even a few years um that
2:28:09this process is going to um impact our
2:28:12actions. Uh we need to
2:28:15um we have we just in short we've had
2:28:18groundwater well applications to drill
2:28:21wells in Anderson County and Henderson
2:28:23County.
2:28:25Um the wells that are planned for
2:28:30Houston County have not even are not
2:28:32even required to be uh permitted and
2:28:35application is not even required. Um
2:28:38that being said, this is put together.
2:28:40Um there's an investment firm that has
2:28:43purchased a big ranch and is wanting to
2:28:46drill a lot of wells that are very close
2:28:49to us that we have high suspicion that
2:28:54will impact our aquifers that we
2:28:56currently have municipal wells pulling
2:28:59water from. We currently also purchase
2:29:02water from uh surface water from Houston
2:29:05County Lake who is fed by artisian and
2:29:09springfed elements.
2:29:11We feel like that massive amount of well
2:29:17pumping from our aquifers will reduce
2:29:21aquafer pressures
2:29:24to impact our lake, our springfed lake.
2:29:26Once those pressures drop, then artisian
2:29:29and springfed capacities of the lake we
2:29:32feel will be directly impacted.
2:29:35We also feel like our municipal wells
2:29:37are going to be impacted. There was a
2:29:40project recently, it was called the
2:29:42Vista Ridge Saws project that
2:29:44transported water to San Antonio.
2:29:47After their exportation and their
2:29:49pumping, there was hundreds of wells
2:29:52that were impacted and went dry. There
2:29:55was many wells that required to be redug
2:29:58and and and redrilled
2:30:01um to reach the aquifer because the
2:30:04water table drops. The water tables
2:30:06shift up upon that massive amount of
2:30:08pumping. That being said,
2:30:12I'm requesting council to by this
2:30:14resolution allow myself to represent the
2:30:18city and legal counsel that we can bring
2:30:22on board to go and contest at the public
2:30:25hearing for these applications
2:30:29and make sure that the city to do our
2:30:31best to make sure that the city is
2:30:34recorded as an affected party that we
2:30:37have standing to go to a contested case
2:30:39hearing and fight this with
2:30:42representation coming from hydraologists
2:30:45and other uh geotechnical groups as well
2:30:48as an attorney that um can fight this
2:30:51and give us our best chance of survival.
2:30:58Everything that I'm hearing is there's
2:31:01not a good chance for us just to shut
2:31:02this down. These are really deep
2:31:04pockets, big investors, and they will
2:31:07steamroll us in a heartbeat. We're
2:31:10really reaching out to other counties
2:31:11and cities and water districts and water
2:31:14and supply corporations, and we're
2:31:16wanting to form coalitions after the
2:31:18fact, whoever gains admittance as an
2:31:20affected party. We would like to work
2:31:22together with these other organizations.
2:31:25And that's what this resolution also
2:31:26lets allows me to do is to reach out to
2:31:29these other organizations and work
2:31:31together to give us our best shot that
2:31:34we um that our concerns are mitigated
2:31:39whether it's by volume that they have to
2:31:41reduce the amount of water that they can
2:31:43pump out, they have to reduce the number
2:31:45of wells, whatever it is that gives us
2:31:49some insurance
2:31:52and can and help us know that our
2:31:54current water supply and or future water
2:31:57supply is not going to be negatively
2:31:59impacted by this potential export group.
2:32:04[name], you might should explain to to our
2:32:07audience and those who are watching why
2:32:09the 11 wells in Houston County don't
2:32:12have to be permitted. So, there's
2:32:14something called under under the um and
2:32:17and I have about two weeks worth of
2:32:19education on this, so please forgive me.
2:32:21I'm I'm going to be pretty limited. Um,
2:32:24we have I have utility superintendents.
2:32:26They have all the TCQ licensing and and
2:32:29understand local operations, but we know
2:32:32that where this water where our water
2:32:34comes from, it comes from the lake. And
2:32:36this water comes from our water comes
2:32:38from municipal wells. For the last
2:32:40couple of days, we've been on our
2:32:42municipal wells. We have not been buying
2:32:44water from the lake due to their plant
2:32:46being shut down from and receiving
2:32:48lightning damage. So, we need wells. We
2:32:52also need the lake, right? We want both.
2:32:54We want assurance that we are going to
2:32:55have water now and in the future.
2:32:58The local Houston County is not under
2:33:01something called a groundwater
2:33:02conservation district. A groundwater
2:33:05conservation district is not a fixall.
2:33:08People can still drill. As you see,
2:33:09people are drilling and or or or
2:33:12planning to drill in Anderson County and
2:33:14there's a likely very good likelihood
2:33:16they will proceed with those wells.
2:33:19However, in Houston County, there's not
2:33:20even a notification process required. If
2:33:23they want 11 or if they want 20 or they
2:33:25want 50, there's not a process that they
2:33:29have to go through to show that this
2:33:30prop this water is going to be used,
2:33:33what it's for, are they going to waste
2:33:35it locally? Are they wanting it for data
2:33:36centers? Are they want to export it? Are
2:33:38they wanting to
2:33:40water cows with it? And so there's none
2:33:43of this process is required when there's
2:33:45not a groundwater conservation district.
2:33:47Currently
2:33:49I can't tell you from a personal
2:33:51standpoint and you know from a legal
2:33:53stand we can't tell you that do we want
2:33:56a groundwater conservation district or
2:33:57not. However, we know that that was one
2:34:02layer of protection that we should
2:34:03probably consider, right? And and and
2:34:06find out if that's something that we
2:34:07want or not because they can start
2:34:10drilling the those wells in Houston
2:34:11County right now. And they may already
2:34:12have. I don't know. We're hoping that
2:34:15it's based on some metrics that they put
2:34:18together, costbenefit analysis that they
2:34:19need all of those wells to be, you know,
2:34:22to to be successful enough and make
2:34:24enough profit to be worth their while.
2:34:26and that if it's if and if it's delayed
2:34:28in Anderson County that they just don't
2:34:30start the ones in Houston County. That's
2:34:31our best hope, but we can't stop it.
2:34:34There's not a process to stop it. But
2:34:36right now, they're built they're
2:34:37drilling their their plans are to drill
2:34:3954 wells. Um I'm sorry, 55 wells. 55
2:34:44highcapacity wells. the wells in Redtown
2:34:48Ranch that are really close to us.
2:34:52That's
2:34:53using their permit numbers that they've
2:34:55asked for is about 52 times the water
2:34:59consumption of the city of Crockett.
2:35:00It's about three and a half times the
2:35:01city of Tyler that they use on a on a
2:35:04daily basis. So, it's a lot of water
2:35:07coming out of our little bitty portion
2:35:08of our county. It's dangerous. Um, and
2:35:12so the goal is to go through this
2:35:14process,
2:35:16make sure we have a seating, a seat at
2:35:18the table to fight this to our best
2:35:19ability, to slow it down, to make sure
2:35:21that they provide all required processes
2:35:26to ensure to us that they're not going
2:35:27to be impacting our water supply. But
2:35:30also with the mitigation clause and and
2:35:33to try to provide some mitigation
