Agenda · Packet · Minutes · YouTube · 1:01:45 long
0:01I should have gotten a little warning or
0:02nothing else.
0:08>> Ready?
0:09>> Yes, ma'am.
0:13>> Good evening, everyone. It is now

1:12all the praise in Christ Jesus name we
1:14pray. Amen.
1:15>> Amen.
1:18I pledge algiance to the flag of the
1:21United States of America and to the
1:24republic for which it stands. One nation
1:27under God, indivisible, with liberty and
1:31justice for all.
1:36>> With that being said, we would like to
1:39recognize all our visitors and we thank
1:41you so much for taking out of your busy
1:43schedule for being here. And also I
1:46would like to introduce one of our
1:48special visitors today uh one of our
1:50foreign exchange student and I I'm going
1:52to let her introduce herself. She's with
1:55the leadership program from uh Crockett
1:57High School.
2:03You might have to adjust. Can you hear
2:05adjusted for
2:13my name?
2:18and I'm student from a small country
2:21called
2:23Asia and
2:26my program is future of America and I'm
2:29here to share
2:38>> welcome welcome
2:44>> but she'll spending some times with me
2:46as a shadow and we're going to walk
2:48around. We'll be visit visiting other
2:50departments and if you would like to
2:53speak to her, answer any questions.
2:54She's she'll be writing up a summary of
2:57all the experiences that she's had. And
2:59so every department head or department
3:01person, don't forget to speak to her and
3:04let her know who you are. And thank you
3:06so much. Uh with that being said, do we
3:09have we don't have any comments from the
3:11audience? And that moves us to the
3:15approval of the minutes
3:19of regular session September the 15,
3:212025. Approve of minutes.
3:25Everyone has a copy.
3:35>> I'll make a motion to approve.
3:38I second.
3:39>> It's been moved and second. All in
3:40favor?
3:42Motion carries. Brings us to the order
3:45of business number two. Considering
3:48approving ordinance amending chapter 19,
3:51utilities of the Crockett Code, amending
3:53section 19 through 37, increasing the
3:56rates for residential and commercial
3:58water service. Amending section 19-58
4:03increasing the rates for residential and
4:05commercial sewer service containing a
4:08servability clause contain a rep
4:11repealing clause and providing an
4:14effective date. Mayor and council,
4:18when we went through budget workshops,
4:20we uh
4:24discussed the fact of whether we were
4:26going to pay our debt based on the ad
4:30valorum tax or whether we're going to do
4:31it on a usage basis with water and sewer
4:34rates.
4:36and council directed to put part of that
4:40into the of paying the debt by using the
4:43water and sewer rate increases. And I
4:45want to go through and discuss how that
4:48kind of breaks down for you. There's no
4:51base rate increase on water or sewer,
4:54but there is
4:57a consumption rate increase. So that
4:59basically means
5:01that the people that will be paying for
5:04the the increase are the ones that use
5:07the water and the sewer. It's not across
5:10the board.
5:11And for an example,
5:15an average user, that's what you see
5:17down here at the bottom is the 376, but
5:21that is based on the average of our
5:23total water usage for the year from all
5:26of our customers. Whereas an individual
5:30household that uses a very minimal
5:32amount of water, say less than a,000
5:34gallons, they won't see a dollar
5:37increase on their bill at all. It's
5:39based on that. It's not based on the
5:43fact of it's across the board. It's an
5:46average for that. And what that does is
5:49you can see on the water side the
5:50revenue increase that it brings. You can
5:53see on the sewer side what that brings.
5:58and that's to pay the debt for our
6:00infrastructure. And if everybody's been
6:02around town the last couple of days,
6:04you've seen plenty of water manes that
6:05have been broken. That infrastructure
6:07has been here for a long time. And not
6:12only is it pay for that, but it is
6:14leveraged funds with that as well. We're
6:17not paying the total amount because some
6:19of that is grant money that we're paying
6:22the match for. So you're not paying the
6:24total debt of the 14 million. You're
6:27just paying the portion of that that
6:29we're required to pay back. And so
6:32that's part of it as well.
6:35And the downside to this is is we've
6:38already approved and ratified the budget
6:42for next year. And to balance that
6:44budget, it was based upon the fact that
6:47we were going to increase the rates in
6:50our water and sewer to do that.
6:53If we choose not to raise the water and
6:56sewer rates, then we've got to find
7:00a deficit total of about $328,000
7:04out of the adopted budget for next year
7:08in water and sewer. If you will remember
7:12back to that budget,
7:14there's not a lot of fluff in that
7:16budget whatsoever.
7:18And in my professional opinion, if we
7:21have to cut $328,000
7:23out of that budget, we basically won't
7:25have a water and sewer department is
7:27what it amounts to. And that's kind of
7:29where we are at this point.
7:32And so again,
7:35and I understand that some people are
7:38worried about the base rate that did not
7:40increase at all. It's all based on the
7:42consumption. And that's the sin increase
7:45for consumption per gallon of sewer is
7:470.0. 088 cents per 100 and the water is
7:510.081
7:54per 100 gallons of water. And so that's
7:58where we are. That's why it's proposed
8:01because during the workshop council
8:05directed to pay that debt out of
8:09consumption instead of out of the taxes
8:12against property. So that's my
8:15presentation and I would remind council
8:18as we move into the discussion phase
8:23that you need a motion and a second on
8:25the floor before discussion takes place.
8:36>> What is the plan?
8:43Okay. Then I'll make a motion then
8:45that's the only way we discuss it is
8:47consider
8:49approve an ordinance amending chapter 19
8:52utilities of the Crockett Code. Amending
8:55section 19-37A
8:57increasing the rates for residential and
8:59commercial prop water service. Amending
9:02section 19-58 increasing the rates for
9:05residential and commercial sewer service
9:08containing a severability clause
9:10containing a repealing clause and
9:13providing
9:15an effective date.
9:18>> I second that motion.
9:20>> Okay, it's been moved and second.
9:23All in favor
9:25>> to discuss.
9:26>> You can have discussion then.
9:27>> Yeah.
9:28>> Well, that's the only way we could,
9:29>> right? You the motion had to be made
9:31now. Now you can have discussion.
9:32>> No, you can. Okay. We didn't have to
9:33vote on it. Okay. So, it's an open
9:35discussion. So, um it's open for
9:38discussion.
9:41>> Does someone have did you have something
9:43you want to say?
9:44>> Oh, yeah. Uh well, yeah. I want to ask
9:47um I understand that we um you talk
9:50about
9:50>> Yes, ma'am. I I apologize for leaving
9:52that part out. I've got it here before
9:55you. If y'all will see this separate
9:58sheet here, Miss [name] was questioning
10:02the fact that in the ordinance, it says
10:05for those outside the city limits, the
10:07water rates just double. And because the
10:10agenda was posted and the ordinance was
10:13posted prior to that discussion, she
10:16wanted it to be in the minutes and and
10:21that we can bring that this section back
10:23for an amendment. And it basically just
10:25spells out the fact what it says is
10:28rates for water service furnished
10:30outside city limits shall be twice the
10:32inside city rates. Accordingly, the
10:34charges are one residential water $49.34
10:40base rate plus $126 per 100 gallon used.
10:44Commercial water $6942
10:47base rate plus $126 per 100 gallons
10:50used.
10:56I want to be on the record to say that
10:58uh I think we got some of the highest
11:01water rates around for the type of water
11:04that we receive
11:07and that we buy.
11:09And uh
11:14so I think we need to go to the water
11:16district to revisit
11:18our
11:20we don't have a contract. I was fix
11:22contract. We don't have one,
11:26right?
11:28>> Is that right? We don't have a contract
11:30with them, right?
11:31>> That's what the lead.
11:31>> And how many gallons of water do we buy
11:34that we don't use?
11:37>> How much?
11:38>> It dep it it depends per month.
11:40>> A million.
11:41>> Yeah.
11:42>> But aren't we at least about that?
11:44>> At least a million gallons, right? So I
11:47think we need to go there before we
11:50raise the rates on
11:52our customers,
11:55our our people that we do. I I think we
11:58need to visit that. We need to visit
12:00that first.
12:01So
12:04>> Okay. In terms of where we are right
12:06now,
12:07>> you also say we're not going to have a
12:08water department, right?
12:09>> Okay. The one thing about it is that
12:12because of the way the budget was at, I
12:13I don't think it exclude going to them,
12:16but it's going to become a legal issue
12:18and it has been a legal issue for a
12:19while.
12:20>> Have you looked at Facebook and see how
12:21many people that's been that our water
12:25stinks our water when we get it from the
12:27water district and they're sending us
12:29bad water and we're paying for it.
12:31>> Okay. What we would have to do even at
12:33the staff because that contract it this
12:36isn't the first time. I think you've
12:37been around long. I've been wanting to
12:39do something about it for a long time.
12:41>> Each time you have presented, but you
12:43know that it just can't say we won't do
12:45it because we need the water. I mean,
12:47that's that's a given. We got to have
12:49some water. But if we to do it, it might
12:52be a better proposed at this time to
12:54prop propose how we're going to address
12:56it legally because you just can't say no
13:00water.
13:01>> I mean, that's I mean, if you like,
13:03let's just pay for the water we use.
13:05>> Okay. But that that has to be done
13:08through a legal step. Correct.
13:11>> Do we have a contract?
13:12>> Well, that's
13:13>> it has to you still going to have to
13:15have a legal person to make it go into
13:17effect. You can't just go there and tell
13:19them we're not going to do this water
13:21and and they cut it off. Then where are
13:23we going to be? We do have to have
13:25water. I mean, it's not no ifs, and but
13:27there has to be a procedure or process
13:30for going through it. So what we're
13:33proposing
13:33>> if I could say something I mean I you
13:35know I just don't I mean what they're
13:38doing to us I don't know the inception
13:41of that you know you know say there's no
13:45contract there's no contract
13:48I don't know what our obligation would
13:49be then to just to keep you know paying
13:52for that and and and if it's going to
13:55take legal if it's going to take legal
13:57action to stop it u
14:01I mean you Why? Why? Why couldn't we? I
14:04mean, I I just don't see how you how
14:06some anyone would agree. I mean, it'd be
14:08like anything we go to do go to buy
14:11something, they say, "Well, we're going
14:12to charge you more than what the price
14:14is." I I wouldn't buy anything that way.
14:17>> Okay?
14:17>> And I said, and I I've said it
14:21before, quite a while ago. I mean, you
14:24know, I understand that, you know, that
14:25they're in a bind and but I don't think
14:27it's our fault. But even if I mean,
14:30yeah, I understand what you're saying
14:31about
14:32>> and uh if and if and if and water is
14:34going to be the issue for our county
14:38probably from now on, there's going to
14:40be people coming after our water and
14:43we're going to have to just u uh you
14:45know do something to protect our water.
14:48And if we let them I mean if something
14:50happens they shut down and we don't do
14:52anything. It's my understanding the
14:54state could come in and take the lake
14:56over and they could do whatever they
14:58wanted to with the water.
15:00>> Okay.
15:00>> I just wish there was a way that we then
15:03if if if they're struggling that we
15:05could take it over and refurbish what
15:07needs to be refurbished so that we could
15:09have the water. But then that was the I
15:11mean that was the art I mean I'm sorry
15:13that was the statement that was made
15:15that we were going to get we were trying
15:16to get an assessment for what it cost to
15:20take over it and that was what was being
15:22put together
15:23>> and part of that is in the debt that
15:26we're paying off is the the assessment
15:30of
15:38[Music]
15:41Okay,
15:44we know how that is. I'm not going to
15:45argue with nobody. We can't control it.
15:48Okay. Why don't you tell us I mean I
15:51understand what [name] is saying and I
15:52understand it. But I think we are in the
15:54process of trying to make an assessment
15:58>> of of of where we are in our assets,
16:01where they are in their assets to see
16:04what options there are. and and I don't
16:09think we're arguing the fact of whether
16:12we should work towards a solution in
16:15that instance, but this is more budget
16:18related to the water and sewer rates as
16:23is now.
16:24>> Right now.
16:25>> Yes, ma'am.
16:25>> Okay. So,
16:27>> so my
16:27>> where we are I'm sorry. Go ahead.
16:28>> So, my my question so basically the
16:31water rates so we're still dealing with
16:33with the budget in general.
16:35>> Yes, ma'am. the whole budget, right? So,
16:37my my suggestion or my recommendation is
16:41I mean, have we actually looked at the
16:44council as a council? Have we actually
16:47looked at the budget actually reviewed
16:50the uh purchases items that we're
16:52purchasing things that we can go in and
16:55possibly And you're saying that we can't
16:57cut some things. Can we go in and look
16:59and see what's priority?
17:01>> I think I mean
17:03>> I mean the council have looked at like
17:06things like that. I mean overall
17:08balances we haven't gotten like
17:12>> you know like just say
17:15>> I think we in uh um I think added this
17:18past year and not to just say the and
17:21not to uh but just say for instance um
17:27uh I guess the the shelter I would say
17:29that we added that
17:32>> the what animal shelter
17:33>> animal shelter we added that and added
17:36to edit edit that. So, I'm just asking
17:39>> that was in last year's budget
17:40originally. It continued over to this
17:43one. Yes,
17:44>> ma'am. What I'm asking is just let us
17:46look at re revisit and look and see
17:49what's
17:51>> what's priorities.
17:52>> We and and I understand that, but we
17:54approved the budget that took effect
17:57October 1st.
17:58>> Okay. the budget is is there
18:00>> and so and this was part of the proposed
18:03budget that was approved by council to
18:07move forward. And during the workshops,
18:10council directed that the consumption of
18:14the increase of water and sewer rates
18:16was what was going to take to be that
18:20$328,000 worth of revenue for that
18:23budget to exist starting October 1st
18:26through September 30th. This is to pay
18:27the debt or the water.
18:29>> This is to pay the debt on the water.
18:31>> So, how how did we get there to have to
18:34do this to pay debt while the water
18:36department?
18:37>> It's supposed to be self-funded.
18:40>> I mean, our taxes supposed to be
18:42self-funded. How How do we
18:44>> get there to have to use water rates to
18:47pay debt? because it's the Texas Water
18:51Development Board funds that we received
18:54for
18:56the North plant.
18:59It is for
19:01money that we're getting that's going to
19:03basically replace the water lines on
19:06East
19:06>> to do for water, not
19:08>> and and the north plant, the whole sewer
19:10plant.
19:10>> So So that's what I was asking you. But
19:12you're saying debt. This is debt, right?
19:14Overall debt. overall debt.
19:17>> I was talking about water. I mean, water
19:19is supposed to stay in water.
19:21>> Uh sewer is supposed to stay in sewer
19:23>> and it it is and that's why you'll see.
19:27>> So, are we doing this to buy police
19:29cars? No, sir. We're doing this to get
19:32>> potholes and another budget.
19:35>> No, if you if you'll look in the water
19:38and not not I'm just asking general, not
19:42nothing to do with y'all buddy. and the
19:44water budget and the sewer budget.
19:46You'll look down through there and it'll
19:48show you the debt line items and that's
19:50it's for the it will pay and those add
19:54up to in the sewer side where it says
19:58total revenue needed. The debt payment
20:01for the year is $168,626
20:04just for sewer. And when raising the
20:07rates that raises it to 171,51869.
20:11But then you look at the water,
20:14>> it's because we've been getting
20:15increases from the water department or
20:19>> water. These are just the debts for the
20:21loan from the Texas Water Development
20:23Board and those other things that are
20:24going to redo the North Plant, which
20:26like I said, that's leverage money
20:27because we're not paying the full 14
20:30million back. It's just a percentage of
20:32those that we're paying back. And so
20:35like on the water side,
20:38the total revenue needed to pay the debt
20:42is 159503
20:44and we're going to raise 15787516.
20:48And you put the two and so we were able
20:51to absorb the 2,000 in the water side
20:54and we'll have a little excess just
20:57based on the rates on the sewer side. So
21:01that it is to pay the water and sewer
21:04debt only. It will stay within those
21:06budgets.
21:08>> So what it means is everybody's not
21:09paying.
21:10>> No. And they're not because it's based
21:12on the the ones consumption of water and
21:15>> balanced out. But
21:16>> we we do that already enough. So
21:19>> Okay. But one thing I mean where we are
21:22right now with what's been allocated
21:24what we agreed on in the budget first.
21:26The only step that we can take at this
21:28point is to go forward by and like I
21:32say, I think we're already in the
21:34process to get an assessment of what we
21:37can do and how much we're obligated.
21:40People have been saying for years that
21:43it's not a contract, but for some reason
21:46we haven't been able to get out of it
21:48because we needed the support of the
21:50water each time. Each time we've had a
21:54fail in our water just to supply, we've
21:56had to go back because you got to have
21:58water one way. But I think at this point
22:03where we are and everybody's frustrated,
22:06but the fairest part is if you're not
22:08using a lot of water, you're not paying
22:10more than you normally would. I mean
22:13they didn't raise if you're if you're
22:15using the same amount of water your
22:18increase is not going to be overly
22:19reflective of an additional but we are
22:23do have out of the city limits and it is
22:26going to be but then the the
22:29infrastructure to get it out there is
22:32not as simple as it is to get it in
22:34town. We've been struggling and I'd ask
22:37uh [name] to mention it a little bit
22:39but with that busted line just one line
22:43and then another line and then another
22:45line just if you've driven down the
22:47street. So we are in bad shape with uh
22:50sewer because it hasn't been fixed in
22:53over 60 70 years and every time one
22:57bust. But what I'm saying that this this
22:59this it might be a band-aid. Call it
23:03what you like. But if we can get through
23:05this and get a legal opinion on what's
23:07the next step cuz we're going to have to
23:10go forward with it. We've already looked
23:12at the budget. Everybody has made their
23:14recommendation. Do we like it? Not at
23:17this point, but we are going to have to
23:19do something about it. But we're at this
23:21point, we need to get the water and get
23:24the sew and get the bills paid on
23:26because the bills are going to have to
23:28be paid one way or the other. And then
23:30from that point, we can assign a special
23:34counsel to go in what what does it
23:37really take to get out of it?
23:40>> And we're going to have to do that. And
23:42you know because it's the the customers
23:44aren't happy the people aren't h happy
23:46about it.
23:47>> So that's said so that that's where I
23:51was asking question about the opera the
23:53American Rescue Plan Act when they
23:56imposed that act those monies were to uh
24:00given to cities such as ours to support
24:04uh infrastructure issues, water issues,
24:07uh pipe lane uh issues. And so my
24:10question with that is what do we do with
24:13it? I mean did we use it for the purpose
24:16of priority items or we just made a wish
24:21list and just went through it and not
24:24even addressed the uh issues that the
24:26people had in the county because during
24:29that time the people had issues with
24:31water then we had issues with streets
24:34then we had issues with is
24:35infrastructure then. So what I'm asking
24:38is what do we do? Why didn't we react
24:41then like we're doing now? I mean, when
24:44we received this money, we should have
24:46looked at all the priority items and
24:48took them head on and address those. But
24:52now we in a predicament that we we got
24:55to figure it out. So, I I talked with a
24:58lady today and I was comparing the water
25:02issues inside the city limits and
25:04outside. I just went a little bit a
25:07little bit further and this friend of
25:08mine just so happened I called her and
25:10she was telling me that she was having
25:12issues because she was already had a
25:14plumber out to her house and I said,
25:16"Well, sister," I said, "I'm glad you
25:18told me." I said, "Cuz that's what I'm
25:19calling about." Well, I called her. She
25:20said, "Terrina," she said, "It's water."
25:22She said, "It's my water bill $200." She
25:25said, "And I had a leak. Did not realize
25:28I had a leak and it's her water bill
25:31$400." I asked her if she had gave me
25:34permission to get her copy of water bill
25:37and I did and so she lives out in Meta
25:40View, but she has a $400 water bill and
25:43she was very upset about it and she was
25:46like, "Y'all please don't go up on the
25:48water cuz I mean she said the water I
25:52can't take a bath in it because it
25:54breaks me out. It has all those extra
25:56chemicals in it and I and and plus the
25:59past week or so I've been receiving
26:01emails with bathtubs with water and it's
26:05just brown just
26:07>> and I can address that. Um part of that
26:12is starting I think it was September the
26:1415th
26:16um the lake had to do what they call a
26:18free burn. It's required to basically
26:22change over from chloromines to chlorine
26:24and and treat the water to clean out
26:26everything. And when you do that, it
26:28does exactly what its purpose is. And
26:30it's going to clean out old pipes and
26:32whatever's in those pipes is going to
26:34come out.
26:35>> Well, I now will say this with the new
26:39flushing in the water and it coming in
26:40with the four, look at your pipes. I had
26:44four pipes removed and because I'm I'm
26:47in an old house too, they're full of
26:50rust. I don't know how they build up. I
26:52don't know. But I would bring it here
26:53just for example. You wouldn't believe
26:56that that brown is not coming so much
26:59from the water. It's coming out of those
27:01pipes, right?
27:02>> They're very very if you live in any of
27:05the older houses. I didn't know it could
27:08be that much. I'm in the process of
27:10changing mine to I mean personally to
27:12the rubber. Only thing I got to say
27:14about that, um,
27:16>> don't nobody want to pay for it, but how
27:19we gonna get it fixed if we don't pay
27:20for it?
27:21>> Yeah, I agree.
27:22>> I mean, it's always going to hurt and
27:24it's always we going to have to pay for
27:26it. It ain't going nowhere.
27:28>> So, the thing
27:30>> after we get through paying for it, can
27:32our bill go back down?
27:34>> And that's and that's what you're
27:35waiting for.
27:36>> The trouble is everybody don't pay for
27:38it.
27:38>> Yeah. And and it's fair. I mean, it's
27:40not a lot of things that everybody get.
27:42If you stop using a lot of water, your
27:44bill won't change much. If you use a lot
27:46of water, your bill is going to change a
27:49lot. And I know some people have extra
27:51things and and if I mean, and so that's
27:55in terms of fairness. It doesn't get any
27:57fairer than it. I agree with everybody
28:00pay for
28:01>> my water bill is over $400 every month.
28:03I'm I certainly don't want it mine to go
28:06up, but
28:08if if I'm asking this question right in
28:11a previous meeting so that everybody can
28:13understand, we agreed to do it this way.
28:16Is that right?
28:17>> Yes, sir. That was during the budget
28:18workshop. It was unanimous that we put
28:22this on consumption, this part of the
28:24debt on
28:25>> and we as council agreed.
28:27>> Yes, sir.
28:28>> To do with the water and the sewer.
28:30That's where that funding was going to
28:32be. And the money was going to be used
28:34for those specifically.
28:36>> So that agreement from the council
28:38brought us to this point.
28:40>> Yes, sir.
28:41>> All right. My next question is if if if
28:44if
28:46this didn't pass, what are the
28:48consequences?
28:49>> Well, we've got to go back to the water
28:51and sewer budget and cut $328,000.
28:55And like I
28:55>> And what would that mean?
28:57>> It's going to eventually end up in
28:59layoffs of of workers. And that's why I
29:01said in my professional opinion, it's
29:03going to be a challenge to have a water
29:05and sewer department because there's not
29:08a lot of extra money in those two
29:12budgets other than personnel
29:14>> and with the number.
29:16>> So we we um incurred what uh about a
29:20million and half of salaries
29:25between two people this year.
29:27>> A million and a half.
29:28>> One million. Uh where you and [name] sell.
29:32>> So we
29:32>> It's not close to a million.
29:34>> It's a million and a half. I want in on
29:35it.
29:36>> Yeah, me too.
29:37>> Is what? Well, what was it?
29:38>> No, I'm I'm going bring it back. But
29:40anyway, we But anyway, we need to look
29:43at personal name. So, I can I will tell
29:45you this.
29:45>> Let me introduce. Yes, ma'am.
29:47>> So, remember I was asking at I think
29:49earlier names.
29:51>> Uh I was okay. I was asking earlier at
29:54um
29:55>> uh one meeting and I was inquired about
29:58salaries.
29:59>> Sure.
29:59>> So have we not looked at you know
30:03salaries because have we not looked at
30:05positions that we may not necessarily
30:09need that was created
30:10>> because of the budget
30:11>> off subject now.
30:12>> Yes, we are. And we and besides
30:14>> So I make a motion we I make a motion we
30:16move on the previous question.
30:18>> Looking for money. Okay. I make a motion
30:20we move on the previous question.
30:22>> Yeah. And that's the one.
30:23>> Yeah. A motion was already on.
30:24>> Okay. But no, but you you
30:26>> the previous question.
30:27>> Make a motion we move on the previous
30:28question.
30:28>> That's acceptable to say
30:30>> it. It is with a with a second. Then
30:32that would terminate all discussion and
30:34proceed to the vote.
30:36>> Now
30:36>> with a second it would terminate
30:38discussion and proceed to an immediate
30:40vote.
30:41>> I second.
30:43>> Okay. So you vote on the previous
30:45question first
30:46>> and the previous question. What did you
30:47want to do about the water department?
30:50>> No, you just All in favor of the
30:52previous question.
30:54>> That's what you say.
30:56>> Oh, I thought Okay. All in favor for the
30:58previous question. That was the one we
31:00were working on.
31:01>> Yeah.
31:04>> Yay. Nay.
31:06>> She's asking who's in favor of the
31:07previous question.
31:08>> To go back to the previous question that
31:10you would
31:11>> That's 30.
31:12>> Okay.
31:13>> Now, now you vote on the motion that Mr.
31:16[name] presented approving the ordinance.
31:21>> Did you
31:22>> I made the motion. We had a second.
31:24>> Yeah, you had the motion in second. Now
31:25that's what's on the floor.
31:27>> The discussion's been terminated with
31:28the previous question.
31:30>> And now the motion on the floor is to
31:32vote for approving the ordinance for
31:34raising the water and sewer rates or
31:36not.
31:37>> I thought it was just water rates.
31:39>> No, ma'am. It's water and sewer rates.
31:41>> They were both on there.
31:42>> Okay. You went back and changed it.
31:44>> No. No, ma'am. Because we remember the
31:47first meeting we had.
31:48>> Oh, no. We're talking about today.
31:49>> The first meeting we had.
31:50>> How are we still discussing?
31:52>> Discussion is no longer on that. We've
31:54had a discussion. It's up to the vote
31:56now. Okay. So, that was the motion and
31:59it's been approved.
32:01>> Moved and second.
32:02>> Moved and second. And now you're ready
32:04for the room.
32:05>> Yes, ma'am.
32:06>> It's already been
32:08>> Yeah, but they only they
32:09>> they already been discussed and it that
32:11was what was on the table.
32:13>> Yeah. But they bring the room. Uh, we're
32:15ready for the vote.
32:16>> We're favoring the roll.
32:17>> Yeah, we're ready for the vote.
32:19>> Yeah.
32:20>> Okay. All in favor?
32:25>> Opposed?
32:28>> Are you opposed? Did you raise your
32:30hand?
32:31>> You What is it?
32:33>> It was all in this for all in favor
32:37>> raised already. It was the three with
32:40>> Okay. And oppose.
32:42>> [name]'s opposed.
32:43>> [name] opposed. And I was asking if it you
32:45don't vote
32:46>> this it's opposed. Okay. It's Yeah.
32:50>> It passes.
32:51>> Okay. So, they've moved on. Motion pack
32:53carries. Brings us to the next item.
32:58>> As soon as I find my front page.
33:01Okay.
33:04Item number three, public hearing on
33:05request from Tracy Ross Jr. for a
33:08specific use permit to place a
33:10manufacturer home on property currently
33:12having an address of 804 Cottonwood
33:15located between Berlesen Street and West
33:17Hall Avenue and identified by the
33:20Houston County Appraiser District as
33:22partial 4309 and 4310. legal description
33:26being lots number eight and and and nine
33:31in the JW Hog block of the Dport
33:35addition to the city of Crockett.
33:41>> Oh, we're council. Oh, I'm Oh, that's
33:44right. I'm sorry. This is the hearing
33:46part.
33:46>> Public hearing. If anybody's there would
33:48like a comment, you may come and make
33:50your comment.
33:54We'll leave it open for a few minutes. A
33:56minute. If nobody has a come in on that,
34:02you actually get to say something
34:05and we want him. Okay. If it's nothing,
34:09did you have something to say about it?
34:12>> On the previous motion is correct.
34:14>> No, no, no. This is only three. The
34:16request this the public hearing on the
34:19specific use permit item number three.
34:21That is all you can discuss. If you have
34:23a concern or comment, does anyone have
34:27it? If not, we'll close the hearing.
34:30Okay.
34:32Hearing is officially closed. Brings us
34:34to item number four. Consider an
34:36approved request from Tracy Ross Jr. for
34:39a specific use place per permit to place
34:41a manufactured home or property
34:43currently having an address of 804
34:45Cottonwood located between Burlesen
34:46Street and West Hall Avenue identified
34:49by the Houston County Appraisal District
34:51as part of 4309 and 4310. Legal
34:55description being lots number 8 and 9 in
34:59the JW Hog block of the depot edition.
35:02Mayor and Council, uh, we had a
35:05application for a specific use permit as
35:08required by our ordinance from Tracy
35:10Ross Jr. to place a manufactured home on
35:14the lots that are described. Went
35:16through planning and zoning. It will
35:19meet all setbacks and requirement. Uh,
35:22planning and zoning saw that
35:25there would be no adverse effect. It
35:28would not substantially depreciate the
35:30value of adjacent nearby properties and
35:33it will keep in spirit and intent of the
35:35city ordinance. It will not affect
35:37traffic circulation or public utilities
35:40or health and safety. There was a public
35:43hearing at the planning and zoning
35:45commission on September 30th. One person
35:48spoke in favor, none opposed. Planning
35:51and zoning recommended approval of the
35:53specific use permit for the placement of
35:55the manufactured home. It will be a 2025
35:58year model manufactured home.
36:02>> Okay. Um
36:02>> I make a motion we approve.
36:04>> I second.
36:05>> It's been moved and second. All in
36:06favor?
36:08>> We have to abstain because we're
36:12>> I have to abain because that's it's a
36:14conflict of interest because I own
36:16property within the 300 ft mark. As a
36:20matter of fact, the property they took
36:21to put the trailer home on my parents
36:24actually used to own it as well
36:26>> and I'm I had I would have had to
36:28abstain too because I have area property
36:31in the area. Okay. Conflict of interest.
36:34So with that being said, motion carries.
36:38All right. Item number five,
36:42consider and approve authorizing the
36:44city to proceed with lease agreement
36:46with deep East Texas Workforce Solution
36:49at 1505 South Fourth Street, Votech uh
36:53Center, Vocational Tech Center, and
36:56determining uh lease value. Council,
37:01>> mayor and council, um we have a lease
37:04agreement um that with the workforce uh
37:08solutions office that's within the uh
37:11votech center um before this lease
37:14agreement is drafted and numbers are
37:17placed into an agreement to you. Uh we
37:20did reach out to the workforce. They're
37:22aware of this. That's why we're
37:24currently under a month lease with them
37:26because they knew that they needed to
37:28renegotiate this after transfer of
37:30asset.
37:30>> How much is that month?
37:34>> Currently the monthto month is as the
37:36previous it's based on reimbursements of
37:38utilities only. So they will only
37:39reimburse the city for cost of
37:42utilities. Uh that was the existing
37:44previous agreement. We continued on from
37:47month to month in order to not default
37:50on it because that lease agreement
37:51expired that they were under. But we
37:54knew that the transfer of assets would
37:56take a few more months. We went to a
37:58month to month and as the um the city
38:02becomes um a uh lease score of the
38:06property under a master lease agreement
38:09then we will sub lease that property to
38:11proalis workforce solutions and so
38:14forth. But as those leases are drafted
38:16we wanted to bring it to y'all to get
38:18your um input on it. Um, as I put down,
38:21I have a a sheet there for y'all to kind
38:24of explain some of the specs of the
38:27property. It's 1,800 square ft of office
38:30space.
38:32Um, I have on the back side of that
38:34sheet, I also have some pictures of it.
38:36I'm sure y'all work for an office. If
38:38you have it, there's just a few
38:40pictures. I reached out without hiring a
38:45some type of a licensed or certified
38:47appraiser and paying funds for it. Uh
38:50this definitely falls in with council's
38:52perview to decide um what y'all think is
38:56fair. We did reach out to some realtors
38:58and we got across the board different
39:01numbers what they based on their lease
39:03agreements that they
39:06worked with other companies at least
39:08from the office space. We got 30 members
39:12in talking to workforce. They the DPS
39:15Texas workforce solutions.
39:18Um they currently have five other leases
39:21and they said this offer here is based
39:23on an average of what they currently
39:26lease for and they'll be they would be
39:27willing to offer this much. If if you
39:32you guys decide that the lease needs to
39:34be more than that, then they would
39:36request that we go through a procurement
39:38process or they actually go through a
39:40procurement process seeking other
39:42buildings, other leases, other options
39:45before they decide to pay more than what
39:47their average is. But that that offer
39:51the offer for 1,00522
39:54is what they're offering um based on
39:57five other sites and they would be
39:59willing to on top of that and not the
40:01whole process.
40:04>> So,
40:15so my my question was so being that we
40:17had the have the month-to-month lease
40:20agreement so um and the pan it has the
40:25property has not changed or anything
40:27like that. So
40:30are we trying to do a lease agreement
40:32now to start recovering the lease fee or
40:37what are we what are those going that
40:41were replaced two in this last year.
40:45>> So as costs of HVACs roof leaks windows
40:50um need to be there's maintenance cost
40:53and there's no revenue to cover those.
40:57>> Yeah. With that being said, over at the
41:00civic center, same thing. You have the
41:02chamber over there. You have the chamber
41:04there.
41:04>> And that's why you negotiated a lease
41:06agreement with them as well.
41:08>> Yes. And you and their lease agreement
41:09is $386 a month
41:11>> for one office. They're only leasing one
41:14office. This is an,800 foot office.
41:16>> Now, my next question with that being
41:18said, um what other uh conference rooms
41:21are they allowed to use or utilize for
41:24their event without a cost?
41:29the
41:30>> No, no, the chamber.
41:31>> Oh, no. That's not on the agenda today,
41:34>> right?
41:34>> But it's it's it's relating to to this
41:36agreement. It's related to
41:38>> No, there only one. What I'm asking is
41:40so so that means that we should have
41:44>> um
41:45>> pretty much kind of talked about it
41:46before you went and talked to cuz I'm
41:49asking um who initiated
41:52the conversation you know because
41:56>> that's why hadn't spoken you had spoken
41:58no one has spoken
41:59>> excuse me that has been
42:00>> that's why we're talking
42:02input
42:03>> well I will say this
42:05>> this has come up before when we first
42:07started looking at pllis This is not the
42:09first time we have discussed that it
42:11that they were uh in because they do
42:13rent another property in the city
42:17right down the workforce.
42:19>> Yeah, the workforce. The workforce is an
42:21established organization. They do have
42:24funding sources and there are they're
42:26they're not just this little small off
42:28they're part of a corporation too. And
42:31so in terms of has the city been very
42:34conscientious of it and supported
42:37they've been very supportive for years.
42:39This is not the first time. This is
42:41about the third time this conversation
42:43had came up and in the me before they
42:46before PVLis got in they were there and
42:49we were just assisting them. But I think
42:52that it's I think at this time it is
42:55appropriate for them and we're doing
42:57each one uh and they're an entity that
43:01should be responsible. We we appreciate
43:03what they're doing but they're self
43:06>> but for to just uh and they they've been
43:10aware of it. The head department has
43:12been aware because they came and
43:14visited.
43:14>> Yes, ma'am. But my understanding from
43:16the get-go when Proalis entered into
43:18that building is that they was very
43:21receptive. They wanted the workforce to
43:24be in that building because they they
43:27you know but if they get to the point to
43:28where they can't um afford it or we
43:31force them to get another building
43:33because of the lease agreement and the
43:35expense of it is not
43:38>> May I interject May I interject please?
43:40>> Yes.
43:41That is why the agenda item is worded
43:44the way it is to get council's input
43:46into the dollar amount.
43:48>> But this is the dollar amount that
43:50workforce came to us with. This is what
43:54their average rent for their facilities
43:56are and this is what they want to pay.
43:59Now I have to be careful with that
44:01because of the fact that last time that
44:04you all went to prov uh not provided but
44:06the workforce and you spoke with them
44:08and you came back to the council with
44:11what they agreed to is really not what
44:14they wanted to agree to. I don't know
44:16what the conversation was but a lot of
44:18the details we didn't get and a lot of
44:21the details we don't get when you all
44:24meet with these different um entities.
44:27We're when when you leave that I don't
44:30feel like we're getting all of the
44:31detailed information. So discussing this
44:34right now motion where we Okay.
44:39>> We we I'm allowed to ask him questions
44:41so we can discuss.
44:43>> Okay. To the point you've stated.
44:46>> Okay. What what they're proposing
44:49>> and what what we need to hear is the
44:51baseline. They have always been aware
44:54that it was going to have to be a
44:55charge. There's not a a question about
44:57it. We went to them and they knew that
45:00it was going to be a charge because they
45:02always pay for the building that they're
45:04in. Uh we're not forcing them to leave,
45:06but it is a point where you do negotiate
45:08the best price, not looking at what the
45:11market value is. That's what you do when
45:14you're protecting the city interest.
45:17They I mean they're they get paid. So
45:19there's somebody's paying them and so it
45:21is a and they're they're not thinking
45:23about leaving and we're not thinking
45:25about asking them to leave but we are
45:27asking them that they do need to be
45:29prepared to pay a decent rental.
45:32>> Part of that is part of that has got to
45:34be fair market value or a public benefit
45:38and that's what our city attorney can
45:40answer as well and that's what the same
45:42contract that we use for the chamber.
45:45There's a couple of other things in the
45:47city which I told you when we did the
45:49chamber one that there was more coming.
45:51And so this is one based on the fact of
45:55they came to us with a number. We
45:57brought it to council at the beginning
46:00of the process to get your direction to
46:04move forward with this lease agreement.
46:05And if you thought that the number that
46:07they were coming forward with was
46:10adequate for the council to be satisfied
46:12with or if we needed to go up or
46:16whatever. And that's why we're doing
46:17this at the outset of this process with
46:21the council. Now, this is not the actual
46:24lease agreement that we're voting on
46:27tonight. the the agenda item says
46:34in determining a lease value for this
46:36lease agreement. That's what we're
46:38trying to determine tonight.
46:40>> I mean, that's understandable, man.
46:41Anybody got a building and going to pay
46:43rent, man.
46:44>> So, that's that's what
46:46>> take no rocket science.
46:47>> At the end of the day, what we need is
46:51y'all to give us a direction in terms of
46:54a lease value in a motion.
46:56>> Okay. Well, this is what I'm my question
46:58I want to ask you. Um,
47:01uh, Mr. [name], you're correct.
47:03Nobody's going to really pay a a for,
47:07you know, not be in a bill and not pay
47:08for it. So, with that being said, that's
47:11a nonprofit. And so, y'all going to have
47:14to make it make me understand, are we
47:17not charging for ballots?
47:20Is is ballots being in that building for
47:23no fee?
47:24>> Okay. We're not We're talking No, you're
47:26talking. We're not making comparison.
47:28>> That's what I'm saying.
47:28>> We're getting to the point of where
47:30we're we're coming close.
47:32>> Hold up. Hold up. Hold up.
47:33>> We're coming close to
47:34>> What are you doing? Let me just Hold up.
47:36Yes, ma'am.
47:36>> Okay.
47:37>> Hold up. No,
47:38>> we're not.
47:40Uh, Excuse me. Excuse me.
47:42>> Okay.
47:44>> This is where we are. I'm just being
47:45fair.
47:46>> What you're doing, Excuse me. You're
47:49doing apples and oranges right now. We
47:51have an item on the table
47:54>> and what that item is is to look at the
47:56recommended cost and what we're going to
47:59have to agree on. Should they be charged
48:02and what is the a parameter that we're
48:04looking at? We're not comparing what
48:06they're doing. We're comparing them to
48:08them. That's all it is to their
48:10>> not charging someone else.
48:11>> We are not char we are looking at them
48:14specifically and seeing what the
48:17recommendation on the sheet that they
48:19gave you. They told you what the deal
48:21was and we're going through
48:23>> and they came to us with an offer of
48:251522.
48:27I want to make a motion we take their
48:29offer. Please. I want to make a motion
48:31we take their offer.
48:32>> What's the offer?
48:32>> 1520
48:34something a month.
48:36>> 1522 plus their portion.
48:38>> So I want and and their portion of their
48:40utilities.
48:41uh with an exception with an exception
48:44it be one year lease at a time
48:47>> just in case PVL needs that building
48:50later or that section later
48:53>> and they willing to pay that right
48:55>> yes sir
48:56>> okay I'll make that motion
48:58>> okay wait a minute hold up
48:59>> but they're not certainly utilities
49:01explain the utilities
49:02>> did you say what the explain utilities
49:04>> said okay hold up let's see
49:05>> I said utilities
49:06>> no no no explain to
49:10>> he made a motion So a motion is on the
49:12floor. So the only thing can be done now
49:14is either a second or it dies for lack
49:17of second.
49:17>> I second.
49:18>> So now it can be discussed.
49:20>> Okay. Moved in.
49:21>> We've been discussing it.
49:22>> Okay. The discussion has been and you're
49:24saying and you the recommendation
49:27is what they provided is plus the a part
49:32of the utility.
49:33>> The utilities and that's what we have on
49:35here. The utilities are being currently
49:39paid in full by probalis. The utilities
49:43will be reimbursed between the two the
49:46two entities. The city is not going to
49:47be the middleman anymore.
49:49>> Okay.
49:50>> Current agreement with proales already
49:52provides for proalis is paying for all
49:54of it and they have agreed to share that
49:57cost between them and workforce.
50:00>> That's my motion.
50:01>> That's the only thing. We need a
50:03workforce. How you know we need them.
50:05It's not a question.
50:06>> Well, well, we're going to do what they
50:08offer. They offered it. We didn't. They
50:10offered it.
50:11>> They offered it.
50:12>> Okay. So,
50:13>> any more discussion?
50:14>> So, what? Yes. Yeah. Real quick. And the
50:18and what uh what I what I was trying to
50:20figure out is like even they with them
50:23being with them offering that I mean we
50:26weren't even advised or given
50:29opportunity to even give a suggestion of
50:33what we would consider it to be leased
50:36for
50:36>> we talking about it now
50:38>> right now that was what the conversation
50:40>> beforehand because my understanding is
50:43that before they discuss any agreements
50:45and contracts they should advise does.
50:48Correct.
50:48>> You're being advised.
50:49>> Whatever you want. What do you want it
50:51to be?
50:52>> Okay. Well, the bottom I mean that's
50:53your interpretation that you haven't
50:55been advised. This is an advisement. So
50:57what what
50:58>> I'm saying is that the council governs
51:00the body, right? The council governs the
51:02city, right?
51:03>> You have been advised.
51:05>> No. Before he goes and make any
51:08agreements, we should be
51:10>> This was not an agreement. This was we
51:13have to on a day-to-day basis move
51:16things forward. And so that's all this
51:19was. This was not coming to you with an
51:22agreement to be approved. This was to
51:24come to you with what was offered to us.
51:27And if the council was accepting of that
51:30or not, this is not us entering into an
51:34agreement tonight. This is only the fact
51:37Mr. [name]'s motion is to accept their
51:39offer. And if we accept that offer, then
51:42we can move forward with the agreement
51:44and then it will be an actual
51:47contractual agreement between the city
51:49and them. This is nothing more that we
51:52will bring back to you the next time.
51:54This is nothing more than the council
51:56determining the value. This is as open,
52:00transparent, and upfront as we can make
52:02anything.
52:03>> And let me let me just interject this
52:05one. The city doesn't do the daytoday. I
52:09mean the council doesn't do the daytoday
52:11operation. That's why people are in
52:13those position. That's in the scope of
52:15their job to do the daytoday paperwork.
52:19Then they bring it back as a whole and
52:22present it. But it is not the council's
52:26responsibility
52:27to oversee the general job. They bring
52:31you the summary of what they're hired to
52:33do and that's in their their and they
52:37don't even know what you don't even know
52:38the summary. You don't even know what's
52:40before the summary. You don't even know
52:42what they're doing at all. So, I'm just
52:44saying that's a job description.
52:47>> You you've had you have an agenda for a
52:50week,
52:50>> but he did this before the agenda.
52:53>> Okay. Well, with that being said,
52:55>> talk to these people.
52:56>> Okay. I make a motion we move on
52:58previous question already done that I'm
53:01saying just reiterating it is going out
53:03I mean
53:04>> I make a motion we move on the previous
53:06question I second
53:07>> enough
53:08>> I make a motion we move on
53:09>> let's go back to where we were made
53:12second please and that's the end the
53:15discussion is
53:17>> they just ended the discussion
53:20>> you've got a previous question motion
53:21and a second
53:22>> and it doesn't matter you can make it at
53:24any time
53:26End end of discussion.
53:28>> Hey, I could end discuss of discussion,
53:31>> Miss [name].
53:32>> End of discuss. No, read your part. You
53:34can do that.
53:35>> No,
53:37you have to have to vote on when we're
53:39in discussion. Discussion can be
53:40completed.
53:42>> It cannot.
53:42>> And then then uh
53:43>> it cannot be considered when you call
53:45for the question.
53:46>> He's already called. You have to stop
53:48the
53:49>> I got a second
53:50>> and it's a second now.
53:52>> All in favor of the previous question.
53:53All in favor of a previous motion. I I
53:56did read it.
53:57>> Okay. So,
53:59>> okay.
53:59>> Three full.
54:01>> Now you vote on move accepting their
54:04offer.
54:05>> Okay. That's what
54:06>> and I that's already on the table.
54:07>> And that was already on the table.
54:09>> Been seconded.
54:10>> Okay. It's been moved and second to
54:11accept offers. All in favor?
54:14>> I have to accept.
54:15>> Motion carries.
54:20>> All righty. Uh item number six.
54:25Is that the right one? Am I on the right
54:27one now?
54:28>> Yes, ma'am.
54:29>> Okay. Public hearing on planning and
54:31zoning commission final report with
54:33conclusion and recommendation for
54:35proposed zoning text amendments relating
54:38to homebased business. Open for the
54:42public hearing is officially open. Does
54:44anyone have any direct uh
54:50input
54:54the information that you have? Does
54:56anyone from the public have any
54:58comments?
55:02Going once,
55:03going twice.
55:06Hearing is closed. Okay. Bring us to
55:09item number seven. Consider and approve
55:11an ordinance of the city of Crockett,
55:13Texas, amending article three of the
55:15appendix A zoning of the Crockett code
55:18deleting section 308 home occupations
55:22in its uh entirety including the
55:25requirements for a home uh occupation
55:29permit or home I keeping my occupational
55:33conditional use permit issued by the
55:35city and replacing it with a substitute
55:38section 308 Homebased business and
55:42garage sales to comply with home bill
55:452464
55:47passed by the 89th Texas legislature
55:50relating to the authority of a
55:52municipality to regulate a homebased
55:55business permitting a no impact
55:58homebased business as defined by House
56:01Bill 2464 to operate by right in a
56:05residential district if the business is
56:08comp compatible
56:10compilable with the residential use of
56:13the property where the business is
56:14located is secondary to the use of the
56:18property as a residential dwelling or is
56:21adjacent to the property owned by the
56:24same owner and having a primary use as a
56:27residential dwelling is not a business
56:30that sells alcohol or illegal drug. is
56:33not a structured sober uh sober living
56:36home and is not a sexually oriented
56:39business as defined by text local
56:42government code section 243.02
56:4602 incorporating curtain provision
56:49relating to the city's limitation to
56:51regulate commerce and firearms etc. and
56:55current provisions relating to garage
56:58sales into substituted section 308
57:02providing a servability clause
57:04containing a repealing clause and
57:06providing an effected date
57:10>> interpretation.
57:11Mayor and council, let me try to let me
57:14try to summize that pretty quick for
57:17you.
57:19>> Basically, House Bill 2464
57:23that the state legislature passed, it
57:26specifically prohibits a governing body
57:28or municipality
57:30from adopting or enforcing an ordinance
57:33that prohibits a no impact
57:36homebased business. And so basically
57:38what we're doing is adapting our
57:42ordinance to meet the state law is all
57:44this is doing. And there's several of
57:46those that will be coming forward. And
57:48that's all this is doing. And as far as
57:50the garage sales go, it it is included
57:53in this because that's where it fits in
57:55our ordinance. It doesn't change.
57:57There's no rule changes regarding garage
58:00sales in the city.
58:01>> People still be
58:03>> Yes, they they can still have them just
58:04the same way they did before. All this
58:06basically does is the state basically
58:10told the city you cannot regulate
58:12homebased businesses if they don't if
58:16they don't create a traffic hazard a
58:18this a that basically the state is
58:21taking the control away from the city of
58:23what we can regulate and we're codifying
58:25that because and it went to PNZ public
58:28hearing PNZ recommended council approve
58:32the ordinance change to codify it
58:34>> so it. I I didn't and I don't know this,
58:38but so just maybe think can someone have
58:42a at their house, can they have a garage
58:45sale every weekend?
58:46>> No, sir. Actually, uh
58:50>> according to our ordinance, they cannot
58:52be held more than twice a year.
58:53>> Okay.
58:54>> So, what you mean by like a homebased
58:56business? a homebased business. If
58:58you've got a perfect I mean if you if
59:01you're a baker, if you're selling cakes
59:03or cupcakes to somebody or whatever
59:06else, I mean something that you do out
59:09of your house that you make money from
59:12as long as it's not alcoholrelated,
59:14>> maybe even a nursery for children.
59:16>> Children, those kind of things. Yes,
59:18sir. And basically that's
59:21like I said, it's the state
59:24>> mandating
59:24>> mandating and it's just us codifying
59:27what we had. So we're legal with the
59:30state.
59:30>> So these would incur like fines and
59:32citations.
59:33Sir,
59:34>> these would incur fines and
59:36>> No, actually this loosens it up to where
59:39unless they we can still manage to make
59:42sure that they meet the fire and life
59:43safety code, you know, those kind of
59:46things, but it really
59:48>> well like they're cooking. You still
59:51have the the the state,
59:54>> right? Uh you you still have the state
59:56lady that comes by and checks you for
59:59>> department of health department
1:00:01referencing to the garage sales if they
1:00:03have more then how many's allowed
1:00:05>> down two per year but the garage sale
1:00:07component is it's just in this ordinance
1:00:11but the thing we're codifying is the
1:00:13homebased businesses as a whole that
1:00:17operate daily
1:00:18>> daily. Yeah. And so the garage sales
1:00:21would just put in the or it's in that
1:00:22ordinance anyway
1:00:24>> and their hours would not be limited,
1:00:26>> right? And they can't have an open sign.
1:00:28They the homebased business, you cannot
1:00:30put any signage that says that it's a
1:00:33business. I mean, that's the one thing
1:00:35the state did keep in there. But
1:00:37basically,
1:00:39>> if you've got a business that you run
1:00:41out of your household and you don't
1:00:43cause problems with the neighborhood,
1:00:45>> no signage,
1:00:46>> no signage,
1:00:47>> then the state says you can do it. Okay.
1:00:49>> And ours was different than that.
1:00:50>> Now, what about
1:00:54>> Well, I I I'll hold that.
1:00:57>> So, that's basically
1:01:00what that is. And uh that's a that whole
1:01:03thing basically is
1:01:04>> state change.
1:01:05>> That's lawyer talk for codifying that
1:01:08ordinance. Am I correct?
1:01:09>> Correct.
1:01:10>> Okay.
1:01:11>> So, they they they could they could put
1:01:13a commercial on the radio.
1:01:15>> Sure.
1:01:15>> And give their address. Just no signage
1:01:18on the property. No open signs,
1:01:20>> right?
1:01:21>> Yeah. Okay.
1:01:24>> Make a motion that we approve agenda
1:01:26item seven as read by mayor.
1:01:30>> Okay.
1:01:31>> I see.
1:01:31>> It's been moved and second. All in
1:01:33favor?
1:01:35>> Motion carries.
