Agenda · Packet · Minutes · YouTube · 1:24:46 long

0:01It's 9:00. 9:00.
0:07>> I tell you where I am. 9:00. Okay. We
0:10got one minute. I have
0:12>> I should be asleep.
0:15It's 9:00.
0:23>> I like that truck yesterday.
0:26It woke me up. I I got back Austin. I
0:30think I woke up about 10:00 last night.
0:33>> A lot of travel.
0:37>> Here come the Here come the law.
0:41>> The other law.
0:42>> It's the law.
0:47>> Yes. Good evening everyone. It is now
0:50officially 6 o'clock and we're opening
0:52our council meetings.
0:55If you didn't mean to be in city
0:58council, you're in the wrong place.
0:59[snorts]
1:02And we're open with an invitation and a
1:04pledge.
1:07Dear, Father in heaven, we thank you. We
1:08thank you for the opportunity to come

1:12those that have given their time and
1:14their talent to make sure that the city
1:16is prospered. Lord, we ask for
1:18protection for our city. And we thank
1:20you how you continue to protect us even
1:22as we go through. And we ask for wisdom.
1:25We ask for knowledge. And we just mostly
1:27ask that you uh share your love. That we
1:29be able to love what we do through out
1:31of love and compliance and looking out
1:35to everyone the empathy that only you
1:37are capable of showing. And we hope that
1:39we reflect. And as we leave here today,
1:41we're just be grateful to give you the
1:43praise and the glory in Jesus name.
1:45Amen.
1:46>> Amen.
1:49I aliance to the flag of the United
1:53States of America and to the republic
1:56for which it stands. One nation under
1:59God, indivisible, with liberty and
2:02justice for all.
2:08>> Once again, good evening to everyone.
2:11We're so glad that you braved the
2:13weather and came out to join us today
2:16because we do know that our business is
2:18important what we do in this city. We
2:21are grateful for our council for all
2:23being here and so punctual. Thank you so
2:26much. Uh with that being said, we're
2:29recognizing our uh visitors. Uh
2:34thank you for that. And at this point,
2:37I'll read you the the statement about
2:39the public comments.
2:41uh from the audience. At this time,
2:43members of the public will be allowed to
2:45speak on city related matters only. No
2:48personal uh matters or matters under
2:51litigation will be allowed. The length
2:52of time may not exceed 3 minutes. City
2:55council shall not speak under this item.
2:59in accordance with the Texas Open
3:01Meetings Act that the council may not
3:04deliberate or take action on matters
3:07except as properly posted in accordance
3:10with the law. With that being said, um
3:13is does anyone have any public comments?
3:19>> All right. So, at this time, we'll bring
3:22us to item number one, regular session,
3:25June 1st, 2026.
3:33move that we approve the the minutes
3:35from the regular session from June 1st,
3:382026.
3:40>> A second.
3:42>> Okay, it's been moved and second.
3:45All in favor?
3:48Motion carries. Brings us to item number
3:51two, reports, police department manpower
3:54and criminal incident report for May
4:03Good evening, Mayor Council.
4:06Police Department manower criminal
4:08activity report for May of 26. Total of
4:1116 officers, worked 2,68
4:14hours, responded to 413 calls,
4:18investigated 11 traffic accidents, made
4:2153 arrests, issued 262 traffic
4:25citations,
4:26completed 69 reports responded to 25
4:30alarm calls and 21
4:34that you'll see a breakdown
4:36question about our report.
4:42Um there's no question about that. I
4:45know I provided y'all with a update this
4:47morning about the shootings that
4:49occurred over the weekend.
4:51I believe in that report that I sent
4:54y'all, we I mentioned two suspect
4:57investigators spent pretty much all day
4:59out of town going counties following up
5:02on that. They've identified three
5:04suspects
5:06that are responsible for the shooting.
5:09They're currently working on paper and
5:12documents arrest for each one of those.
5:16Something I want to mention,
5:19heard it talked about, seen people
5:21talking about it.
5:23I think it's important to note that
5:27this event that took place, this was not
5:30our citizens, not our community members
5:33that this were people from out of town.
5:36They're not related to anybody here.
5:38They come to our city with pre-existing
5:41issues that they had had amongst
5:43themselves and they in our city. I think
5:47I think a lot of people question
5:49[clears throat]
5:50about the event and
5:52making comments
5:55our citizens or our city. I think it's
5:57important to know that if not
6:00these guys coming into town obviously
6:02had issues with each other and put all
6:04of our citizens in danger and we're
6:07actually really blessed that we didn't
6:10have any fatalities and a lot more
6:13gunshot victims than we did for the
6:15number of people we had out there.
6:18In the coming days, there'll be some
6:19more information provided. I'm waiting
6:21for some some things to finalize with
6:24the investigators and then uh we'll
6:27we'll come out with some more public
6:28information
6:30probably around Wednesday of this week.
6:34for now that's really all I have on
6:36that. I'll update y'all as the
6:38investigation continues.
6:40>> Chief,
6:42>> I I appreciate you um seeing to that uh
6:46those that incident. I also want to
6:48appreciate you for working for with the
6:49young men that um
6:52um put on that event uh working well
6:55with them, collaborating with them to
6:57make sure that everything uh worked out
7:00on their behalf. Um I just want to just
7:03thank you for that. You and all the
7:06other officers that were there. Um and
7:08like I said uh in the pre-existing
7:10planning phase as well. Um y'all were
7:13there. So I want to thank you for that.
7:16So That's something I did want to
7:17mention, you know, give credit for
7:20credit to Mr. McCull put this event on
7:23every year. This is the 11th year that
7:26we've had this event issues up until
7:29this year. And the issues, like I said,
7:31that we had, well, not for many of our
7:33people, from somebody completely
7:35unrelated. So, he does a really good job
7:37of of controlling the situation.
7:40Obviously, there's always going to be
7:41more issues here and there, but in the
7:43grand scheme of things, he does a really
7:45good job. So he and I have been in
7:48communication about how to how to make
7:50it better, how to make it more safer for
7:52the community. And going forward, I
7:54think we'll be able to work a lot closer
7:56on that.
7:57>> And as as we talked earlier about it, I
8:00it was a plan. Yeah. And I know it's
8:02very important that it was a plan in
8:05place and it was a consideration about
8:07where to park it and all of that. Uh but
8:10one of the side effects is that it is a
8:12small area and it's not a lot of exits
8:16there. But in terms of what the intent
8:19of and the intent was really when it
8:22started was focused around the youth and
8:24that was the whole deal doing what they
8:26could do to best support our youth and
8:28they were but then it got a little mixed
8:31crowd when it went to adults and youth
8:33and so I know that's one of the factors
8:35we have to look at but in terms of how
8:38the people took care of each other and
8:39how they watch uh and it was a really
8:44it was a like I said was a planned out
8:46event, but some things you just can't
8:48plan when you don't know the full
8:50extent. And it was one of It was the
8:52largest crowd yet.
8:53>> It was very [snorts] large. We estimated
8:55at one point about 2,000 people.
8:58>> It was our community during this
9:01investigation. They've been amazing,
9:05they have
9:07>> like I told I think it's important to
9:10remember what the events for. It's for
9:11our community and our kids. So I think
9:15we should focus on that versus bringing
9:18in so many people. I think we're on the
9:20same page about that. We'll continue to
9:22work on that.
9:26>> Thank you.
9:27>> Thank you for the support. It was It
9:28did.
9:30>> Good job.
9:32>> Okay. Uh brings us to item number three,
9:34fire department monthly activity and
9:37status report for May 2026. Chief,
9:41mayor, council members, uh for the month
9:43of May, we had a total of
9:46breaking that down. 28 city limits and
9:5017 in our county response area.
10:00>> Y'all had an event.
10:02Did y'all have an event at Walmart?
10:04What's that?
10:06Walmart.
10:14You know, I I that's why I said I didn't
10:16realize
10:17how was scheduled who was actually in
10:19charge. I did see a lot of people coming
10:21and going.
10:34>> Like I said, that's a good added to the
10:35city when you get to see you in your
10:39where you are in your official capacity,
10:40but it's not in your scary capacity.
10:44Paul.
10:45>> Yeah. Well,
10:46>> it was real nice. We do appreciate how
10:48y'all are working with the city and give
10:50kids an opportunity to to dialogue, get
10:52to be around here like that.
10:56>> Thank you, Chief.
10:58>> Okay, that brings us to item number
11:00four, business. Consider and approve a
11:02resolution of the city council of the of
11:05the city of Crockett, Texas selecting an
11:07engineer firm to assist the city with
11:10the submittal of an application for
11:12funding and project implementation of a
11:14contract if awarded from the Texas
11:16Department of Agriculture TDA for the
11:192026 Downtown Revitalization
11:22Program DRP and of the Texas Community
11:26Development Block Grant Program Texas
11:28CDBG of the Texas Department of
11:31Agriculture, TDA, under application
11:35number CDM26-04.
11:41Mayor and Council, uh this resolution is
11:43our next step in the process of applying
11:45for the downtown revitalization funds
11:48for uh sidewalks, waterline repairs, um
11:53and the things that go with that. um
11:56handrails, ad 88 access. Um we had four
12:03engineers submit to the project. Um
12:06during the process of of scoring
12:11GLS and PEP Dawson, KSA are almost the
12:16neck and neck. Um GLS did win by a
12:19fraction of a point as you see on the on
12:21the scoring sheet there. Um we have
12:26In my recent years, we have not worked
12:28with GOS. GOS does work with a lot of
12:31cities um around us, including [snorts]
12:35uh Gralin. Um a lot of work in Lufkin
12:37and and their downtown and sidewalks and
12:40everything. Um so, we feel pretty good
12:43about GLS. We just don't have the
12:45personal um uh background with them.
12:48KSA. Uh you you guys all know and are
12:52aware of the work that we do through
12:55KSA. They're really good engineering
12:57firm. Um and I'd look forward to working
13:00with either one of those. Um
13:04KSA did lose a few points due to the
13:06amount of work that we currently have
13:08with them. Um I do feel like their local
13:11staff is really overloaded probably. um
13:15they don't have enough local staff in
13:18out of their Lufkin office and it seems
13:20like a lot of our projects are moving
13:22slower than
13:25>> than they probably normally do. That
13:28being said, um we would
13:31uh look forward to working with either
13:32one of these companies and I don't
13:34really have a specific recommendation
13:35because either one comes with a little
13:37bit of a trade-off
13:39>> and that's that's why we wrote the uh
13:41recommendation letter like we did.
13:44Yeah, I was uh yeah, I was I was in
13:47question because I know that we do a
13:49whole lot of I've noticed that we do a
13:51whole lot of work with KSA engineering
13:53and I was also wondering um because I I
13:57haven't seen a um how a scoring sheet on
14:00how you actually score the engineers.
14:03So, I would like to get familiar with
14:05how we score the engineers. What we what
14:07are we looking for? Um also um
14:14because I think that was one of my
14:15question was do we open it up
14:18>> um to other engineering firms to place
14:21but in
14:22>> Yeah we do like I said we had um some
14:24years we won't have but one engineering
14:27firm submit a lot of it depends on their
14:30workload or uh you know how they can
14:32respond but this year we had four uh
14:34respond to that one. Uh we did call some
14:37references Um, like I said, GOS is the
14:40one that's done a lot of the uh downtown
14:43Lufkin um work. KSA has done our they do
14:48a lot of our water. They they they've
14:50done actually both of our previous uh
14:52sidewalk grants as well. Um they're very
14:57very both of them are very capable
14:59firms. Um and both of them have you know
15:01they're going to have the same budget
15:03for engineering. So the costs are going
15:06to be the same. Um,
15:10>> but I think one of the I mean one of the
15:13things that we did talk about was that
15:16>> it at one point you might have to start
15:18expanding and introducing at least one
15:20others even though we have one that we
15:22have worked with for years but over time
15:25you sometime just bring in a new one if
15:27they're that close in numbers just to
15:29see how well so that we will have an
15:31alternative and there and I think one of
15:35the concerns with over booking for what
15:38they already have here to add another
15:40project on top of it and maybe give us
15:42an opportunity to see. You're just going
15:46to have to try different agencies to see
15:49how well they do it. Again, be
15:51>> So, do you think that KSA I mean, you
15:54think that they're overloaded
15:57at this present time with
15:58>> That's some of that's some of my that's
16:01my opinion. Um, and from what I'm
16:02hearing from other cities, um, that's
16:05working with KSA, we're not really
16:07concerned about their capacity and their
16:10abilities. It's, um, just their ability
16:14to get the work out, um, get it
16:16completed,
16:16>> the performance.
16:17>> Um, we have quite a few million dollars
16:20right now tied up with KSA that is
16:22awaiting to get go out for bid. Um, some
16:25of it's waiting for text um, review and
16:29approvals. some of it's waiting for
16:31water development board approvals, but
16:33it's just in different phases and it
16:34seems like um
16:37>> to add another layer.
16:39>> That was I think that was my I'm glad
16:41you brought that up because that was one
16:43of my concerns was that we have we use
16:46KSA for pretty much all of a lot of our
16:50projects here that I've been noticing.
16:52And I was like, well, this an
16:54opportunity KSA is to be
16:56>> KSA is having the historical data. Uh,
17:01for instance, Mr. Bob Thurber, who's
17:03been with KSA forever,
17:05uh, well, probably, you know, most of
17:07his career, he's been with the city of
17:08Crockett as well. So, he has a lot of
17:10historical data to pull from when we're
17:12working on a new project is not finding
17:15out new information. He has past
17:16records, past plans, designs, uh, maps.
17:20He knows 20 years ago when we put this
17:23line over here and why we did it and how
17:25deep it was. So, you have all that
17:27information. It's hard to it's hard to
17:31go to someone else that doesn't have any
17:32of that background. Um KSA does. Mr.
17:35Thurber has retired with KSA. Um and so
17:39over the past few years, we do have it
17:42just seems like [snorts]
17:43that's just just one of my concerns that
17:45I have to that I it's my duty to bring
17:47it to y'all's attention
17:48>> today. We're not right where we need to
17:53with KSA and their performance. Is that
17:57right?
17:57>> That's my opinion. Yes, sir.
17:59>> Okay. Okay.
18:02>> Is there a time frame for this
18:04submittal?
18:05>> Uh yes, we do have to get this um we
18:08have to select the engineering so they
18:10can complete uh the design and get it
18:12submitted for the grant application.
18:15>> Okay. you know, [clears throat]
18:17>> what would the time frame be like? This
18:19year, next year?
18:21>> Uh, no. In the next few weeks, we have
18:23to get this submitted.
18:26>> Okay. With that being said, um, cuz I
18:29see you have a resolution here with KSA.
18:33>> No, ma'am.
18:34>> Information. We're not
18:36>> I don't have KSA on there.
18:38>> Okay.
18:38>> I'm just letting y'all um appoint. If
18:41y'all can if y'all can select an
18:43engineering firm, we will plug that
18:44engineering firm in and we'll move
18:46forward.
18:46>> Well, the question I have is, have we
18:48had any issues like
18:49>> understanding you're saying that the
18:50projects aren't as far along as we think
18:53they have, have we had like legitimate
18:54issues of shoddy work or not being done
18:57or them not meeting deadlines?
19:00>> Um,
19:01submit submittal deadlines. Um, not
19:04getting the work out. Not a qualify
19:07problem. No sir, we don't have a quality
19:10problem. They're very capable. Um
19:12they're just they're you have one person
19:16in an office in in Lufkin with lots of
19:18workload
19:20>> and he'll admit it too. You know, I
19:22don't want to speak for them, but they
19:25need help. And right now we have a lot
19:28of money already on the books with them
19:30and I would like to
19:35see if another firm can help us as well.
19:38Okay.
19:38>> So, the next firm you would you would
19:40suggest would be GLS?
19:42>> Yes, ma'am.
19:43>> My my concern would be if we pulled
19:44money from them and go to somebody else
19:46that that may just bump bump us further
19:48down because they're like, "Well,
19:50they're not going to invest back into
19:51us, then why are we going to we'll get
19:53to Crockett when we get to Crockett?"
19:56>> That's a that's a thought. Um
19:58>> but I think they're professionally
19:59invested.
20:00>> But wouldn't there be a contract?
20:02>> We have we have many many millions of
20:04dollars tied up right now currently with
20:06them. I do I I do hope that if anything
20:09I do hope this message
20:11um gets to the decision makers at KSA
20:15>> that we want to continue work with them
20:16and consider them as a high priority
20:19engineering firm but we do have lots of
20:22projects that need to get across the
20:24finish line
20:26>> with um we're going with a new firm.
20:29>> Would we be looking at like some
20:31redundancies or would they come in?
20:35Most of these are build design projects
20:38that meet state requirements. Um the
20:41state uh CDBG has certain designations
20:45or requirements for slopage for uh for
20:50height of steps and uh densities of
20:53concrete materials. They have all the
20:55same specifications.
20:57>> Um JLS, KSA,
21:00they do these projects for cities all
21:01over. It's basically mapping out the
21:04location and so there wouldn't be a lot
21:08>> location. So with that with that being
21:10said, you're saying he has all the maps,
21:12the plans and things like that. Isn't
21:14Isn't that what we're paying them for?
21:16So we don't have copies of that.
21:18>> We do. Yes.
21:18>> Okay. So
21:19>> it's historical. It's historical
21:20knowledge.
21:21>> Okay. Okay. Extra. Okay.
21:24>> I think the Yeah. It just seemed like
21:27>> Go ahead. No, I just say it seemed like
21:29after list looking at and just reviewing
21:32them is that at some point you do need
21:34to broaden your base a little bit
21:36because we have worked with them and we
21:37have it hasn't been that we've been
21:39dissatisfied but if if anything happen
21:42because companies are changing and the
21:43one that we dealt most with is basically
21:46in has retired. So I think at some point
21:49you're going to have to broaden your
21:50base. uh like for keys, you don't want
21:53all your eggs in one basket, but you do
21:55want you at least you'll be able to make
21:57a comparison. Right now, we're getting
21:59things done, but we're not in a
22:01comparative mode. And
22:03>> and when you have one person with a
22:05whole lot of the same projects, you
22:08ought to at least introduce one
22:10different person in because the records
22:12are are easy to access, background
22:15information, and all of that. You can
22:16pull that out. And most of the
22:18requirement as he had mentioned before
22:20it's it's designated what you can do by
22:22the state must be done this way this way
22:24and that. But I do think that it it does
22:27a city competition is pretty good. I
22:31mean you get better services sometime
22:33when you it's not a guarantee that
22:35you're going to do it. It might raise
22:37the bar a little bit.
22:40So that's my opinion. So I I'll make a
22:43motion that we select the uh GLS as the
22:47engineering firm to assist the city with
22:49the submission of an application for
22:51funding and project. Do I need to read
22:53>> No. [laughter]
22:55And etc.
22:57>> I second number.
22:59>> I second.
23:00>> Okay. It's been moved and second. All in
23:02favor?
23:04>> I can't see.
23:08>> Somebody counted it for you.
23:09>> Yes. And then
23:10>> all opposed.
23:12>> Okay. One.
23:14>> Okay. Motion carries.
23:16>> Thank you, mayor, council.
23:18>> Okay. It brings us to item
23:21[clears throat] number five. Consider
23:24and approve a resolution by the city
23:25council of the city of Park, Texas,
23:27requesting financial assistance from the
23:29Texas Water Development Board
23:31authorizing the filing of an application
23:33for assistance and making uh
23:36[clears throat] certain findings in
23:38connection therewith.
23:40Mayor and councel,
23:42this is a resolution allowing us to uh
23:45submit our application uh to the Texas
23:47Water Development Board for um we are
23:51allowed to request up to $10 million.
23:53So, we're requesting $10 million
23:56um to the uh Texas Water Development
23:59Board for water line uh repair,
24:02replacements and repairs. Um we're
24:04putting some of the projects together.
24:06This is basically a
24:09um a letter of interest and submittal.
24:12And so if we do get um
24:16approve, you know, approved and get
24:17through the first hurdle, then we will
24:19start the process of building the
24:21projects together and come back to
24:22council um with the amounts that we've
24:24been approved. Um this is a pretty
24:27competitive grant.
24:29Um there's a lot of cities that are that
24:31I know that are going to be putting in
24:33for this. Um but and it is a 0% match.
24:37So it's $10 million with match. And this
24:41is coming from the constitutional
24:44amendment recently enacted by state
24:46legislature for the $1 billion each year
24:49that is uh put towards water
24:51infrastructure. And so they've opened
24:54that process up for cities to submit
24:57their intended use and their request.
25:00>> So So you're saying there's no interest
25:04>> on the $10 million?
25:05>> Yes, ma'am. It's a It's a 100% grant
25:07with no with no match
25:09>> with no more match
25:10>> on on on approval. Will we need a uh a
25:13writer for the grant?
25:15>> Um so moving uh forward with this this
25:18is only allowing us to the the grant
25:21process is more of an application is not
25:23a a grant so to speak.
25:26>> So uh we likely will not have any grant
25:31administration or grant writers. We'll
25:33be doing all that in house. We have the
25:34application. We're probably 50% through
25:38the application now filling in all the
25:40requirements.
25:41>> Um so we're doing the application in
25:44house.
25:44>> Okay. So with this being a grant, we're
25:46not having to pay it back. Is that what
25:48you're saying?
25:49>> Correct.
25:50>> It is.
25:52>> Now I do have another question as well.
25:54Now I see here we have KSA. That's I
25:57think that's what I was looking at. KSA
26:00engineer. Uh they're they're helping us
26:02um on some of the initial projects um
26:05for developing um
26:09uh preliminary budgets for developing
26:12preliminary budgets. Um
26:15>> yes.
26:19>> Okay. But
26:19>> but this is all this is the people that
26:21are who are already working for us on
26:23these other projects. So they're just
26:25asking us to name our current financial
26:28adviserss, our engineers. Um so they're
26:31our current um engineers on our water
26:33projects as well as bond council. So
26:36those are all of our current um
26:40adviserss.
26:42>> Okay. Um
26:43>> on this project, if that's the case, I
26:45make a motion we move forward with the
26:46application process.
26:50>> Okay. It's been moved and second. Ready
26:54for the vote. All in favor?
26:57Motion carries.
26:59Let's find some money.
27:01Uh item number six, [snorts] consider an
27:03approved nomination and appointment of
27:05new member of member or members to the
27:09charter review commission.
27:11>> Mayor and council, I have the commission
27:13member in sheet in in the uh in y'all's
27:17packet.
27:19This shows who all the current members
27:21are.
27:23Um, we've had a request to remove the
27:26precinct 4 charter uh commission members
27:31and to appoint uh Miss Lois Ball and
27:33Miss Joe Denman for precinct for
27:36nominations.
27:40>> What's the
27:44>> Okay. So, I want to make make a move to
27:47appoint those two members.
27:50>> I second this motion.
27:51>> Okay. has been moved and second. All in
27:56>> You
27:58[laughter]
27:59vote against.
28:01>> Yeah. All right. Motion carries.
28:06>> All right. It brings us to item number
28:08seven. Consider an approved approve
28:10setting a timeline for proposed home
28:13charter revision. I know we've been
28:16working for a sale. I
28:19>> mayor and council, I have some
28:22information for y'all. Um, it's been
28:26requested at different points. It's been
28:28talked about in open or public comments.
28:31Um, I have m uh council members
28:33sometimes talking about it. So, I would
28:35like we do have a couple new council
28:37members. Um, so I do I'd like to do a
28:40quick historical recap of where of where
28:42we've come from and where we're at.
28:44>> Okay. uh for the sake of new members and
28:47to get council's input on moving
28:51With a couple new me uh members now
28:53serving on council, it's important to
28:55provide a brief history, explain the
28:57purpose of this effort, discuss the
28:58challenges we've encountered, and
29:00request clear direction on how council
29:02wishes to proceed. The charter revision
29:05process was initiated in October 23
29:08with a goal of conducting the first
29:10significant review and modernization of
29:12our charter since 1960s. The goal has
29:14been to identify inconsist in
29:16inconsistencies and ensure compliance
29:19with state and federal law and present
29:21recommended recommended revisions to
29:23council and then the voters for their
29:26consideration. The process experienced
29:28an early setback when the original
29:31consultant was taking the commission in
29:33a different direction that was not
29:34supported by myself or by city council
29:37and that effort was suspended after
29:39approximately two months. After
29:41additional research, the city was able
29:43to retain a law firm specializing in
29:45home rule charter revisions to properly
29:47guide us through the process legally.
29:50Since that time, we've made significant
29:52process progress and have identified at
29:55this time we're right at 23 potential
29:57charter propositions.
29:59Many of these address provisions that
30:01are outdated, unconstitutional, or
30:03inconsistent with uh current law. This
30:06does not mean that the city has been
30:08operating or will in the future operate
30:11illegally where our charter conflicts
30:14with state or federal law. We're
30:16required to follow superior law. For
30:19example, our charter still contains a
30:22requirement that a council member must
30:23be a land owner to serve, which is not
30:26legally enforceable. It's
30:27unconstitutional.
30:29If you're a renter, you can still run
30:31for council. Other revisions simply
30:35create consistency such as establishing
30:37a uniform process for council members to
30:39appoint people to boards and commissions
30:42and um um key city officials.
30:46Um currently there's multiple processes
30:50and they all defer from the others on
30:52how those appointments are made and
30:53they're not consistent.
30:56However, the process has faced several
30:58challenges that have slowed completion.
31:00The original committee consisted of 13
31:01members.
31:03Looking back, I sincerely wish we did
31:06not have 13 members. That's a lot of
31:07people to work with.
31:09>> Uh, one of the issues is requiring seven
31:12members for a quorum. If you have 13
31:14members and you can proceed with a
31:16quorum of seven members, due to
31:18attendance challenges, people have
31:20different things going on sometimes and
31:22they can't attend. Many times you'll go
31:25to the next meeting with a complete
31:27different combination of members.
31:30that have no historical information from
31:33your previous meeting. And so you're
31:35regressing and starting all over in your
31:37discussions. And all of these were
31:39paying an attorney to sit through there
31:41with us and guide us and lead us.
31:44And for those members that were able to
31:48attend the previous meeting and the
31:49current meeting,
31:51they're going to be going through a lot
31:53of the same information and it becomes
31:56discouraging to have to sit through and
31:59discuss the same things that you
32:00discussed last time. It doesn't seem
32:02like the best use of some people's
32:04times. And so because of that, we do
32:07have a lot of one step forward, one step
32:10back, one step forward, and then we, you
32:12know, so we're going through that
32:13process, right? Definitely nothing on
32:15the members. It's not their their issue.
32:18It's just it's a numbers problem.
32:22Um, in addition, since we started over
32:25two years ago, right at two years ago,
32:27there have been 23 total appointments to
32:29this committee.
32:31um due to incoming council members
32:34making new appointments to replace
32:35existing members. This by f this um for
32:39the for the record, this council has
32:41that authority and is very much
32:43recommended. I want council
32:45to trust and support the people that are
32:48sitting on this committee. So that I'm
32:50not talking about it as a negative, but
32:53with that comes once again another
32:55reset. We have new incoming members.
32:57They don't have the historical
32:58background and knowledge moving forward.
33:00So sometimes we're regressing in
33:02information and coming back to the table
33:04with the same information again. Um so I
33:08just want to I want to kind of give some
33:10some information to council about
33:14the some of the reasoning behind slow
33:16progress. Um this this frequent turnover
33:19um is hard to keep continuity and
33:21momentum.
33:23As a result of these challenges, some of
33:25our dedicated committee members are now
33:28becoming frustrated and disengaged.
33:30after repeatedly covering the same
33:32issues.
33:33Despite that, they have held strong. We
33:37have some really good people on this
33:39these committees. Um we are now in the
33:41final stage of review. Uh we believe my
33:45attorney um our uh committee chair and
33:49myself, we believe that we can complete
33:51this work within the next couple of
33:53meetings, one or two more meetings. We
33:55can finalize all of our discussions. We
33:58already have all the uh the propositions
34:01that the committee has recommended
34:04drafted. So we need to go back do a
34:06quick review and approval process if
34:09there's any last minute cleanup that
34:11needs to be done and then bring that to
34:13council.
34:15At this point I really want clear
34:16direction from council.
34:19Do you want to complete this project
34:20through the committee process or do you
34:22prefer to dissolve the committee and
34:24conduct the remaining review directly as
34:26a council with our charter attorney
34:27because ultimately it's fixing to come
34:29back to you guys anyway.
34:31Um I want to emphasize this is not a
34:34[name] project. Our city can continue
34:37operating under existing law regardless
34:40of the charter. However, I really want
34:43the charter to be finished. We've
34:45started a really good project and I feel
34:47like we're we're close enough to almost
34:50taste it and so I would like to get this
34:52project completed. If you support this
34:55and you want to complete this process
34:56through the committee process, um I I I
35:00ask this um for your commitment to allow
35:02our current committee membership to
35:04finish the work uh without any further
35:06disruption um or restarting previously
35:10completed discussions. The purpose of
35:12the committee is to provide community
35:14involvement and a sampling from across
35:16our community because ultimately this is
35:18all going to the voters for a vote. So
35:20if we have one little pod of people
35:22group thinking
35:24and not taking people's ideas and input
35:27from across the community, we could put
35:29put together a project that could would
35:31would not pass and we've wasted
35:33everybody's efforts. So it's really good
35:35that we have a broad um sampling from
35:37across our entire community. And so I I
35:40applaud that side of the things. Um once
35:44it's completed, it's those proposed
35:46changes are coming back to council for
35:47full review. Council will be able to ask
35:50questions of our attorney.
35:52They will be able to make revisions.
35:54They'll be able to completely strike
35:56propositions if they feel like it's not
35:58that they don't want that proposition to
36:00go to the voters or they can approve
36:02them for placement each one separately.
36:08if we move forward, I recommend that the
36:11committee commi complete the work over
36:12the next one or two meetings. Our
36:14attorney can then finalize the report
36:16and prepare the proposed propositions
36:18for council. Council should expect to
36:20dedicate,
36:23I'm thinking, at least two or three
36:26meetings. And it needs to be in a
36:27workshop format outside of a council
36:29meeting. If y'all can find a few dates
36:32that we can sit down and talk and
36:36discuss charter alone for for an hour to
36:39two hours and get through this process
36:41with our attorney. Um I because of the
36:46commitment from council, I'm I'm my my
36:48hopes are that we would start that
36:50process after our budget season is over
36:52because y'all have other workshops lined
36:54up for that. So, after our budget season
36:57is over, towards the fall, we would like
37:00to bring this report back to council.
37:03And I ask y'all to commit a couple
37:06meetings. Really, y'all set the
37:07deadlines. Y'all set y'all's own
37:08timelines. If y'all want to discuss
37:10everything at length once again, it may
37:13be several meetings. It's going to be a
37:15a lot of it is going to be up to y'all
37:16and how y'all feel like moving through
37:17the process because it's going to be on
37:19y'all's time. Um,
37:22we resume the charter work and in
37:25September and October we finish our com
37:27our committee process. October, November
37:29before we get into holiday season, we
37:32get these to council.
37:34We get council's um workshop process
37:36done and then we use the December,
37:40January, February timeline for our
37:42attorneys to have all the propositions
37:44ready and for us to be able to order the
37:46ballots and go through the process for a
37:48May election.
37:50That's my thoughts
37:52on on the timeline and I want council's
37:56commitment
37:57um and support on this. I want y'all's
38:00input if y y'all are ready for us to do
38:03this process. Um
38:06and how many meetings do y'all want? you
38:08know, do cuz I'm going to have to get
38:10our attorney geared up
38:12>> to do
38:13>> to to do this to to meet with um council
38:16and to work through this process cuz
38:18it's not just a one off or a two two
38:20proposition issue. It's we're we're
38:23redoing the entire charter, you know,
38:25from front to front.
38:26>> How would how would we know how many
38:29meetings it would take, though? Well,
38:31you you won't you won't a lot of it's
38:34going to be as you go.
38:35>> I mean, if our attorney's got to be
38:36there, right?
38:38>> Um, a lot of it's going to be y'all set
38:41y'all's own timeline as y'all as y'all
38:43go. Um, but I do want y'all to know that
38:46there is
38:48>> going to be some commitment from
38:49council. Like, I I want to know that
38:52y'all are going to be able to do this
38:54process as well
38:55>> so we don't falter in at at the end
38:58point. I' I'd like to uh actually, you
39:01know, make a motion um because I do have
39:06some concerns and I move to table item
39:09number seven until the charter revision
39:12committee can determine which home rule
39:16charter they are revising, whether it is
39:20the original charter that's dated April
39:231967
39:25or the adopted charters dated ated 1985
39:30and 1997
39:33and allow the new members time to review
39:38and provide amendments, recommendations,
39:42inputs to whatever needs to be on the
39:46charter to the charter vision committee.
39:58Are we open for discussion?
40:00>> Yes.
40:00>> So if we table it, it gets brought up
40:03next meeting. Is that not is that
40:05correct?
40:07>> But um with with the with the
40:10proposition
40:12you're saying that there are multiple
40:13charters. The thing is is that we're
40:17looking to
40:19correct the charter and make a
40:20[clears throat] new charter to begin
40:22with. So, I think we should just move
40:25>> No. Who Who's correcting a new ch who's
40:28making a new charter?
40:30>> So, you're saying we're making a new
40:31charter? No one said you said we were
40:33supposed to be improvising and
40:37updating
40:38the old charter. So, you're saying we're
40:41making a new charter. So, which one are
40:43we doing?
40:44>> You're putting a lot
40:47You're putting a lot of All of this is
40:48all based on very false premises. None
40:50of this is correct. Okay. So
40:52>> it's not factual.
40:53>> Okay. So we have a
40:54>> So I can't even respond to that.
40:55>> Okay. Reason you can't. Okay. So we have
40:57a charter that's dated that was approved
40:59by the people in April of 1967 that the
41:03people actually voted on. So my question
41:06is when do we have another vote in the
41:09city of Crockett for another charter?
41:12>> We
41:14now now I guess would be a good time we
41:16can discuss this portion.
41:17>> But you're veering off into other
41:19questions.
41:19>> Well, I'm just so
41:21We've operated under one charter the
41:24entire in our entire existence. It has
41:26been amended with one with votes and
41:29they all the every amendment to the
41:32charter has had to happen with a vote of
41:35our citizens. If something was added to
41:38this charter, there's another vote. But
41:40the charter has not changed.
41:42>> When when have these votes happened?
41:44Because
41:45>> they've happened historically many times
41:47during our history of our city.
41:49>> Please give me some dates. Call the
41:51question.
41:52>> Call the question.
41:55>> She has a motion. It's been seconded.
41:57Call the vote.
41:59>> Cuz we're discuss this today.
42:00>> We have We have a mo motion. Call the
42:03>> Is there a second?
42:07>> All in favor?
42:08>> No, we need a sec. Who seconded the
42:10>> He? No, I didn't. Oh, he his Yeah, it's
42:13been seconded.
42:19So now we go back to the previous
42:21>> Okay. Then the previous question. I'm
42:23sorry I missed that.
42:24>> The previous question was to table.
42:26Let's
42:26>> go back to the the previous question was
42:28to table
42:30>> item number seven. Yeah. To table to
42:33table item number seven. Well
42:35>> so now you would call for a vote for
42:37>> For the previous question.
42:39>> Okay. I need some help. Okay. So, we're
42:42calling for
42:43a vote
42:45>> to table
42:47>> until we can find out which charters are
42:51>> which charter
42:52>> being discussed. I suppose
42:54>> the charter that we've been working
42:56with. Is that the one?
42:59>> The charter that will be updating the
43:01charter. Which charter we're using to
43:03update?
43:05>> I'm a little confused.
43:06>> She's made a motion to to table it. It's
43:08been seconded. We need to vote on if
43:10we're gonna table it or not.
43:12>> It's a yays and naysay is where we're
43:14at. Madam Madame Mayor,
43:16>> call for a vote.
43:18>> The mayor the mayor called for a vote.
43:20If there's any other vote,
43:22>> anyone else that wants to vote to table
43:31>> Who's who does not want to table?
43:34Okay. It fails. it would not be table.
43:40Okay. So, at this point, we're going to
43:44move forward.
43:45>> We can continue with another vote if
43:47there's another motion that wishes
43:49someone that wants to make another
43:50motion. Um,
43:52>> as I as I mentioned before, this is a
43:55timeline for us to go finish the process
43:58that we started two years ago. Um, for
44:01further clarification,
44:04there's never been multiple charters.
44:06There's one charter. There's amendments
44:08that have been made. We are doing we are
44:11not doing a oneoff amendment. We're
44:13doing a full revision at this point. So
44:16this full revision will be with the
44:18latest this full revision is based on
44:21our latest and current
44:24>> charter that we've always operated on.
44:26>> What was that? What is that?
44:27>> Please let me know what which charter
44:29are we actually operating on.
44:31>> One. We've only had one.
44:33>> We only have one.
44:34>> Which one?
44:35>> I mean that question. I can't answer
44:37that question.
44:37>> The thing of it is is
44:38>> because there's one which I'm going to
44:40explain something to you is that and to
44:43uh to everyone I understand is that a
44:46charter does not or amendments does not
44:48go forward until the citizens or the
44:51taxpayers has voted on the charge. So
44:54what amendments have been made and when
44:56were those amendments that's
44:59>> okay?
45:01>> I don't know.
45:01>> We don't have anything no motion to
45:03discuss.
45:03>> Oh okay. I Well, okay.
45:07>> I make a motion we push the time limit
45:09and have the committee report to the to
45:11the council by September 1.
45:14>> Okay,
45:15>> Okay, it's been moved and second. All in
45:20Motion carries. And then
45:22>> Thank you, council.
45:22>> We'll continue with Thank you. Got a
45:25little ball there. U Okay. Item number
45:29eight, consider and approve an ordinance
45:30[snorts] amending article three of
45:32charter nine, chapter nine, food and
45:35food handlers of the Crockett code,
45:39deleting article 3, mobile caterers,
45:43mobile food push carts, mobile food hot
45:47trucks, mobile food units, and mobile
45:50food vendors in its [clears throat]
45:54entirety.
45:56uh including the requirement to obtain a
45:58permit from the city of Crockett before
46:00operating a mobile food unit and
46:03replacing it with a substitute article 3
46:06mobile food vendors to comply with House
46:09Bill 2844,
46:12also known as the Mobile Food Vendor
46:16Regulatory Consistency Act, passed by
46:19the 89th Texas Legislature, which
46:23effectively which effective July 1, 2026
46:29permits
46:30>> preempts preempts, I'm sorry, a local
46:32authority power to prohibit the
46:34operation in its jurisdiction of a
46:37mobile food vendor who holds a mobile
46:40food vendor's license issued by the
46:42Texas Department of the State Health
46:44Services and complies with all other
46:49state and local laws, including all fire
46:51codes, location restriction, [snorts]
46:54Zoning codes incorporating regulation
46:57relating to administrative author
46:59authoriz authorizations
47:02allowed location and distance and hours
47:06of operation providing a servability
47:08clause containing a repelling repelling
47:13clause and providing an effective date
47:16and Dr. [name] can't see. She can read
47:18but she can't see. Thank you.
47:19>> Yes ma'am. Thank you mayor and council.
47:21This is a um this repeals our existing
47:25mobile food vendor
47:28>> um ordinance and uh permitting process.
47:31The state um passed as uh was just read
47:36passed um a law that preempts all city
47:39regulation. So we're no longer in the
47:42food vendor uh mobile food vendor
47:44permitting business. It takes it out of
47:47our hand and all other cities. And once
47:49a once a mobile food vendor is has their
47:52state permits and licenses, they can go
47:54to any city um and operate if they want
47:57to go to, you know, parade or festivals
47:59and and and things that they don't have
48:01to go through a a long drawn out process
48:03through the city. Um the city was
48:05required initially to do that because we
48:08had to ensure state compliance. Now the
48:10state takes care of it all and we're out
48:13of that business. Uh which is really
48:15good for us. We're excited to be out of
48:18that. Um, that being said, with the only
48:20things that still remain, we want to
48:22make sure that they're properly
48:24disposing of their waste water, that
48:26they have a grease trap. They're not
48:27dumping grease and things of that
48:29nature. So, um the those are the only
48:32things the uh the fire um the the fire
48:37suppression or inspections that they
48:38have an extinguisher um as required by
48:41the fire department and that they're
48:43properly disposing of their waste and
48:45waste water. Um and then there's but
48:48there's not a fee process for any of
48:50that. We we'll take care of that and um
48:53they're good for a year.
48:56I approve u the order of amending
49:00article three of chapter nine food and
49:04food handling of cross
49:08>> second that
49:10>> okay it's been moved and second ready
49:12for the vote all in favor
49:16motion carries
49:19>> we have nothing in the executive
49:21>> yes you have
49:22>> oh yes we do I'm sorry number nine
49:25Executive Section Government Code 551087
49:30deliberation regarding economic
49:32development a negotiation with the
49:34business prospect.

50:24have when they made the recommendation.
50:26I'm sure they
50:26>> information on
50:28>> they should have
50:30>> if they recommended they
50:31>> I don't know. I know for sure. You got
50:33to talk to
50:34>> Yeah.
50:35>> They would have done it for the people
50:37that they submitted.

1:22:04>> Oh, I thought he was in here. Oh,
1:22:07sorry. Make that corner. Okay, we're
1:22:09good.
1:22:11We'll quietly wait till he returns.
1:22:33Okay, we're officially back in session.
