10:01>> At this at this time, we are up to the
10:04approval of minutes. Number one, the
10:06regular session October [clears throat]
10:085, 2026.
10:11I'll make a motion that we approve the
10:13minutes from October the 5th, 2026.
10:16>> Second.
10:19>> Okay, it's been moved and second.
10:25>> I'm sorry.
10:29>> You ready for all in favor? I thought
10:32somebody was saying oppose.
10:35Motion carries. Okay. At this bring us
10:38up to the reports. a presentation of a
10:40proclamation recognizing [clears throat]
10:41November 8th through the 14th, 2026 as
10:45National Nurse Practitioner Week in the
10:47[clears throat] city of Crockett, Texas.
10:49>> Mayor and Council, I have um Mrs.
10:53[resident] [resident] here representing
10:56nurse practitioners in Crockett and she
10:58has a short presentation to talk to
11:01council about and then we have a
11:02proclamation afterwards for her.
11:07Good evening and thank you for tonight.
11:11I just wanted to talk a little bit about
11:13nurse practitioners and how they serve
11:15in our city and in our county. I'm not
11:18sure if you all realize that we have 11
11:21practitioners currently practicing in
11:23the city of
11:25we have
11:29Timber and myself
11:32clinic
11:35staple and Barnes
11:38Health and Wellness has
11:40Texas family doctor
11:47of us.
11:50Of course, that number far exceeds the
11:51number of physician colleagues that we
11:53have. And so that we serve a very
11:56important role in in the city and the
11:59county. Three of us have actually
12:01purchased buildings and remodeled and
12:03set up our businesses here to serve for
12:06the long run. And you know, a lot of
12:09what I do is
12:12mentoring for younger students that are
12:14coming into our city as well. We have
12:17affiliation with Texas&M Austin
12:22Baylor [resident] [resident] [resident]
12:26all bring nurse practitioner students
12:28medical students pharmacy students
12:30therapy students where they graduate
12:32through our clinics. So
12:35me being the senior member saying that
12:38I'm closest to retirement one of the
12:40things that is important to me is that
12:43really show value for younger people
12:46that are training and considering where
12:48they may want to practice in the future.
12:51I've served in a lot of roles in the 28
12:54years that I've been a nurse and I've
12:56been here for about 11 years.
12:59I've worked in Texas Medical Center.
13:01I've worked as a professor at UT. I've
13:04worked as a staff nurse and now as a
13:06nurse practitioner urgent care.
13:10I have to tell you of all my roles that
13:12I've had in my career, this has been the
13:15most fulfilling serving market. So I
13:18thank you this evening for allowing me
13:21to come and speak a little bit
13:25and for us
13:29>> ma'am
13:34we have something good for
13:52Okay. From the office of the architect
13:55is a proclamation. Whereas nurse
13:58practitioners NPS's are highly skilled
14:01healthc care professionals who advanced
14:04education and clinical training.
14:07equipped them to provide quality
14:09compassion patient centered care
14:13including the diagnostic treatment and
14:15management of acute and chronic illness.
14:19Whereas more than 47,000
14:22nurse practitioners serve te across
14:25Texas playing an essential role in
14:27meeting growing health needs
14:30particularly in rural and medically
14:33underserved communities where access to
14:36medical services often limit. And
14:39whereas the city of Crockett, a
14:41designated rural medically underserved
14:45communities, is fortunate to have 11
14:48nurse practitioners serving locally,
14:52including three who have invested in our
14:55community by purchasing property and
14:58establishing their own medical clinics,
15:00strengthening our health care system,
15:03and expanding access to essential
15:06services. And whereas the dedicated
15:09expertise and compassion compassion of
15:12these professionals improve the health
15:16and well-being of our citizens and
15:19national
15:20nurse practitioner weeks provides us an
15:25opportunity to recognize their
15:27invaluable contributions to our
15:29community. Now therefore I the mayor of
15:34city of my name
15:39together for us. together with the city
15:42council do hereby proclaim November the
15:448th through the 14th, 2026 as
15:50your drum roll national nurse
15:53practitioner week
15:56[applause]
16:01in the city of Texas and encourage all
16:04our citizens to join us in honoring our
16:0711 nurse practitioners for their
16:09outstanding
16:11dedication to quality health care and
16:14commitment to strengthening the health
16:16and the future of our community and
16:19witness where I here to set my hand
16:22because the great seal of the city of
16:24Texas to be a 19th day of October 2026.
16:39We did a lot.
16:42[applause]
16:57That was nice.
16:59Thank you. It is such an honor to be
17:01able to have business and investing in
17:05us. Our healthc care is very important.
17:08Thank you. Uh that's that brings us to
17:10reports. Item number two, presentation.
17:12Oh, I got the presentation. I'm sorry.
17:14City administrators uh report on
17:16proposed changes to the city's garbage
17:19collection uh route.
17:22>> Mayor and council, um I wanted to bring
17:24this to y'all in advance. Uh we'll bring
17:26it to you probably November the uh 2nd
17:29at our next council meeting um in a more
17:32official mapping and and layout for
17:35y'all to consider and speak with
17:37representatives of the of Eco Waste, our
17:40uh garbage collector contractor.
17:43There's several changes that they've um
17:47that continue to um need to improve on
17:52and one of them that keeps on coming
17:53back and and truthfully I I see it as
17:55being a a positive change um than their
18:00current operation and it includes adding
18:03another truck to their rotation in the
18:06city of Crockett. What they're wanting
18:08to do is place two trucks in the city of
18:11Crockett uh five days a week. We
18:13currently have u garbage collections on
18:16Mondays, Wednesdays, and Fridays. It's
18:19causing them to work hours well in
18:22excess of 12, sometimes even 16 hours a
18:25day. So, they're running their truck
18:27drivers over the state limit of of CDL
18:30driving limits, causing them to bring
18:33out admins, uh, running doing pickups
18:36really late at night a lot of times
18:37trying to get the full route picked up.
18:40They're wanting to coordinate that with
18:42their county pickup where they have two
18:45two trucks um in the city and I believe
18:48two trucks in the county, but they're
18:50wanting to do this on a daily basis
18:53Monday through Friday, five days a week
18:56um to make shorter days to where they're
18:58picking up time and if there's a a need
19:02either a bad weather day or their one of
19:05their truck drivers are sick and they're
19:07having staffing problem, whatever case
19:09may be that caused them to done longer,
19:10they're having shorter days to make that
19:12up. They don't have to um be already
19:15tied for time and then try to add an
19:18additional route into their pickup. Um
19:21the the first map that they brought,
19:24it was
19:26it was very clean and streamlined where
19:29they kind of divided the city up in five
19:31pie charts in in a in a in a pie chart
19:33with five sections, but it didn't
19:36coincide with our precincts. And I asked
19:39them to to look into some options that
19:42were were easier for us to explain to
19:44our community. A lot of most of our
19:45community is getting they're aware of
19:47what their precinct is if they're
19:48precinct one through five.
19:51Let that coincide with the day of their
19:53pickup to the to the biggest degree. And
19:56so they're going to present a couple
19:57more options and come to council and
19:58talk to y'all about that at our next
20:00council meeting. But I just wanted y'all
20:02to be aware of that. There's also
20:04some cons some some issues with um the
20:09double
20:11staffed trucks. They have a a driver and
20:14at least one sometimes two guys on the
20:16back of a truck.
20:19Um if y'all looked at the news, um a
20:22city very close by to us actually had a
20:25wreck um this past week with fatalities.
20:29um they're wanting to get people off the
20:31back of trucks as much as possible. In
20:34many ways, our pickup processes, it made
20:37a lot of sense to have a person on the
20:39back of the truck. And we can talk more
20:42and I would like to kind of break that
20:44down to council some of the pros and
20:46cons be between having side loader
20:48trucks that are automated
20:50um and having uh staffed trucks or
20:54trucks that are staffed with members on
20:55the back riding the truck. um heat
20:58exhaustion. There's a lot of concerns
21:00and issues that they want to bring to
21:02council. They're not ready right now at
21:05this next meeting. They first want to
21:07address route changes and establishing
21:10that, but they also want council to
21:12start considering
21:17what it would look like with some
21:18automated side loaders versus um rear
21:21loaders with um sta staff with members
21:24on the back. So
21:26>> I wanted to bring that to council to
21:27kind of give you some heads up on it.
21:29>> So this is this is meaning that we're
21:31looking at purchasing.
21:33>> No.
21:33>> Okay.
21:34>> No means they're going to purchase and
21:37it means our garbage rates are probably
21:38going to go up.
21:41>> No, they're um
21:42>> they can't.
21:43>> I think our argument No, they can't. And
21:45I think their argument if anything um it
21:48will make them a lot more efficient
21:50having side. So, I think those need to
21:54be some of council's considerations.
21:55>> Okay. What about uh I guess their time
21:58frame um of pickups? Uh would that be
22:01something they consider same hours or
22:03would they consider earlier hours?
22:05Because I hear you saying that late
22:07nights. So, if it's late night, they
22:09start early.
22:10>> Well, if they're if they're moving to
22:11five days a week, they're going to have
22:12shorter days. So, they won't go into
22:14their goal is to not go into the late
22:16nights. But also by our ordinance and by
22:19our contract
22:21um they're not allowed to start pickup
22:23services earlier than uh 7:00 I believe.
22:27And so in order to not be in in
22:30subdivisions and around homes running
22:33garbage trucks at 5 or 6:00
22:35>> I think that was just a certain certain
22:37area that was requesting that.
22:38>> It's in the contract.
22:39>> Yeah,
22:40>> it's in the contract.
22:41>> So can we relook at revisit?
22:42>> Y'all can if y'all want to. Yes, sure.
22:44because I think it was just certain a
22:45certain area that was specifically um
22:48stating that they didn't want anyone to
22:50come through there by 7:00 because they
22:53come part of the discussion but the
22:54contract includes
22:55>> I think that was that was in the morning
22:57I believe when there was people
22:58>> the morning contract was the early and
23:01someone do come early
23:02>> so that's not
23:04>> that's what that's the main uh points
23:06that I want to bring y'all in advance um
23:09and we'll get more of a uh a rollout
23:13plan the dates and times and when
23:15everything when the actual
23:17representatives can be here.
23:18>> So, we'll get a copy of all of this
23:20before
23:21>> Yes, ma'am.
23:21>> meeting.
23:22>> Yes, ma'am.
23:23>> Okay. Um,
23:26is that it?
23:27>> Yes, ma'am.
23:27>> Okay. Item number four, our fire
23:30department monthly activity and status
23:32report for September 2026.
23:35>> Good evening, Mayor Council.
23:37>> Good evening.
23:38>> For the month of September, we had a
23:39total of 44 calls, 30 of those being in
23:42the city Rocket 14.
24:07>> We're good. Thank you.
24:09>> Nobody has anything. Thank you.
24:12Okay, that brings us to item number
24:15five, police department manpower and
24:17criminal incident report for September
24:192026.
24:20>> Good evening, mayor, council,

24:52traffic citations, completed 67 reports,

24:58that, you'll see a breakdown of our
25:00incident. I'll entertain any questions
25:02you may have about
25:09It's nice to see we don't have a lot of
25:12drug arrests.
25:16>> Thank you, chief. Thank you, sir.
25:18>> Thank you.
25:18>> Appreciate it.

58:54Okay. So that brings us to the next
58:58item.
58:59Uh item number seven consider and
59:01approve the adoption of the revised
59:03policies of the Crockett Police
59:05Department.
59:12Get you a chair.
59:14>> Welcome. Welcome back.
59:16>> Yeah.
59:23>> Mayor, council, city administrator, as I
59:26told y'all
59:28ago, our policy manual has been severely
59:30outdated for years.
59:33Like I was sharing during the meeting,
59:36you look at some of our old policies and
59:38they've been copied so many times the
59:40wording is sideways on the page and
59:43running off the page. There's no PDF
59:46copy of that and a lot of the laws and
59:48stuff have changed over the years that
59:50that
59:52um I said these policies come from best
59:55practices through the state of Texas.
59:57There's a lot of agencies that use
59:59those, especially agencies that are
1:00:02working towards being recognized.
1:00:05So, um, these policies I've been
1:00:07running, uh, our city attorney, so if
1:00:10she catches anything that is off or
1:00:13shouldn't be right, you know, we can we
1:00:16can fix that. I did receive some
1:00:18[snorts] emails from council members
1:00:20prior to tonight's meeting about making
1:00:23some adjustments. Um, but those are
1:00:25really adjustments, changing changing
1:00:28numbers or changing misspelled words or
1:00:31wording things like that, making sure
1:00:33that everything is covered in the policy
1:00:36that it should be. And so ultimately
1:00:38what I'm asking tonight is um you've
1:00:41seen the policy topics. Uh you've seen
1:00:44the policies that we're asking to put in
1:00:46place and the purpose and I'm asking
1:00:49that we adopt those policies so that we
1:00:52have those going forward. Uh so a good
1:00:56cut instruction
1:00:58to our officers, to our staff of the
1:01:00procedures that they follow, you know,
1:01:02from a dayto-day basis.
1:01:06>> Mayor, mayor [clears throat] and
1:01:07council, we
1:01:09>> we need before discussion, we need a
1:01:11motion.
1:01:12>> Yeah.
1:01:12>> Uh, mayor and council, I move that we
1:01:15approve the adoption of the revised
1:01:18policies of the Crockett Police
1:01:19Department.
1:01:20>> I second that.
1:01:22>> Okay. It's been moved and second. Ready
1:01:24for discussion?
1:01:25[segment omitted]
1:01:27[segment omitted]
1:01:33[segment omitted]
1:01:36[segment omitted]
1:01:39[segment omitted]
1:01:45[segment omitted]
1:01:49[segment omitted]
1:01:51[segment omitted]
1:01:54[segment omitted]
1:01:56[segment omitted]
1:01:58[segment omitted]
1:02:03I was going to bring to your attention
1:02:04is the uh
1:02:07the uh financial financial part. And I
1:02:12saw where
1:02:17the issue is right down here is that um
1:02:24how you're you're actually in your
1:02:26policy. you're actually bypassing the
1:02:30council and giving authority to the city
1:02:34manager, the financial director, and the
1:02:38treasurer to make uh to approve your
1:02:42budget.
1:02:43That's what I saw.
1:02:45>> We already do that.
1:02:48>> So, the council does not approve your
1:02:49budget. Well, if if there's um an
1:02:52extravagant purchase, if I'm going to
1:02:54buy a new vehicle or um I'm trying to
1:02:58build a new station, obviously those
1:03:00purchases are going to come before
1:03:01council. Uh but from day-to-day
1:03:03operations,
1:03:06we already make those because the
1:03:08council approves my budget, that money
1:03:11in that budget can be
1:03:13>> utilized.
1:03:14>> Okay. So, it's so you're saying it's
1:03:16already in your budget. So, Okay. So,
1:03:19That's what you say is basically the
1:03:20money is already there and but so being
1:03:24that they approve your budget and
1:03:28basically as far as the spending goes we
1:03:31the council is not advised on anything
1:03:33that you're purchasing or
1:03:35>> yes
1:03:35>> how does that work
1:03:38>> like activity I mean like different
1:03:40things so in other words we don't get we
1:03:42don't get to
1:03:43>> activities are reported
1:03:45are reported by the city for all
1:03:47departments including the police
1:03:48department. Our activity reports will
1:03:50show all the expenditures and money
1:03:52going in and out.
1:03:53>> So that's what
1:03:54>> So it is reported to council.
1:03:56>> It's being reported to council.
1:03:58>> Yes, ma'am.
1:04:01>> Every month.
1:04:02>> I'm just trying to understand what you
1:04:03were asking. Will you ask that again?
1:04:05>> Okay. Basically, I was asking the
1:04:07activity, you know, the activity like
1:04:09say monies that are you're spending in
1:04:11and out uh that you're receiving.
1:04:16my department is tracked through our
1:04:17budget software.
1:04:19>> When the council sets my budget,
1:04:22>> it's up to me to determine how that
1:04:24money spent and the supplies and the
1:04:26things that we need
1:04:27>> for my department.
1:04:29>> That all that money is tracked in our
1:04:31budget software.
1:04:33>> Every time we have an expenditure,
1:04:34whether it's a credit card,
1:04:36>> purchase order,
1:04:37>> that money is tracked. So that's that
1:04:41answer your question
1:04:41>> somewhat because I because uh I think I
1:04:44have been asking for that information a
1:04:46while back when we was doing budgeting
1:04:48and u I never received any of it. Yes,
1:04:50you have
1:04:51>> you're you get that report monthly.
1:04:53Every month you get that report.
1:04:55>> I don't
1:04:57>> Yes, ma'am.
1:04:59>> Interest particular concern about that.
1:05:02>> So, let me ask you a question. So, so
1:05:04well, well, that's my my whole issue is
1:05:07like anything like the monies that are
1:05:09being spent out of your, you know, your
1:05:11department. just kind of get an idea
1:05:13because I was looking at where you were
1:05:15talking about um emergencies and things
1:05:19uh emergency expenditures and it was
1:05:22saying that that you or your designate
1:05:25would determine uh if there was an
1:05:27emergency to spend those monies and u I
1:05:31think it would be approved through the I
1:05:33think the administrator
1:05:36>> or how how does that work?
1:05:37>> Well, there's there's a lot of things I
1:05:39mean we could search all night for
1:05:44Emergency expendure can be a lot of
1:05:46things. Just for instance, this last
1:05:49budget year, one of our brand new
1:05:51Durango is a transmission out. That's an
1:05:54emergency expenditure because we have to
1:05:55have that car on the road. I don't have
1:05:59time and we don't have time to let it
1:06:01sit to wait for the next council meeting
1:06:03to come forward to say
1:06:06>> council, can we fix this car that we
1:06:08have to have? No, that's an emergency
1:06:09expenditure. it's in my budget. Um, it's
1:06:12in my vehicle maintenance,
1:06:15>> an expenditure that big because it's
1:06:17it's higher price. I'm going to reach
1:06:20out to the city administrator or to the
1:06:21finance director and say, "Hey, you're
1:06:23fixing to see an expenditure for $4,500
1:06:27>> for this vehicle to get fixed. I don't
1:06:29want that way they're not caught off
1:06:30guard or not surprised because it could
1:06:32come down later on where I have to cut
1:06:34back in my budget to come in under
1:06:37budget."
1:06:39So, that kind of an example of an
1:06:41emergency expenditure. Okay. If um
1:06:46you know if one of our vehicles catches
1:06:48on fire and we have to buy a new car,
1:06:51that's an 80 something thousand
1:06:52expenditure. Um in my eyes, yeah, it's
1:06:55going to be an emergency. But an
1:06:56expenditure like that, I'm going to come
1:06:58to council and say, "Hey, we need to
1:07:00replace this." So there, you know, I
1:07:02don't I don't know there's any other
1:07:05concerns there.
1:07:08>> Yeah. I I might well just
1:07:10>> saying don't look too much into
1:07:12emergency expenditures. If it's if it's
1:07:14something that's very important,
1:07:17very expensive, obviously I'm going to
1:07:19come to the council and let the council
1:07:21know. But day-to-day operations, I'm
1:07:23going to expend my budget.
1:07:26>> But like you said, the essence of the
1:07:28budget when it's approved by the
1:07:30council, it's already the budget. And
1:07:34when you're taking from me, that's you
1:07:36just sometime you do move things around
1:07:38and [clears throat] but it's in the
1:07:40budget
1:07:41>> and so and if it's any other unusual
1:07:45amount, that's where it would come back
1:07:47if it was something special. But when we
1:07:49approved the budget, it's pretty well
1:07:51approved to go ahead with it.
1:07:54>> So being that you're in charge of your
1:07:56your budget and if I have any budget
1:07:59concerns, any budget questions, I need
1:08:01to basically come to you. Correct. No,
1:08:04no, no.
1:08:05>> The council has approved the budget.
1:08:07>> No, no, no, no. I was asking if I had
1:08:10any any questions about but you can't
1:08:12micromanage.
1:08:15>> If I have any questions about any
1:08:17expenditures and that's not
1:08:19micromanaging, I can ask those
1:08:21questions. If I have any questions about
1:08:23spending, any expenditures or activity
1:08:26in your department for spending, I can
1:08:28come to you and get that information.
1:08:30Correct.
1:08:30>> Sure. see those records. I think all
1:08:33those records are kept here at city hall
1:08:37copies. I don't know exactly where they
1:08:39but any any money that we spend is
1:08:43taxpayer dollars, there's going to be an
1:08:46invoice or receipt to accompany that
1:08:48that purchase. So if you have questions
1:08:50about why do you have you know four
1:08:53rings of paper
1:08:56you can see that invoice.
1:08:58>> So do we not keep digital?
1:09:00>> I'm sorry. Do we not keep digital
1:09:02invoices in?
1:09:04>> That's
1:09:06digital information. I'm not sure if you
1:09:08have access to that.
1:09:10>> Say that again.
1:09:11>> Our budgeting software has digital
1:09:14information, but I don't those records
1:09:19I only have to make those records
1:09:21available and those records are
1:09:23available. I don't have time to sit and
1:09:26print off and copy hundreds of receipts.
1:09:29Okay, we're off we're really off topic.
1:09:31This this is this is not a budget
1:09:33workshop. This is not a budgeting
1:09:34workshop. This this is about policy.
1:09:38No, no, no, no, no. This is about
1:09:39adopting his policies. This is a this is
1:09:41not a budgetary workshop. We're not
1:09:43we're not budgeting. We're not talking
1:09:45about his budgeting.
1:09:47>> I'm talking I didn't interrupt you. I
1:09:48interrupted the chief cuz he's up here
1:09:50explaining.
1:09:51>> Let him listen right now. Hold up.
1:09:56>> Call the question. Madame Mayor, we have
1:09:58a we have a motion in a second.
1:10:01>> I'm We just have a motion to call the
1:10:04question.
1:10:04>> No. Yes. A
1:10:05>> motion to call the question.
1:10:08>> A second.
1:10:08>> A second to call the question.
1:10:10>> A second.
1:10:11>> Okay.
1:10:14>> All in favor
1:10:15>> discussion
1:10:16>> to call the question.
1:10:19>> Oppose.
1:10:25>> Okay. Question. We're call for vote.
1:10:27>> Question's been called.
1:10:29>> Now we need a motion to
1:10:31>> the previous question.
1:10:32>> Previous question.
1:10:34>> Okay.
1:10:34>> We have a motion in a second. We need a
1:10:36vote on the previous question.
1:10:38>> And what was the question?
1:10:39>> To adopt the the policies that the chief
1:10:41has put forth.
1:10:43>> Yes.
1:10:44>> It was made a motion by Mr. [name],
1:10:47Mr. [name], seconded. And that's the one we
1:10:49need to vote on now.
1:10:50>> Okay. All in favor?
1:10:54>> Opposed? We have a um
1:10:58>> we already we've already had the motion.
1:11:00>> Yeah, but we have a we have a
1:11:02discussion.
1:11:03>> No discuss discussion was a
1:11:05>> discussion question. It was the closure
1:11:07of the discussion
1:11:09>> on the previous question.
1:11:12>> You have a discussion
1:11:14in the middle of discussion. There was a
1:11:16motion to call questions.
1:11:26So the motion has passed.
1:11:28>> Okay. So now we're on to item number
1:11:30eight.
1:11:31>> We're on to item number eight. Discuss
1:11:35and consider awarding by resolution a
1:11:38contract for grant administr
1:11:40administration services pertaining to
1:11:42the application and implementation if
1:11:45awarded of the city's mitigation
1:11:47reallocation
1:11:48program MRP grant from the Texas General
1:11:52Land Office GLLO and authorizing the
1:11:55execution of a contract.
1:11:58>> Mayor and council, I have the um score
1:12:00sheets in front of you. Um we on Friday
1:12:04we had the bid closing for grant
1:12:06administration for the
1:12:09GLLO reallocation program that we
1:12:11discussed at our previous uh council
1:12:13meetings. Um it's a rapid moving grant
1:12:16um with November deadline for uh
1:12:19submission. And so we did have two
1:12:23responsive biders on
1:12:26the um grant administration. So they'll
1:12:29be part of administering the grant
1:12:30through its life cycle if awarded. Um
1:12:33they'll also assist in the uh grant
1:12:35writing. Um
1:12:39we had uh Trailer and Associates and
1:12:42Lenford CMS um both submitted um RFPs
1:12:46for that uh project. Um
1:12:50we did it based on we did it based on a
1:12:53$10 million which is the uh $10 million
1:12:55being the grant maximum. So, we uh
1:12:59calculated it based on a full $10
1:13:01million. Um, and Trailer Associates
1:13:06quote was for 7% of grant total and
1:13:10Langford was for 7.25%
1:13:13of grant total. Um,
1:13:16we have a long-standing history working
1:13:18with Trailer. They've been very
1:13:20effective and um, we've received a lot
1:13:24of uh, grants through their
1:13:25administration. Um, I have the score
1:13:29sheets in front of you. Trailer, um,
1:13:32scoring at 100. Langford also got great
1:13:35scores and good reviews from other
1:13:37cities. It's just that they did have a
1:13:39higher, uh,
1:13:42uh, cost.
1:13:44>> Did you not u the, the bid information
1:13:48uh, on each one of the grading?
1:13:51>> Yes, ma'am. I Yes, ma'am. I I reached
1:13:53out to council said that I had that
1:13:54available. I have the rating sheets um
1:13:59and we tallied them up and that's the
1:14:01total score for trailer and langford.
1:14:03>> Okay. My question is why is there any
1:14:06particular reason why you didn't include
1:14:08the rating sheets in our packet?
1:14:11>> Because we did it on Friday and the
1:14:12packets were put out on Tuesday
1:14:16and that's why I reached out to council
1:14:18and let let y'all know that I do have
1:14:20that information.
1:14:24>> Okay.
1:14:31Um so we today we're asking for um the
1:14:35approval of this uh award by resolution.
1:14:39Um and I'm okay like I said I believe
1:14:42both of them are wellqualified
1:14:43candidates. Um the scoring did go
1:14:46towards trailer due to their lower cost
1:14:49but both of them are qualified
1:14:50candidates and so we would ask just for
1:14:53an approval for one of them so we can
1:14:55move forward with the grant application.
1:14:57>> So is this if this is a contract that
1:14:59we're we're approving?
1:15:00>> No ma'am. You're uh approving the
1:15:04resolution
1:15:05>> resolution and
1:15:06>> to allow us to enter um into a contract.
1:15:08Yes, ma'am.
1:15:09>> Okay. So have we not seen the contract
1:15:12>> I haven't even seen the contract yet.
1:15:13So, we're approving the contract before
1:15:15>> based on a resolution so we can begin
1:15:17applying for the grant.
1:15:19We can't develop a contract if we don't
1:15:22have the resolution by law. So, this
1:15:25resolution is the next step in
1:15:27developing the contract.
1:15:30The biggest thing that council
1:15:32one is this is a successful company that
1:15:35does a great job. Both of them I believe
1:15:38are well qualified. I think they're both
1:15:40good companies that can do a great job.
1:15:42Uh secondly is the cost um trailer
1:15:48is a little bit cheaper than Lanford. So
1:15:51I would just like council to allow us to
1:15:54move forward so we can get the
1:15:56application submitted in the by the
1:15:58November deadline.
1:16:00>> So my next question is how do we approve
1:16:02a contract when we have a
1:16:05>> you're not approving the you're not
1:16:06approving the contract. You're approving
1:16:07the resolution.
1:16:08>> How we approve the resolution for the
1:16:10contract? because we haven't even seen
1:16:12the contracts yet.
1:16:13>> The
1:16:16contract can only be drafted where it's
1:16:19illegal to draft a contract until a
1:16:20resolution has been submitted.
1:16:22>> Okay.
1:16:22>> And we have documentation that we pro uh
1:16:26>> follow the proper uh procurement
1:16:28process. So the resolution is the first
1:16:30step in developing the contract. Then
1:16:33the contract I will bring back to
1:16:34council.
1:16:35>> Okay.
1:16:35>> So the grant and the grant has not been
1:16:38submitted. No, we need we need this this
1:16:41grant administrator that we would this
1:16:43is the first step in approving that
1:16:44grant administrator to submit the grant.
1:16:48>> Okay. Do we know the cost of what how
1:16:49much it's going to cost us to
1:16:51>> 7%.
1:16:53>> 7% of the
1:16:54>> for trailer for trailer is 7% 7.25 for
1:16:57Langford.
1:16:59So depending on how much we're awarded
1:17:01as well. So it comes out of the grant
1:17:03proceeds. If we don't get the grant we
1:17:05don't pay a dime. If we get the grant,
1:17:07we get we pay that 7%.
1:17:09>> Mayor and council, I'll make a motion we
1:17:11award it to Trailer and Associates.
1:17:13>> That's right.
1:17:14>> A second.
1:17:14>> Okay. It's been moved and seconded.
1:17:17>> Ready for any more discussion?
1:17:25>> Um, [cough and clears throat]
1:17:26did you have anything else?
1:17:38Yeah. No, it's just basically um
1:17:44>> I don't have anything.
1:17:44>> Okay, there's nothing else ready for the
1:17:47vote.
1:17:48>> All in favor?
1:17:50Oppose?
1:17:54>> voting for voting for oppos?
1:17:58>> Okay, motion carries. Okay, brings us to
1:18:02item number nine. Discuss and consider
1:18:05awarding by resolution of contract. Is
1:18:08that the one we just read?
1:18:11>> Am I on the right?
1:18:12>> No, you're
1:18:12>> okay. for engineer services pertaining
1:18:15to the application and implementation if
1:18:18awarded of the city's mitigation uh re
1:18:22reallocation program MRP grant for the
1:18:25Texas General Land Office GLO and
1:18:28authorizing the execution of a contract
1:18:35mayor and council. Um we went through
1:18:37the same process for engineering. Um the
1:18:41we had four submissions. Uh we had a
1:18:43submission from EDGE. Um this initi this
1:18:47scoring sheet here says GLS. It's not
1:18:49GLS it's edge. Um PEP Dawson which was
1:18:54which purchased KSA. Uh
1:18:56>> okay.
1:18:56>> Uh KSA uh was bought out by PE Dawson.
1:19:00So you'll be seeing that name more often
1:19:02if under our engineering uh current
1:19:05engineering projects light point and
1:19:08SPI. Uh we have four four bids um
1:19:13submitted or RFQS which are
1:19:15qualifications. They're not bids.
1:19:17They're not there's no cost associated
1:19:19with our decision making on this. After
1:19:22calling references, uh, reviewing the,
1:19:25uh, the the packets, uh, for all of
1:19:28these four firms, um, our
1:19:32recommendation, um,
1:19:35um, based on the scoring sheet is, uh,
1:19:38for Edge Engineering,
1:19:41um, for a total score of 98.67,
1:19:45uh, Pape Dawson, KSA also a very
1:19:47qualified firm. Uh they also received
1:19:51high ratings there. What they lost a
1:19:53couple points just because of our
1:19:55concern due to the quick timeline of
1:19:58submission for this project and to carry
1:20:01out this project. There's a 24-month
1:20:04deadline to get the project through all
1:20:06design, engineering, and construction.
1:20:09And we currently have s quite a few
1:20:12projects with KSA. And we feel like
1:20:15speed is one of our biggest concerns and
1:20:18the reason for recommending edge.
1:20:26>> Any other?
1:20:27>> Well, I make a motion if we're ready for
1:20:29a motion.
1:20:31>> I make a motion that we accept uh Edge
1:20:35as our engineering firm.
1:20:37>> Second.
1:20:38>> Okay. It's been moved and second. Any
1:20:40discussion?
1:20:41>> Yeah. So in this in this case as well,
1:20:43we have to um approve the resolution
1:20:46before the contract is
1:20:50>> only issue I have with is not seeing
1:20:53what's in the contract and proving the
1:20:55contract.
1:20:57>> You're not approving the contract.
1:20:58You're proving a a resolution for us to
1:21:01draft and enter into a contract. We'll
1:21:03bring that contract back to city
1:21:04council.
1:21:05>> I haven't seen the contract either.
1:21:07>> It's just for it to be created.
1:21:09>> Okay. This just allows them to draft a
1:21:11contract so we can review it. If we
1:21:12don't like the contract, then we don't
1:21:13have to sign it. But if we don't make
1:21:15this resolution, we can't even look at
1:21:17them.
1:21:20>> No. Any other question?
1:21:22>> Okay. You ready for the vote?
1:21:24>> Yes.
1:21:24>> All in favor?
1:21:27Opposed?
1:21:29>> Okay. Motion carries.
1:21:30>> Thank you, council.
1:21:33>> Okay.
1:21:35Brings us to item number 10.
1:21:39Consider and approve a resolution and
1:21:41agreement with the Texas Department of
1:21:42Transportation for the temporary closure
1:21:44of the state right away for Christmas
1:21:46and quiet.
1:21:49Council,
1:21:51>> I move that we approve the resolution.
1:21:55>> I second.
1:21:57>> Okay, it's been moved and second. Ready
1:22:00for the vote? Any discussion?
1:22:02>> Yes. I just have I I want to let you all
1:22:05know that I'm in favor of the U
1:22:07Christmas on the square. Um but I just
1:22:10want to I have a question. I just want
1:22:11to like to know it has um that we are
1:22:15providing the insurance uh for that
1:22:17event.
1:22:18>> No, ma'am. Say that again.
1:22:20>> No, ma'am. We're we're not allowed to
1:22:22pay for the insurance. They do.
1:22:24>> They had us as additional insured.
1:22:26>> Say that again.
1:22:27>> They include us as as additional
1:22:29insured. They pay for that thing.
1:22:31>> Okay.
1:22:31>> Not us. Okay, that's what I that's what
1:22:33my question was.
1:22:34>> Yes, ma'am.
1:22:34>> Was that we were paying for
1:22:37>> You have any more?
1:22:39>> Okay. Anything else? Okay. Ready for the
1:22:41vote?
1:22:42>> Yes.
1:22:42>> All in favor?
1:22:45Opposed?
1:22:47Motion carries. Brings us to the
1:22:49executive session.
1:22:51Personnel matter of deliberation
1:22:54regarding the retirement of the fire
1:22:56chief. At this time we'll
1:22:58>> mayor if you don't mind can you call for
1:23:00both executive session agenda items that
1:23:02way we can address both
1:23:04we won't have to come back and item
1:23:06number 11 and item number 12 government
1:23:09code 551074
1:23:11personnel matters deliberation regarding
1:23:14the possible appointment and
1:23:16reassignment and duties of an interim
1:23:18fire chief.
1:23:20Okay, at this time

1:23:25Yeah.
1:23:49Take a seat.
1:23:57All right,
1:24:13goodbye.
1:24:29I'm good at

1:52:15I don't know.
1:52:42What's
1:53:05It was [snorts] hot.
1:53:12>> Yeah.
1:53:25I'm sorry.
1:54:11You that my baby.
1:54:40>> It's crazy.
1:54:42It was like
1:55:09warmer out here. It definitely did.
1:55:55It's probably
1:56:30Is yours
1:56:45like this?
1:57:22First
1:58:01He's a He's a
1:58:07You don't

1:59:33Freeze.

2:08:52two or three.
2:08:56>> [clears throat]
2:09:15>> Don't you a fire
2:09:23>> and we can do them both together. Oh, we
2:09:25have to do them separate. We have to do
2:09:27them separate.
2:09:28>> Okay.
2:09:30Okay. We're officially back in session.
2:09:32And since the executive section had two
2:09:34parts, the 11 and 12, the first one we
2:09:37do 11 uh and and it's open for the um
2:09:42accepting
2:09:44the retirement of the fire chief.
2:09:50>> Mayor, Councilman, I'll begrudgingly
2:09:53accept the retirement of Mr. [name] Fzen
2:09:55as fire chief.
2:09:56>> I begrudgingly second.
2:09:59[laughter]
2:10:00>> Are you ready for the any discussion?
2:10:03>> Ready for
2:10:06[laughter]
2:10:08>> I gradually accept.
2:10:11>> All right. All in favor?
2:10:15Opposed? Motion carries.
2:10:17>> Thank you.
2:10:19>> Thank you so much. We appreciate it. And
2:10:21it brings us to item number number 12.
2:10:24uh to uh appoint uh an interim fire
2:10:30chief.
2:10:32>> Yes.
2:10:34Mayor and council move that we um we
2:10:38accept [resident] [resident] as interim fire
2:10:41chief moving forward.
2:10:45>> I second.
2:10:46>> Okay, it's been moved and second. Any
2:10:47discussion?
2:10:49Ready for the vote? All in favor?
2:10:53Motion carries. What's that, Chief?
2:10:56>> All right, Chief.
2:10:58>> Care for anything?
2:10:59>> Okay, we get them.
2:11:01>> Any words?
2:11:05>> I appreciate each one of you. What
2:11:08little bit we've got talking, I'm sure
2:11:09we'll have plenty more time to do so,
2:11:11but anything that
2:11:14I need from you, I won't hesitate to
2:11:16ask. I promise. So, I'll just say the
2:11:18same. If there's any question you have,
2:11:21just ask.
2:11:23pretty simple.
2:11:25>> I'll try to answer any question.
2:11:30>> We're glad. Thank you so much.
2:11:32>> Thank you.
2:11:34>> All right.
2:11:35>> Congratulations.
2:11:37>> Yes. Get a motion to adjourn.
2:11:39>> Uh well, I have a Oh, I'm sorry. Did I
2:11:42miss or do you
2:11:42>> real quick? I just uh just point of
2:11:44information. Um just in general um I
2:11:48kind of when we talking a little bit
2:11:50earlier and I kind of was trying to
2:11:53understand where Chief was coming when
2:11:55he said that he wasn't for sure what
2:11:58kind of information that can be released
2:11:59to me. So um I wanted understand I want
2:12:04to get an understanding of what what was
2:12:07meant by that and
2:12:10>> that's I think you missed that one I
2:12:14I mean we've covered all that's why I'm
2:12:16asking
2:12:16>> session so if you would like to
2:12:18>> No this is a point of
2:12:19>> recommend to put it on there
2:12:21>> no this is a point of information this
2:12:22is point of information from previous
2:12:24question
2:12:25>> I'm really no
2:12:26>> I'm only supposed to act the entire
2:12:29council
2:12:32What do you mean?
2:12:33>> You can't ask me individual questions
2:12:38>> agenda. Okay. Cuz
2:12:40so that's what I'm asking. So when I
2:12:42have when when council has questions or
2:12:44whatever, no one can actually talk with
2:12:47you if they have questions on agenda
2:12:49items.
2:12:59That's correct.
2:13:03>> Mayor's
2:13:05council.
2:13:07>> So to give advice to individual
2:13:11>> at a meeting I mean that's because I
2:13:13know one time
2:13:14>> agenda
2:13:16>> agenda would make a difference.
2:13:17>> Okay. But it's a point of information
2:13:20that I was asking. So that's I'm asking.
2:13:23We're not under even agenda item to ask
2:13:25a point of information.
2:13:27>> Well, we mean
2:13:29>> on a previous you can ask point of
2:13:31information on a previous uh issue or
2:13:33previous question.
2:13:35>> Can you not
2:13:36>> legal opinion or
2:13:39>> can you not I mean I'm just got a point
2:13:40of information on I mean it's a
2:13:43information on receiving documents and
2:13:46things on behalf of the council behalf
2:13:49of the city.
2:13:50>> Where was that on the agenda? We were
2:13:52discussing that during the policy.
2:13:56>> The agenda item is whether you accept or
2:13:58don't accept the policy.
2:14:01>> But when you have questions about the
2:14:03policy, he gave us opportunity to
2:14:05discuss the policy
2:14:07>> and we were in discussion.
2:14:08>> We did but I was
2:14:11>> we in discussion of policy
2:14:13>> and so
2:14:16>> I think we but anyway
2:14:18>> if you want to put something on the
2:14:20>> Okay. The reason I asked I'm just going
2:14:22to go.
2:14:23>> You could ask me if something in there
2:14:24was illegal in the policy and I could
2:14:26answer that.
2:14:27>> Okay. You're trying to decide if you
2:14:30like it or not.
2:14:30>> No, no, no.
2:14:32>> No. I'm not trying to decide if I like
2:14:34it or not or anything like that. It was
2:14:36just one of the what was um said while
2:14:38we were in discussion.
2:14:57Is it any uh new business?
2:15:00>> Um well well okay
2:15:03I just I just
2:15:04>> Okay.
2:15:05>> I do have a question um to to [name] um on
2:15:10the information that um
2:15:13that I had requested. Is this for
2:15:15>> Okay, that has nothing agenda item.
2:15:17>> No. Did you get this information?
2:15:21>> Agenda item.
2:15:21>> Okay. My my USB.
2:15:24>> Uh, we can't discuss it right now. It's
2:15:26actually illegal. So, um,
2:15:28>> you can approach me and ask me for any
2:15:30information and you've had the
2:15:32opportunity to,
2:15:33>> but you can't do it. It's not an agenda
2:15:36>> item right now. So, that's something
2:15:38totally different. We We've already
2:15:39concluded agenda.
2:15:40>> I just I just have point of information.
2:15:43>> that's not a point of That's not a
2:15:44point.
2:15:44>> That's not a point. That's
2:15:46>> a point of information. We'll put this
2:15:48another time.
2:15:50>> We've covered the agenda.
2:15:51>> Yeah. Uh well, I do have another point
2:15:53of information. Is that on the new
2:15:55business items?
2:15:56>> Okay. You can put you can make a request
2:15:58to put
2:15:59>> on new business items. My question is um
2:16:02>> is it not? No, no, no, no. You have to
2:16:05make you have to make
2:16:08>> Well, my my question is is if I need to
2:16:10make a motion to put an item on the new
2:16:12business. Yes.
2:16:13>> Does [name] have to make one as well
2:16:15>> because he's been placing items on the
2:16:17agenda?
2:16:17>> No, ma'am. Without No, you just make
2:16:20Okay. Wait, let's just go back. This is
2:16:22what the new business says.
2:16:24>> Well, I'm just asking about the new
2:16:26business.
2:16:26>> Okay. Do you want to make a motion to
2:16:28put something on the agenda?
2:16:30>> That's it.
2:16:32>> That's all you can do at this point.
2:16:33>> So, so anybody can put new business So,
2:16:35anybody could put an on the agenda.
2:16:40>> That's what I'm asking. I'm like I'm I'm
2:16:41>> we really need to stop discussing this.
2:16:43Okay.
2:16:43>> That's not what you're here to do. Ask
2:16:46that question. What you're here to do is
2:16:47are you putting one on the agenda or
2:16:51>> That's what I'm ask.
2:16:52>> Uhhuh. So what I'm asking if if if the
2:16:55council places the item on new business
2:16:57then does the the uh administrator place
2:17:00item on new
2:17:01>> but just not part of you making a motion
2:17:05to put something
2:17:07information on this on on the new
2:17:09business. No. Okay. Do you want to
2:17:13>> motion?
2:17:15Okay. No, I don't have a motion to make.
2:17:18Not at the moment.
2:17:19>> Okay.
2:17:21>> Let's go.
2:17:22>> Motion to adjourn.
2:17:24>> I second that.
2:17:34>> Did you put my uh place on that?
